New Referral System to Enhance Access to Healthcare for Teachers

Teachers will now be able to access better specialized care after the referral management system was overhauled.

According to Minet Kenya, the referral process of the Teachers Service Commission (TSC) Teachers’ Medical Scheme was streamlined to ensure that beneficiaries requiring specialized reviews, tests, procedures, or medications are promptly referred to the appropriate hospitals.

Following consultations with TSC, Minet said that 17 hospitals across the country had been designated as referral facilities.

In a press statement on February 5, Minet explained that the adjustments to the Scheme’s medical service providers are in line with National Protocols for Levels 4, 5 or 6 hospitals.

“The panel has more than 800 medical service providers. Of these, only about 60 are on a referral basis across the country,” the statement read in part.

Minet had moved to quell teachers’ anxiety over the change of the panel of accredited medical facilities. Minet underscored that it will continuously prioritize the provision of high quality care for teachers and their dependants.

“Minet reassures all teachers under the Scheme that they can continue to access services from accredited medical providers within the Scheme.”

The Scheme has 487 private, 146 public and 133 mission hospitals, and 63 anchor clinics run by Bliss Healthcare in which beneficiaries can access inpatient, outpatient, dental, optical, and maternity services. The facilities range from level 4, 3B, 2, 3A, 5, 6B, 6A to 4B.

TSC rolled out the Scheme in 2015 as a remedy to the inadequate medical allowance provided to teachers.

The Scheme is designed to address the unique needs of teachers and their families, with the beneficiaries enjoying access to IVF treatment at the county level, overseas treatment, and psychological telecounselling services available round the clock.

The 2022 Minet TSC contract runs for three years, serving more than one million teachers and their dependants. The Scheme registers about 7,000 outpatient visits every day, 300 new hospitalizations per day, 400 dental cases daily, and 400 optical cases in a day.

Teachers Want Time Off to Run for Political Positions in 2027

Teachers Want Time Off to Run for Political Positions in 2027

Teachers are asking for official time off so they can run for election positions in the upcoming 2027 general election.

Through Malel Langat, the deputy secretary general of the Kenya National Union of Teachers (KNUT), they expressed their desire to compete for six seats without having to give up their teaching certificates or jobs, unlike other professionals such as lawyers and doctors.

Currently, the law requires teachers to resign before running for office, but they believe this should change so they can return to teaching if they don’t win.

The union is suggesting a 90-day leave for campaigning and elections. This way, if they don’t succeed, they still have their jobs to fall back on.

During a meeting in Mombasa on May 3, 2025, Mr. Malel also urged the Teachers Service Commission (TSC) to promote teachers who have been in the same job group for three years.

Additionally, he is asking for a 60% salary increase as part of their new agreement for 2025-2029. This includes a 30% raise in allowances and another 30% increase in basic salaries.

He also called for a risk allowance for science teachers working with junior secondary schools.

The TSC has previously prohibited teachers from engaging in political activities. In a notice issued on December 1, 2020, TSC leader Dr. Nancy Macharia warned that any teacher or staff member found guilty of this would face consequences.

Here is the full notice from the TSC:

RESTRICTION OF EMPLOYEES OF THE TEACHERS SERVICE COMMISSION FROM PARTICIPATING AND/OR ENGAGING IN ACTIVITIES AND AFFAIRS OF POLITICAL PARTIES

The above captioned matter refers.

The Commission is in receipt of a Circular, Ref: EACC.7/10/4 VOL.VII (61) dated 1/10/2020, amplifying the above provisions of the law.

Pursuant to the provisions of Article 77(2) of the Constitution of Kenya as read together with section 23 of the Leadership and Integrity Act, 2012; section 12 of the Political Parties Act, 2011; and regulation 187 of the Code of Regulation for Teachers, Clause 166 of the Human Resource Policies & Procedure Manual for Secretariat Staff, public officers are prohibited from holding office and/or actively engaging in political activities.

Accordingly, this is to remind all employees of the Commission of the explicit positions of the law prohibiting them from taking part in any active political engagements while still in service of the Commission; and further requiring them to refrain from:

1. holding office in a political party;
2. engaging in a political activity that may compromise or be seen to compromise the political neutrality the office they hold;
3. publicly indicating support for or opposition to any political party or candidate in an election; and
4. engaging in activities of any political party or candidate, or act as an agent of a political party or candidate in an election.

In congruence with the spirit of national values and good governance under the Constitution which includes impartiality and political neutrality, it is vital for all employees of the Commission to adhere to strict observance of the law in respect hereof by abstaining from taking part in political engagements.

In this regard, all employees of the Commission are directed to shun partisan political activities while in active public service.

The Commission further brings to your attention that any of its employees who currently holds and/or engages in political activities is in violation of the law and is liable to disciplinary action.

This is therefore to advice such an employee to immediately resign from such office.

Further, any breach of the directions of this Circular shall result in disciplinary action.

All County Directors are hereby directed to bring the contents of this Circular to the attention of ALL the officers and teachers serving under them.

Likewise, all Institutional Heads are equally directed to bring the contents of this Circular to ALL teachers and to post the same on school/staffroom notice boards for ease of reference by teachers.

TSC postpones TPAD2 training sessions

The Teachers Service Commission, TSC, has postponed the County based TPAD2 training sessions for teachers. The exercise that has been running for the past few weeks has now been halted as a result of the spiraling covid19 infection rates among the teachers.

Teachers who were hoping to be inducted on the new TSC appraisal system will now have to wait a little bit longer.

“Following the upsurge of the Covid-19 disease in the County with reported Cases amongst our teachers in the County, the Commission has with immediate effect stopped all scheduled TPAD Training for Principals, Headteachers and teachers.” Reads a memo sent by Laikipia County TSC Director, Mrs. Murrey.

So far, over 30 teachers have succumbed to the killer disease since schools were reopened for form four, class eight and grade four learners.

She is directing that the exercise shall resume only upon advise and that all other activities/meetings that require gathering be equally cancelled and instead encourages virtual meetings.

She warns of dire consequences should the directive be defied by Sub County Directors.

“This directive should be taken with the seriousness it deserves. Observance of the MOH Protocol on the containment of the Covid-19 MUST be observed at all times in and outside the working stations.” She reiterates.

TSC Boss Dr. Nancy Macharia on Monday ordered teachers aged 58 years and above together with those with pre-existing conditions to stay at home. Macharia said that it is a Presidential directive and the teachers will not be sacked for staying at home.

“As this is a presidential directive, your employers will not sack you. The TSC has negotiated for teachers to be covered for Covid-19-related illnesses.” She told the media on Monday.

In other Counties the exercise has already been concluded. For instance, about 500 teachers, school heads and principals were successfully trained in Nyamira South Sub County; found in Nyamira County. Primary school teachers were trained for on November 12th and 13th at Kebirigo Boys High School with their secondary school counterparts being inducted on November 16th and 17th; at the same venue.

The exercise was presided by the TSC County Director in Nyamira, Wilson Koros. He said the Commission was taking the appraisals serious and future promotions will entirely depend on an individual teacher’s TPAD performance.

Hardship Areas List; TSC scraps off some areas from the list

The Teachers Service Commission, TSC, has reviewed the list of areas designated as hardship. According to the Commission, payment of hardship allowance will no longer be paid to the staff in the scrapped areas.

All Sub-counties in Nyandarua County have now been scrapped off the list of hardship areas. Also affected are Kigumo, Murang’a, Kandara and Nyahururu Sub- Counties.

New list of TSC designated hardship areas.

TSC has designated various areas as hardship. The areas considered as hardship include those that are prone to terrorism, famine and aridity. As of 2012, TSC had about 38 areas approved as hardship.

Currently, teachers teaching in schools located in some parts of the following counties receive monthly hardship allowances.

S/NO. AREA/ COUNTY
1 Garissa County
2 Isiolo County
3 Kilifi County
4 Kwale County
5 Lamu County
6 Mandera County
7 Marsabit County
8 Narok County
9 Samburu County
10 Taita Taveta County
11 Tana River County
12 Turkana
13 Wajir County
14 West Pokot County

HARDSHIP ALLOWANCE

The Teachers Service Commission, TSC, pays extra allowances (hardship allowances) to teachers working in areas classified as hardship. While classifying an area to be a hardship area, the locality must meet any of these conditions:

  • Lack of or unavailability or inaccessibility to food,
  • Inadequate transport and communication network,
  • Limited basic social services and amenities,
  • Persistent harsh climatic conditions like flooding, landslides and drought,
  • Insecurity and high possibility of security threats.

Hardship allowance is therefore paid in an effort to compensate for the cost of living for teachers working in areas designated as hardship. Like stated above, teachers working in hardship areas face a myriad of challenges; from lack of water, flooding to hostile living conditions characterized by constant spates of attacks.

Hardship allowances

In December, 2014, the Salaries and Remuneration Commission, SRC, reviewed hardship allowance to be paid at a flat rate for all equivalent grades/ job groups. The Commission effectively abolished the pegging of the hardship allowance as a percentage of basic pay.

The table below summarizes the monthly hardship allowance rates that are paid to teachers working in hardship areas; per job group:

S/NO GRADE TSC SCALE FORMER JOB GROUP Hardship Allowance- in Kshs per Month
1 B5 5 G 6,600

Interdiction letter for TSC teachers

The Teachers Service Commission, TSC, may decide to reverse the interdiction of a suspended teacher. In such a case, the Commission sends a revocation of interdiction letter to the teacher.

Several reasons may make the TSC to reverse the interdiction of a teacher. A number of reasons may precipitate such a decision. These include:

  • Irregular and faulty interdictions i.e if the Commission detects malice in the allegations made,
  • Interdictions being done without adherence to the laid down procedures e.g. failing to give teachers an opportunity to appear before the investigation panel together with the accusers and witnesses to defend themselves against the allegations raised.
  • Poor and inadequate investigations at the institution/county level,
  • Delays in submission of supportive evidence e.g. availing duly signed Board Of Management minutes, statements and report in support of allegations raised.
  • Issuing casualty returns on desertion before expiry of fourteen (14) days.
  • Failure to fill in/forward casualty and casualty/ appointment returns on time.
  • Failure to carry out prompt and exhaustive/comprehensive investigations prior to interdiction.
  • Failure  to involve the Board of Management, BOM, during investigation process,
  • Failure to give specific charges on interdiction.

TSC revocation of interdiction letter format.

Upon consideration by the Commission, the teacher will receive a revocation of interdiction letter. See a sample below;

RE: REVOCATION OF INTERDICTION

Blow to TSC Intern Teachers as Court rules against their push for PnP employment

Intern Teachers employed by the Teachers Service Commission, TSC, have been dealt a big blow over their quest to have their terms of employment changed to Permanent and Pensionable (PnP).

Weeks after the Employment and Labour Relations Court (ELRC) found their employment contracts to be illegal, the court has now directed that the status of their employment should remain. This is until the commission either gets temporary orders from the Court of Appeal or reaches a compromise.

Justice Byrum Ongaya, however, gave TSC a grace period of three months, meaning that it has to seek intervention from the higher court or absorb all the affected teachers on permanent and pensionable terms.

The latest directive has caused uproar among the contract teachers who hold that their terms must be changed to PnP.

In the meantime, TSC moved back to court to suspend the judgment claiming that it would jeopardize its plan to employ the interns next year.

However, Justice Ongaya said the application meant that TSC was asking him to sit on his own judgment.

He however stated that the status quo be maintained until August 1, 2024.

“It is in the interest of justice, it appears to the court that it would be appropriate for the status quo prior to the judgment to be maintained with respect to the findings and orders of court in the judgment, pending a compromise or rearrangement of the affairs between parties or applicants filing appropriate application at the Court of Appeal,” ruled Justice Ongaya.

Ongaya ruled that TSC had violated the right to fair labour practices by giving the teachers internship positions while they were qualified and possessed teaching licenses.

Elsewhere, this writer has discovered that Members of Parliament have been dishing out employment letters at Constituency level. This has caused jitters to the Interns who feel shortchanged. One wondered how a recent graduate would be employed on PnP while others who graduated earlier are still working on Contract.
