Reprieve as Major Improvements are made to the TSC Teachers’ Medical Scheme

Reprieve as Major Improvements are made to the TSC Teachers’ Medical Scheme; public officers Medical Scheme Fund {Circular}

JOINT COMMUNIQUÉ ON THE MANAGEMENT OF THE TEACHERS’ MEDICAL SCHEME UNDER THE PUBLIC OFFICERS MEDICAL SCHEME FUND (POMSF)

The Teachers Service Commission (TSC), the Social Health Authority (SHA), the Kenya Union of Post Primary Teachers (KUPPET), and the Kenya National Union of Teachers (KNUT) have had a consultative meeting to discuss and address pertinent issues relating to the management of the Teachers Medical Scheme under the public officers Medical Scheme Fund (POMSF) which has been in operation for the past five months since 1st December, 2025.

At the outset we jointly reaffirm our unwavering commitment to the health, dignity, and well-being of the Kenyan teacher. To this end, we have agreed on the following:

  1. Processing and payment of Last Expense Benefit.

Parties confirm that the last expense benefit is a key component of cover payable at the rate of 300,000 upon demise of the Principal Member. The initial 160 claims received by TSC and SHA have since been processed and payment to the Next of Kin will be released effective Wednesday 29thApril, 2026.

As clarified during our last consultative meeting we clarify that the Group Life Cover and Work Injury Benefits Act (WIBA) provisions are not administered under the Social Health Authority (SHA). The Teachers Service Commission (TSC) is actively pursuing a separate budgetary allocation to cover these provisions for teachers.

  1. Allegations of Co-Pay by Teachers.

The provisions of the contract signed between SHA and TSC is crystal clear on this subject. Teachers are guaranteed medical services within applicable limits under the Cover without the requirement of Co-pay.

Teachers are urged to report any cases of denial of services on the basis of Co-pay. The Authority will take stern action on medical facilities found to be charging this unauthorised levy.

  1. Specialized Treatment and In Vitro Fertilization (IVF):

The cover guarantees comprehensive access to specialized services, including advanced cancer care, specialized surgical procedures, IVF and other fertility treatments. SHA has since approved Nairobi West Hospital to offer this service and an official communication will be made before close of business tomorrow.

  1. Overseas treatment.

SHA has finalised the process of contracting overseas facilities to provide service to teachers. The following are the contracted facilities contracted by SHA.

  • Acibadem Mehmet Ali Aydinlar University, Atakent Hospital-Istanbul Turkey
  • AcibademMaslak Hospital-Istanbul, Turkey
  • AcibademAltunizade Hospital-Istanbul, Turkey
  • Acibadem Adana Hospital-Istanbul, Turkey
  • Workhardt Hospital-Mumbai, India
  • Soliman Fakeeh Hospital-Jeddah, Saudi Arabia
  • King Faisal Specialist Hospital- Riyadh Saudi Arabia
  • Apollo Hospitals Enterprise Ltd (Apollo Cancer Centre)-Chennai, India
  • Kims Hospital Enterprises Private Ltd- Andhra Pradesh, India

The authority has issued the guidelines for access to the benefit and has been published on the SHA and TSC website.

  1. Operationalisation of the National Joint Steering Committee:

TSC, SHA, KNUT, KUPPET and KUSNET have agreed to immediately operationalise the National Joint Steering Committee and will meet within 21 days to review the scheme performance and provide oversight on the management of the scheme.

  1. Activation of County Joint Committees:

As agreed in our last meeting, we have activated 47 County Joint Committees. These committees will be chaired by the TSC County Head and will comprise the SHA County Manager and one representative from KUPPET, KNUT and KUSNET. They will convene quarterly meetings or on a need by need basis to facilitate structured dialogue, address emerging operational issues, and enhance communication with beneficiaries. Teachers are encouraged to seek guidance from these Joint Committees.

  1. Ex-Gratia payment:

Following the institutionalization of Ex-Gratia Management Framework, teachers who exhaust their medical limits and are facing catastrophic health financial burdens are required to request in writing for ex gratia considerations. TSC is responsible for financing, receiving, vetting, and routing all ex-gratia requests, while SHA shall be responsible for payment of these approved compassionate claims. We need to emphasize that this is a payment of mercy and its not within the benefits under the cover.

  1. Continuous Member Education:

SHA, TSC, KNUT and KUPPET will immediately co-facilitate a continuous, nationwide member education campaign to empower teachers with accurate knowledge regarding their benefit entitlements, patient portal navigation, and their rights and responsibilities.

SIGNED ON THIS 22ndDAY OF APRIL 2026

Dr. Jamleck Muturi John, MBS, Chairman, Teachers Service Commission.

Dr. Abdi Mohamed, Chairman,Social Health Authority

Dr. Mercy Mwangangi, CBS Chief Executive Officer, Social Health Authority

Ms. Evaleen J. Mitei, MBS Ag. Commission Secretary/CEO, Teachers Service Commission (TSC)

Fate of 44,000 teachers recruited by TSC hangs in the balance

The fate of 44,000 teachers recruited by the Teachers Service Commission (TSC) hangs in the balance after the employer told Parliament that it may terminate their employment if the National Treasury does not allocate funds following a recent Court of Appeal ruling.

The teachers are majorly deployed in junior schools and such a move would leave the schools grossly under-staffed and affect learning in the segment that comprises Grade 7, 8 and 9 under the Competency-Based Education (CBE).

The TSC legal director Cavin Anyuor told the National Assembly Committee on Education that the commission only has the option of employing the teachers on permanent and pensionable terms or terminate their employment after the court declared the teacher internship programme discriminatory, unconstitutional, and illegal.

The ruling was delivered on February 27, 2026. The Court of Appeal upheld an earlier decision by the Employment and Labour Relations Court declaring the TSC internship programme policy null and void. The intervention comes at a time when the interns renewed their contracts for another year, running from January 1, 2026, to December 31, 2026.

“We are in court seeking a grace period to allow the government to organise itself, mobilise the necessary resources, and set clear timelines for implementation before pronouncing itself on the matter. We hope the court will grant us that grace period,” said Mr Anyuor when senior officials of the commission appeared before the National Assembly Committee on Education yesterday.

The commission introduced the programme in 2019 to plug staffing gaps in the service. The Kenya Kwanza regime has touted its mass teacher recruitment programme as one of its successes, but that would now change if the teachers are not converted to permanent and pensionable.

The teachers and teachers’ unions have termed the programme an abuse of labour since the teachers are paid a ‘stipend’ instead of a salary and do not enjoy all the other benefits other teachers enjoy.

The latest cohort of intern teachers, comprising 24,000 most of whom were posted to junior schools, was engaged in January this year, surpassing the TSC’s initial target of 20,000. The January recruitment largely focused on hiring science teachers, as the government sought to address an acute shortage of technical teachers in junior schools.

Mr Anyuor told the MPs that due to the profound effect of the court ruling, the commission has held a crisis meeting and that engagements to chart a way forward are at an advanced stage.

“The commission has also engaged with the government to chart the way forward to either take one of the options,” he said.

More Funds Needed

The chair of the committee, Julius Melly urged the TSC not to discontinue the internship programme, warning that doing so would render thousands of young Kenyans jobless and worsen inflationary pressures.

“The best thing you can do is to impress on the National Treasury for additional funding,” he said during consideration of the Supplementary Estimates 1 for the financial year 2025/2026.

Last week, Education Cabinet Secretary Julius Ogamba told the Senate that the government intends to abide by the Court of Appeal decision, which rendered the teacher internship policy null and void.

“The court was unequivocal that recruiting trained and registered teachers as interns is illegal and discriminatory. What is the Ministry doing to ensure these teachers are absorbed on permanent and pensionable terms,” said Mr Ogamba. He was responding to Kitui Senator Enoch Wambua who raised concerns regarding the status of the educators.

“The Court of Appeal has determined that the policy of internship for teachers is null and void. As we speak, the TSC and the Ministry are studying the ruling to determine the steps required to ensure full compliance. We recognise there will be significant financial and budgetary implications,” the CS stated.

While the CS did not provide immediate timelines, he assured the House that the extent of the legal and financial burden is being calculated to allow for a smooth transition to the TSC payroll.

However, Nandi Senator Samson Cherargei, accused the CS of being cagy regarding the exact costs of the absorption.

“The CS cannot say he wants to comply without telling us if they have requested funds in the supplementary budget. We need to know how much is required and how the transition will happen to ensure it is not done through political favoritism or discrimination,” Mr Cherargei argued.

About a fortnight ago, the Kenya Union of Post Primary Education Teachers (Kuppet) warned that it would leverage legal instruments regarding the continued engagement of 44,000 intern teachers by TSC without confirmation.

Kuppet Secretary-General Akelo Misosi said it was unacceptable for the commission to engage the teachers as interns when they are registered professionals.

“We are giving TSC an ultimatum to style up, because soon we will adopt the legal framework to address this issue,” Mr Misori said.

MPs support TSC in bid to add more allowances for Teachers

Members of the National Assembly of Kenya have rallied behind the Teachers Service Commission (Amendment) Bill, 2024, sponsored by Hon. Abdul Haro, that proposes to standardize teachers’ allowances and end unremunerated acting appointments in schools.

The Bill, which seeks to amend the Teachers Service Commission Act No. 20 of 2012, proposes to formalize various allowances payable to teachers and introduce structured guidelines on acting appointments within the Commission.

In moving the Bill for Second Reading, Hon. Abdul Haro (Mandera South) pointed out the amendments will entrench fairness, predictability, and certainty in the management of allowances in the teaching profession. He added that prolonged acting appointments without remuneration had become a demoralizing trend within the sector.

“We have teachers who act as deputy head teachers or principals for years without being confirmed or compensated. This Bill seeks to formalize and entrench fairness in acting appointments so that teachers serving in such capacities are duly recognized and remunerated,” said Hon. Haro.

The proposed law outlines allowances payable to teachers, including house, commuter, hardship, special duty, responsibility, special school, reader’s facilitation, leave, and transfer allowances. Notably, it restricts acting appointments to a period between one and six months, after which the position must be substantively filled.

Seconding the Bill, Hon. Dorothy Ikara (Nominated) lauded the initiative, describing it as a “shield for teachers against administrative injustices.”

“Teachers have endured anxiety and frustration when serving in acting capacities for years without confirmation. This Bill introduces fairness and structure, ensuring no teacher is left in limbo. Acting teachers must be paid acting allowances, this should not be left to the discretion of the Commission,” she emphasized.

Hon. Ikara added that the Bill aligns with constitutional values under Article 41 on fair labour practices and Article 237, which establishes the Teachers Service Commission.

“Teachers are not asking for favours; they are asking for fairness. Supporting this Bill means supporting the very foundation of our education system and the future of our children,” she stated.

Contributing to the debate, Hon. Joshua Makilap (Baringo North) said the amendments will restore dignity and authority to administrators in acting positions, who often lead schools without enjoying the privileges or respect that come with substantive appointments.

“When a teacher is appointed to act but receives no allowance or recognition, it erodes their authority and morale. This Bill seeks to dignify the teaching profession by ensuring that acting administrators enjoy the privileges that come with their responsibilities,” Hon. Makilap noted.

Lawmakers also commended the Bill for promoting transparency through mandatory consultation between the Teachers Service Commission and the Salaries and Remuneration Commission (SRC) on remuneration structures.

Hon. Robert Basil expressed support, saying the Bill would enhance teacher morale, stabilize school leadership, and improve education outcomes.

Debate on the Teachers Service Commission (Amendment) Bill, 2024 is expected to continue next week.

Tough times ahead for Teachers as TSC seeks more disciplinary powers

The Teachers Service Commission (TSC) is seeking fresh powers in changes that are aimed to expand its administrative and disciplinary powers through draft amendments to the Teachers Service Commission Act.

The changes aim to strengthen discipline and professionalism within the teaching service with conduct of teachers taking centre stage.

The proposed Bill seeks to tighten entry requirements for teaching courses, reinforce the registration and employment framework for teachers and align the commission’s disciplinary measures with national laws.

Under the amendments, TSC would have the power to suspend or deregister teachers found guilty of professional misconduct.

An internal review committee would hear appeals before cases proceed to court.

The draft Bill also introduces new offences, including sexual exploitation of learners, and broadens the definition of serious offences to include acts that “grossly offend public policy and interest”.

The commission presented the draft amendments to the Committee on Education on 4 February in Naivasha.

The committee, chaired by Julius Melly, raised concerns about the wide-ranging changes, noting that they affect nearly every section of the existing Act.

“If the amendments touch on all provisions, why not repeal the entire Act and start afresh?” asked Mandera South MP Abdul Haro.

A TSC representative said the commission opted for amendments rather than repeal to preserve institutional continuity.

TSC legal director Cavin Anyuor added that the draft Bill was prepared under the guidance of the Attorney General’s office to ensure alignment with the constitution and current administrative practices.

The proposal would empower TSC to decentralise its functions through zonal offices, establish new directorates and create an Institute of Teacher Support and Professional Development (ITSPD) to oversee continuous teacher training.

The model is based on the Kenya School of Government, which provides capacity development programmes for public service officers.

The Bill also proposes expanding the definition of ‘institutional administrator’ to include heads of schools, deputy principals, registrars, deans, senior teachers and other administrative staff.

Committee members sought clarification on structure and implementation.

Moiben MP Phylis Bartoo asked whether junior secondary schools would have separate deputies or remain under a single principal.

Junior school teachers (Grades 7–9) have previously staged demonstrations demanding autonomy from primary schools.

They cite the need for independent administration, separate management and improved infrastructure. They argue that being managed by primary school heads, who often lack secondary-level qualifications, undermines professionalism and the effective implementation of the Competency-Based Education.

On the proposed decentralisation of TSC offices, Lugari MP Nabii Nabwera questioned the feasibility of establishing mandatory zonal offices given the financial implications.

The commission currently has no budget allocation for offices in all the more than 400 subcounties.

“What if there are no funds to establish an office in every zone?” Nabwera asked.

The commission also faced questions on disciplinary procedures and coordination with the Ministry of Education.

“Section 35 places disciplinary control with TSC. How will this converge with ministry directives, and what happens when a teacher disobeys?” asked Teso South Mary Emaase.
