TSC warns of fake recruitment advert for 5,000 teachers

The Teachers Service Commission, TSC, has come out to warn teachers and the general public over a fake recruitment circular for 5,000 teachers on permanent and pensionable terms. The fake recruitment advert doing rounds in social media platforms fraudulently says that ‘interested candidates should apply to the secretary, Board of Management of the school where a vacancy has been advertised and submit a copy of the application to the TSC County Director.. not later than 25th June, 2020’.

This is not the first time that scammers have come up with such circulars. But, the commission’s quick response will go a long way in saving hundreds of prospective job seekers who may fall prey to the conmen.

“Please ignore a fake advert about recruiting teachers that is circulating on social media.” warned the commission via a tweet.

OFFICIAL ADVERTS.

TSC posts vacancies on its official site tsc.go.ke. Anything else should be treated with the contempt it deserves.

Indeed the commission is set to employ 5,000 new teachers on permanent and pensionable terms, this year. Also to be hired are 10,000 intern teachers. It should be noted though that the adverts have not been released by the commission.

While presenting the National Budget for the Financial Year 2020/21 in Parliament on Thursday,  Treasury Cabinet Secretary Ukur Yattani said additional teachers will be hired to plug the teething shortage in public schools.

“To increase the teacher to student ratio, I have proposed Ksh 2.0 billion for the recruitment of 5,000 teacher… Ksh 2.4 billion (will be used) for recruitment of 10,000 intern teachers to support the 100 percent transition in schools; and Ksh 300 million for recruitment of ICT Interns to support digital learning in public schools,” He said.

This comes even as the Kenya National Union of Teachers, knut, protests a mone by private schools to ask for financial bail out from the government during the current covid 19 pandemic.

“The demand by the Kenya Private Schools Association (kpsa) for funds from the Government under the pretext that their cash flows has evaporated with unexpected closing of schools to fight the coronavirus pandemic is laughable and an insult to the intelligence of the public which is fully aware of the billions of shillings private schools make annually in terms of profit.” says knut secretary general Wilson Sossion.

Sossion says such funds should be used to hire more teachers instead of being “channeled to boos private enterprises.’

“Teacher shortage in the country presently stands at 125,615. Shortage in secondary schools has risen to 95,258 from 57,380 in November, 2019. In primary schools, the shortage has hit (the) 30,357 mark.” he explains adding that this has been caused by lack of adequate funding to TSC to hire more teachers.

TSC promotions 2021- Dr. MAcharia meets leaders

The Teachers Service Commission (TSC) has moved to resolve a pending impasse over promotion of teachers in some parts of the country. This follows a petition by 16 teachers in Kajiado County who complained about being locked out of promotion by the commission.
This forced the TSC CEO Dr. Nancy Macharia to host a team of leaders from Kajiado County on Friday 30th April 2021. The leaders (who included Hon. Ole Metito Katoo, George Sunkuyia, Judith Pareno and Mary Seneta) were making a follow up on the matter so as to reach an amicable solution.
In the petition, the teachers claimed that they have been locked out from leadership by a system introduced by TSC where only teachers who serve in Job Groups L, M and N are promoted to be headteachers, sub county directors and county directors.

“Through CPGs (Career Progression Guidelines) the Commission has been selectively promoting teachers to the said positions and, therefore, discriminating against deserving cases. All Maasai teachers in Kajiado, are being denied promotion opportunities as a result of the policy,” the petitioners said.

According to the petition, the policy has disadvantaged teachers in Kajiado County who have the requisite experience and skills an opportunity to get promoted.

The teachers say that none of the resident teachers in the county have attained the Job groups L, M and N.

The petitioners, wants the Senate to intervene with a view to have affirmative action by the TSC for appointment to leadership positions of resident teachers and the policy be reviewed to give priority for promotion to leadership positions to resident teachers after which other teachers serving in the county could be considered

Sources in the Friday meeting intimate that the team discussed teacher management issues affecting Kajiado County.
TSC Boss when she met leaders from Kajiado County.
A few days ago, Dr. Macharia appeared before the Senate Committee on Education so as to respond to the petition by the teachers in Kajiado County.

Nominated Senator Judith Pareno accused TSC of open bias and demanded investigations, claiming non-Masaai teachers from one community have taken over schools leadership in the “entire Masaailand”.

“All headteachers and their deputies are non-Masaai, most of them are from one community. We will be seeking to show the committee that there is discrimination,” complained Pareno.

On her defense, the TSC Boss told the Senators that the commission is guided by the Code of Regulations for Teachers in effecting promotion.

“To this end, all promotion above common cadre grades and to administrative positions are filled competitively as per the provisions of the Code of Regulation for Teachers and the Constitution of Kenya,” Said Dr. Macharia.

“Once a vacancy is established, the commission advertises the same through print and electronic media for interested teachers across the country to make applications for the positions.” She added.

The Teachers Service Commission (TSC) is finalizing the interview results for teachers who attended interview for promotions conducted in February 2021. The interviews were carried out between February 8 and 19, 2021 at designated TSC County offices countrywide.

A total of 32,431 teachers who were shortlisted and interviewed. Also ongoing are promotions and deployments of primary school teachers (who have attained degrees) to secondary schools.

Also in the pipeline is Diploma teachers’ promotions interviews.

TSC fires teachers for disrupting CBC training

It is grief and pain for teachers who disrupted new Competency Based Curriculum, CBC, training in April this year. This is after their employer, the Teachers Service Commission (TSC), decided to dismiss some of them for disrupting the training. “Pursuant to the hearing of your discipline case held on 15/08/2019, I am directed by the Teachers Service Commission to inform you that the Commission has carefully considered your case and has determined that you are guilty of the charges levelled against you and that you are hereby dismissed with effect from 15/8/2019,” reads in part a dismissal letter sent to one of the affected teachers.

In May, this year, the Commission interdicted 160 teachers among them 10 union officials for boycotting and disrupting training on the new competency-based curriculum (CBC). The interdictions were effective 5th May, 2019 and the teachers were given 21 days to show cause why action could not be taken against them.

In April there was temporary disruption of training sessions witnessed in parts of Kakamega, Kajiado, Makueni, Homa Bay among other counties. Those interdicted included heads of institutions and Union officials. The interdicted teachers who had responsibilities were directed by TSC to vacate office with immediate effect.

Those interdicted included 58 teachers from 34 schools in Kajiado County.
Efforts by the Kenya National Union of Teachers, Knut, leadership to have the decision rescinded were met by opposition from the Commission; with TSC Boss Dr. Nancy Macharia promising stern action.

The dismissed teachers can however appeal the decision and have their cases reviewed. This should be done within a period of ninety (90) days from the effective date on the dismissal letters.

TSC set to promote school administrators; demote classroom teachers who were erroneously promoted

The Teachers Service Commission, TSC, has come out clean on the state of promotions for teachers. According to the commission a number of school administrators who are due for promotion have not been moved. Instead, some classroom teachers are enjoying higher perks due to an error during data collection by TSC county and sub county directors.

The teachers’ employer  collected data for institutional administrators in in June, 2017. This was supposed to validate and move the administrators to higher grades once the current Collective Bargaining Agreement (CBA) was to be implemented.  But, TSC boss Dr Nancy Macharia now says the commission’s field officers provided inaccurate data leading to disparities in promotions for institutional heads, their deputies, senior teachers and senior masters.

“It has been established that some of you (TSC field officers) provided inaccurate and misleading data leading to errenous conversions (promotions to the new grades after implementing the SRC salary guidelines in 2017),” says Dr Macharia.

“Classroom teachers were converted to grades exclusively reserved for institutional administrators, teachers serving as deputy or senior teachers were wrongly captured as heads while in other instances, staffing levels in terms of required administrators in a school exceeded the optimum establishments contrary to the established staffing norms,” she further explains.

COLLECT DATA AFRESH

A number of school deputy heads and principals have been crying foul over the move by the TSC to snub them.

But, the commission now seeks to recollect the data and clean its payroll. Dr Macharia explains that having unreliable data in the TSC data base has ‘negatively affected the operations of the commission in terms of payroll management and the process of selection, appointment and deployment of new administrators’.

The commission has now directed the field officers to recollect the data and submit the same to the headquarter by June 30, 2020.

“You are hereby directed to critically analyze the data and reconfirm all institutional administrators,” says the TSC boss in her latest circular to the field officers.

Also required is data for schools with extra administrators (teachers with minimum of grade C4 in secondary schools and their counterparts in primary schools having C2) so that they can be appointed to serve in their respective positions.

The issue of teachers’ promotions has been thorny. Most affected are tutors serving in grade C3 (Secondary Teacher) with some having stayed in the job group for over 15 years. and, this has been worsened by the commission’s failure to advertise promotion vacancies for these and other classroom teachers; citing budgetary constraints.

TSC is set to implement the fourth phase of the 2017-2021 Collective Bargaining Agreement (CBA) that was agreed between the Commission and teachers’ unions. The Commission has already implemented the first, second and phases; that were effected in 1st July, 2017, 1st July, 2018 and July 1, 2019 respectively. Read full article here; what teachers will earn per job group after TSC implements the fourth phase of CBA in July, 2020.

In a proposal by the National Treasury post COVID-19 economic recovery strategy, all employed Kenyans will pay one percent of their salaries with their employers topping with a similar amount. Funds collected will go into the yet to be set up unemployment insurance fund (UIF).

“The government will establish a UIF to cushion workers in financial distress by providing them with short-term relief when they become unemployed, or are on unpaid leave or unable to work because of illness….The amount of contribution to the fund with be two per cent which include one per cent paid by employees from remuneration paid and one per cent paid by the employers.” says a report from the National Treasury.

This will add to the long list of statutory deductions on teachers’ payslips. Already teachers pay a mandatory portion of their monthly salaries towards the National Hospital Insurance Fund (NHIF) and the Pay As You Earn (PAYE) tax.

The government through the Ministry of Planning and National Development is set to raise Sh300 Million by 2022 so as to cushion the unemployed Kenyans and those who lost jobs due to the Covid-19 pandemic.

The government has been cushioning the vulnerable in the Society through the ‘Inua Jamii ‘social protection program; thet provides cash to orphans and vulnerable children, older persons and people with severe disabilities.

Next year teachers and civil servants are also expected to contribute towards the new contributory pension scheme.

The government will be rolling out the new pension scheme for all teachers and civil servants on January 1, 2021. All employees in the formal sector are expected to contribute 7.5% of their monthly basic salaries towards the statutory pension scheme.

KUPPET in new demands for teachers’ allowances and salaries

Kenya Union of Post Primary Education Teachers has come up with a raft of demands to see increased perks for its members. In the proposal, KUPPET wants salaries and allowances for its members be reviewed upwards by the Teachers’ Service Commission (TSC) to cushion them against the increased Cost of living. “The cost of living has increased rapidly over the last two years affecting the purchasing power of house hold goods and services. The transport cost has increased beyond the commuter allowance negotiated due to increase of fuel and general overall transport cost”, reads the document presented to the TSC by KUPPET.

PROPOSALS OF NEW ALLOWANCES

The union demands that the following issues may be considered for negotiations to cushion teachers in their delivery of services:

1.COMMUTER ALLOWANCE
The Union demands that commuter allowance be increased by 50% of the current rate. Commuter allowance shall be paid as per Appendix. In the proposal, lowest teachers are to get Kshs. 7,500 while those in higher ranks will get Kshs. 24,000 up from the current Kshs. 16,000 if the proposal is adopted by the TSC.

2. LEAVE ALLOWANCE
The Union demands that leave allowance be paid based on one’s basic pay i.e. an equivalent of one month’s basic pay for all cadres. They want an increased leave allowance of of between Kshs. 27,325-Kshs. 43,694 for the lowest paid teachers in job group C2. Those in the highest job group, D5, are to get a leave allowance of Kshs. 152,000. The leave allowance is payable once a year, with the January salaries.

3.HOUSE ALLOWANCE
The Union demands that House allowance be harmonized across all regions.i.e Teachers in Grade C2 should enjoy the same house allowance whether in Nairobi or Marsabit and this should be in all grades.

4. TOWNSHIP HARDSHIP ALLOWANCE
While teachers enjoy equal house allowance across all regions, the Union proposes the introduction of township allowance. Teachers in urban areas experience challenges of high cost of living and expensive urban transport and this makes no difference with a teacher in a hardship area. We propose a town allowance of 30% of basic salary be paid to teachers in major cities or county headquarters.

5. HARDSHIP ALLOWANCE
Hardship allowance shall be payable to teachers assigned duties in Arid and Semi-Arid Lands (ASAL) areas. However, the areas declared as hardship needs to be reviewed because there are other emerging issues like terrorism, cattle rustling etc.

6. RISK ALLOWANCE
Risk allowance shall be payable to all Science teachers due to exposure to chemicals and other substances. The Union demands that Risk allowance be paid at a rate of 20% of the basic salary as per appendix. This is a new allowance proposed by KUPPET for Science tutors. In the proposal, teachers in job group C2 will get a minimum of Kshs. 5,465 while those in D5 will get a high of Kshs. 30,587 per month.

7. ACCOMODATION ALLOWANCE
Teachers are assigned duties outside the work station. In the civil service, there are guidelines stipulating the allowance for every cadre. The Union has proposed development of clear guidelines on the payment of accommodation allowance (per diem) as well as the amount as shown in the appendix. In the appendix,Teachers in grade C2 are to receive between 6,000 and 3,000 in big cities and others areas respectively. While, those in grade D4 will receive between 10,000 and 5,000

 7. POST GRADUATE SCHEME OF SERVICE
The teaching service has no scheme of service for teachers who have attained a Masters and Doctorate degrees. Instead, the employer awards three increments to the holders of such qualifications. The proposed scheme seeks to allow TSC recruit teachers possessing post-graduate qualifications at entry level. The Union demands that Post graduate scheme of service be developed and be eligible to all teachers holding a Master’s and Doctorate degree. The said teachers shall be paid an allowance equivalent to 40% of the basic salary.

8.CAREER PROGRESSION
Parties agreed that career progression in the teaching service shall be as provided under Part VI of the Code of Regulations for Teachers. However, KUPPET demands that the Commission in performance of its obligation under this agreement ensures that every teacher under its employment is facilitated to undergo professional development.

9.OVERTIME ALLOWANCE
KUPPET demands that working hours for all teachers be 8 hours per day i.e. 8.00 am. to 5.00 p.m. with one hour lunch break for five days i.e. 40 hours per week – Monday to Friday. Further, the Union proposes that any extra hours worked be compensated as an overtime as teachers in boarding sections are overworked and no monetary compensation are done. The overtime allowance schedule is attached as per Appendix.

10. COMPREHENSIVE MEDICAL COVER
We propose that medical allowance be increased by 100% to enable the employer improve health benefits with insurance underwriters. This has been a major cry from most teachers who want the TSC to revoke the AON medical scheme that they term as inefficient.

11. TEACHERS’ SALARY INCREMENT
The 2016 basic salary increment be varied to align the increment with challenges of inflation.

OTHER ISSUES

TheUnion also wants these other issues addressed with immediate effect

  • The marking scheme for employment of Diploma teachers is discriminating and unfair to diploma teachers. We propose it be reviewed so that they are given same marks as graduates.
  • Special schools allowance terminated without consultation should be reinstated.
  • Annual increment for teachers seems not clear. Not all teachers have been given the same.
  • There should exist common cadre grades to show job group progression as before the CBA 26th October, 2016.

It remains to be seen what response  the TSC will give to the proposals. the TSC has been adamant on increasing teachers’ perks and promotions saying they are implementing the current CBA that runs to 2021.

Education CS urges KNUT and TSC to drop hard-line stands

Education Cabinet Secretary, Amb. Amina Mohammed, has urged both the Kenya National Union of Teachers, KNUT, and the Teachers Service Commission, TSC, to drop hardline stands and negotiate to solve industrial disputes in the sector. Speaking to journalists in Nairobi, today, Amina urged both parties to embrace dialogue and avoid taking hardline stands.

“There is a negotiation that is ongoing. It is constructed on a conditional dialogue. We all have to learn to have discussions in peace. We must learn to compromise,” the CS said.

While advising that in negotiations it is a give and take scenario, Amb. Amina told both parties that it was in bad faith if any one party wanted all its demands met. “No one can walk away from a negotiation table with everything they wanted; then it is not a negotiation, it is basically a dictatorship,” added Amina.

This advice is coming as both the KNUT and TSC continue pointing accusing fingers at each other over the aborted Naivasha talks. The TSC claims that the KNUT leadership came into the meeting with a list of 85 teachers whose transfers they wanted revoked immediately, by the employer.

Speking to the media on Thursday, KNUT secretary general, Hon. Wilson Sossion, warned of dire consequences if the TSC does not come up with solutions to the contentious issues, in 2 weeks’ time. Immediate stoppage of the delocalization of teachers, scrapping of the Teacher Performance contracting & evaluation and promotion of teachers upon attainment of higher qualifications are among the issues fronted by KNUT for discussion.
