Full address by President Uhuru Kenyatta today on the 8-point stimulus programme

Here is the Presidential address on the Coronavirus pandemic: The 8-Point Stimulus Program, Saturday 23rd, May 2020;

“Today I want you to reflect on the state of our economy with me. 

But before I invite you to do so, let me first make an observation. Whenever we talk to you about the economy, we bombard you with figures and statistics without a human face.

Yet behind these figures are real lives. 

There is a hardworking farmer who mixes his sweat with the soil in order to feed his or her family and our communities;

a diligent mother who has the double role of nurturing the family and maintaining a full-time job;

an aspiring and driven young person, with hopes and dreams for tomorrow;

and an impatient teen who cannot wait to grow up and be a part of the game. 

But when we give you economic figures, you never see the faces of these Kenyans. 

Today, I will paint a picture of these Kenyans.  

The Coronavirus pandemic will continue undermining our efforts to revitalize the economy for the unforeseeable future.  The rate of infections may SURGE upwards if we FAIL to comply with the protocols issued by the Ministry of Health. It is my prayer that we heed the call and conduct ourselves with responsibility and 

As of this morning, we have cumulatively tested 57,650 samples, out of which 1,192 persons have tested positive for the Coronavirus disease, with 50 of our compatriots having so far, succumbed. 

Because of the effects of this pandemic on the economy, there are Kenyans who have been stripped off their dignity, they cannot feed their families or pay their rent. 

Many of these Kenyans find themselves in a vulnerable and difficult situation. 

And that is why EVERY week, my Administration, has been dispatching a total of 250 Million Shillings to vulnerable families.

And you may ask WHY we have chosen to directly send the money to these vulnerable groups?  We are MOTIVATED by two reasons.

One, in the past, if a family could not feed itself because of floods or famine, or other such natural calamities we rushed to give them FOOD RELIEF. 

Government got suppliers, gave them resources to buy the food and arranged for the logistics of distributing the relief to those in need.

Unfortunately, with this measures we only discovered with time.

We noted that half the financial resources given to relief suppliers were LOST to BROKERS and logistics. 

Very little of such resources reached to the targeted groups. We had to change this method of support delivery by leveraging on technology through cash transfers directly to the families. 

This way we have by-passed BROKERS and CARTELS.

Two, we have catalyzed the local economies by injecting 250 million shillings each week through these families.

Money in the hands of a family, gives them power to make economic choices in their local spaces and not depend on lining up to receive food donations. 

And these choices catalyze and build the economy from the bottom up. 

During these unprecedented times of CORONA VIRUS, we have to cushion the economy from below and not from top down.

Now, I will PAINT a second PICTURE.  It is about our young people. 

Our nation is made up of over 70% young people. 

Although this gives me hope, because a young population is better equipped to fight the Corona virus, it also WORRYING.

Worrying because, during a pandemic like the one we have, the SHEER ENERGY of our young population will FIGHT the VIRUS, alright. 

BUT in the process, their energy could also be misdirected. 

And this is why we MUST direct it to constructive use.

 As we fight this VIRUS, I have started to HARNESS the ENERGY of our young people, engaging them in the National Hygiene Programme – Kazi Mtaani Initiative.

Under this programme, we will SPEND a total of 10 Billion shillings engaging our youth in restoring public hygiene standards, urban civil works, and other public undertakings. 

Currently, during the trial period the number of youth engaged is 26,000; we intend to increase that number to 200,000 youths, across the country.  

And to make it sustainable after the COVID crisis, we will regiment them into livelihood guilds. These are small groups of young people with a purpose, and a passion for Kenya. 

Working with county governments, we will look for ways of generating work for them.

We are making this endeavor through an urban renewal programme to upgrade and to modernize our towns and cities; we want our towns to be clean and green, just like Singapore is.  There is no reason why Kenya cannot be.

Fellow Kenyans,

This COVID-19 pandemic is not only a health crisis, it is fundamentally an economic crisis.  Jobs have been lost, businesses have closed and the economy is on a go-slow.  To combat the effects of this down-turn, my Administration has had to take additional measures.

Today, I am happy to announce the rolling out of my 8-Point Economic Stimulus Programme, amounting to a total of Ksh 53.7 Billion. 

The injection of this money into the economy will stimulate growth and cushion families and companies as we navigate our way out the COVID-19 pandemic.

The first element of the 8-point programme will focus on infrastructure.  Following the ongoing rains, road infrastructure has been adversely affected across the entire country.  To address this challenge in the short term, as a Government, we intend to rehabilitate access roads, footbridges and other public infrastructure.

We have set aside a total of Ksh. 5 billion to hire local labour for this undertaking. 

We are convinced, with the use of local labour and local construction materials, in line with our “Buy Kenya Build Kenya” Policy, we will stimulate and support micro and small business enterprises.

The second element of the stimulus programme will be about education. I know the anxiety weighing on the minds of parents and their children in regard to when schools will re-open. We will in the very near future, be communicating, what plans and programmes we have for the education sector. In that regard, we have allocated an additional budget of KSh. 6.5 Billion to the Ministry of Education. 

The purpose of this is to hire 10,000 teachers and 1,000 ICT interns to support digital learning.  The programme will also support the improvement of school infrastructure, including acquisition of 250,000 locally fabricated desks.  The aim is to get thousands of our graduates off the bench and into action while we support local artisans and builders businesses.

The third element of the programme will target Small and Medium Enterprises.  During this COVID pandemic, the liquidity of these enterprises has been adversely affected.

The stimulus programme will deal with this in two ways.  First and Foremost, we have allocated Ksh 10 Billion to fast-track payment of outstanding VAT refunds and other pending payments.  I am also happy to note that just yesterday, we released Ksh. 30 Billion towards payment of pending bills in the roads sector.

In addition to this, we will inject Ksh 3 Billion as seed capital for the SME Credit Guarantee Scheme.  The intention here is to provide affordable credit to small and micro enterprises. 

And to do so in an efficient and structured manner, borrowing from the professional standards and practices of private sector credit arrangements. 

Health is our fourth target of the 8-point stimulus programme.  My Administration intends to  hire an additional 5,000 healthcare workers with diploma/certificate – level qualification for a period of one year. This will not only enhance our COVID-19 response capability but also enhance the implementation of the Universal Health Coverage (UHC) programme.

Further, the stimulus programme will set aside Ksh.1.7 Billion for the expansion of bed capacity in our public hospitals. I encourage the Ministry of Health to utilize our Jua Kali Sector in this endeavor.

Similarly, resources will be pumped into our medical research facilities to enhance their research capacity, which is critical to generation of new innovations in the medical field. 

But with the extra resources, these facilities will also undergo some level of reforms to optimize their performance. 

Fellow Kenyans, we will in due course announce a raft of reforms in our research institutions. I am persuaded that these reforms will upscale our medical research facilities to a standard that can rival the best in the world.

The fifth element of the stimulus programme will focus on agriculture.  My Administration has prioritized Ksh. 3 billion for the supply of farm inputs through e-vouchers, targeting 200,000 small scale farmers. 

This is meant to cushion farmers from the effects of adverse weather, and to secure food supply chains in the post COVID-19 period and into the future.  Further, under this programme we have allocated Ksh. 1.5 billion to assist flower and horticultural producers to access international markets, in a period where we have a shortage of flights into and out of the country. 

 These interventions will support the sustenance of our farming communities and provide continued gainful employment for thousands of workers in our bread basket areas.

Tourism is the sixth area of target for the stimulus programme.  This sector has suffered the most – because of restricted movements, and termination of international flights.

To jumpstart this important sector, and protect its players from heavy financial losses, my Administration will provide soft loans to hotels and related establishments through the Tourism Finance Corporation (TFC), and A total of Ksh 2 Billion will be set aside to support renovation of facilities and the restructuring of business operations by actors in this industry.

In addition to this, funding will also be set aside to support the operations of our premier hospitality institution, Utalii College, to guarantee the steady supply of well-trained hospitality professionals.

The tourism component of the stimulus programme will also engage 5,500 community scouts under the Kenya Wildlife Service at a cost of Ksh. 1 billion.  Additionally support will be made available to approximately 160 community conservancies at a cost of Ksh. 1 billion.

Fellow Kenyans, we want to green our country and hence the seventh element of the stimulus concerns the environment.  To mitigate the impact of deforestation and climate change, and to enhance the provision of water facilities, my Administration will rehabilitate wells, water pans and underground tanks in the Arid and Semi-Arid areas. For this purpose, we have set aside Ksh. 850 million.  A further Ksh 1Billion has also been set aside for flood control measures; and another Ksh 540 Million for our Greening Kenya Campaign.

 Our Eighth and final element of the stimulus programme is manufacturing.  As a strategy, we will enforce the policy on “Buy Kenya Build Kenya”.

To this end, my Administration will set aside an initial investment of Ksh. 600 million to purchase locally manufactured vehicles.  This is expected to sustain the operations of local motor vehicle manufacturers, and the attendant employment of workers.

 I also want at this point to thank the National Assembly and Parliament as a whole for its incisive and speedy consideration and approval of the tax measures my Administration proposed to spur the economy – by ensuring that employees have more of their earnings available to them to spend and to reduce the corporate tax burden as an incentive to business enterprises.

I therefore take this opportunity similarly urge the August House to consider, on a priority basis the Budget Proposals to anchor my 8 – Point Economic Stimulus Programme in order to release this money to Kenyans who are in need.

Finally, my Fellow Kenyans, the challenges of the moment have put us on a new road.  And the twists and turns of this road are unknown.  Not only to us, but to the world at large.  Every Country is struggling to find a way forward.

But I am comforted by only one thing about Kenyans.  Throughout our history, we are on record as a people who know how to do a good fight.  And we have proven this over and over again.  If we stay the course, we will overcome this challenge as we have done in the past.

 I urge all of us to remain true to our country and confident that the endurance we are so famous for will drive us to victory.

I take this early opportunity to wish our Muslim Brothers and Sisters a Happy Idd-Ul-Fitr.

Why being an Examination Centre Manager during KCPE, KCSE Exams is one of the most risky jobs in Kenya

A Centre Manager is, mostly, a head teacher (Primary schools) or a principal (Secondary schools) of a school where a National Examination (KCPE or KCSE) is carried out. The Centre manager is appointed by the Kenya National Examinations Council, KNEC, after secondment from the employer; the Teachers Service Commission (TSC). During the examination period, the Centre manager is directly answerable to the TSC Sub County Director. As a Centre manager, the head teacher or principal must always be on high alert to spot any happenings within the school vicinity that may jeopardize the examination process . Since the buck stops with the centre manager, this job is considered one of the most risky. We sample a few reasons that make this job treacherous:

  • Collection and returning of Examination Materials

It is the sole responsibility of the Centre Manager to collect and return examination materials from and to collection containers, daily, for the entire period of the examination administration. The Centre manager must wake up very early in the morning to be at the collection point (KNEC Container) for dispatch of the examination materials. Already, two centre managers have been arrested  in Meru County, today, during the first day of the KCPE exams- 2018. It is reported that the said Centre managers reported to work while under the influence of alcohol and also arrived late at the KNEC container; to pick the tests. Some other centre managers are facing the same fate; infact, a handful of others were disciplined last year.

  • Lethal penalties in case of examination malpractice

The Centre manager bears the brunt for any examination irregularity at his/ her examination centre. This year, in June- 2018, the Teachers Service Commission (TSC) sent home a number of principals of schools whose candidates had their Kenya Certificate of Secondary Education (KCSE) examination results cancelled; last year, 2017. A TSC report showed that six principals of secondary schools that accounted for a large part of the cancellations, with 1,022 candidates affected, were given marching orders by the employer.  According to TSC’s Chief Executive Officer, Dr. Nancy Macharia, about 60 teachers faced interdiction over the 2017 KCSE national examinations irregularities. The KNEC act, of 2012, gives tough guidelines geared towards safeguarding the integrity of the National tests. Any slight mistake may land the Centre manager in big trouble. The Centre manager must safeguard the examination materials and deliver them to the examination centres and collection points, no matter what. Last year, an image of a centre manager wading through raging waters, after a heavy down pour and with the exam materials tightly held, went viral.

  • Many other responsibilities.

Apart from carrying out his/ her duties as the school’s head, the Centre Manager performs many other responsibilities as stipulated by KNEC. These responsibilities are contained in the KNEC commitment letter that the centre manager must sign.

  • No freedom of choice.

Being a centre manager is mandatory. A Principal or head teacher can not opt out of this responsibility. One automatically becomes a centre manager by virtue of being a Principal or a head teacher. Given opportunity to choose, some heads and principals may opt out of the responsibility. The job is gruesome. One has to be alert all the time. There is no room for committing even the slightest of mistakes. Needless to say that this is a do or die job!

  • Meagre pay

The Centre managers do not receive extra allowances from the KNEC, apart from the Ksh. 500 daily transport reimbursement. This is because they are deemed to be on duty and that they are paid salaries and allowances by the TSC. Furthermore, the deputy heads, boarding masters, Laboratory Technicians, Science teachers and deputy principals receive no extra pay during the examination’s administration period.

The examination pressure is so much on some centre managers that they breath a big sigh of relief once the examination administration period is done. Nevertheless, the Centre Managers are ready to press on with this noble responsibility.

Popular lawyer offers to represent the 8 Ambira boys calls for contacts to the parents of the boys

A Popular and flamboyant lawyer has pledged to represent the arrested boys from Ambira High School in court. The boys were caught in camera hurling abuses at Cabinet Secretaries Dr. Amina Mohammed (Education) and Dr. Fred Matiang’i (Interior).

The eight boys who appeared before Ukwala resident magistrate Gladys Adhiambo, yesterday, did not take a plea after the prosecution requested for one week for investigations to be carried out. The boys will be locked up at Ugunja police station until 3rd December 2018, when the case will be mentioned in the same court.

Lawyer Nelson Havi has now decided to represent the boys in court and is calling out for contacts to the parents and/ or guardians to the eight boys. “We have offered to act for the 8 Ambira High School boys. If you know the identities and contacts of their parents or guardians, please notify us ASAP (immediately). We cannot have a high handed executive decision to punish children and a more than willing Court assisting in the transgression,” said Nelson Havi.

The lawyer shot to fame as one of the lawyers who represented The National Super Alliance, NASA, in the 2017 General election petition. He has also represented one of the top government critic and Lawyer, Dr. Miguna Miguna, who was deported to Canada, few months ago.

The lawyer says the police over reacted by arresting the boys instead of subjecting them to Guidance and Counselling. “The boys should have been give four strokes of the cane each and ordered to uproot the biggest tree stumps in the County. I am sure that is what my High School Headmaster Bokasa and Provincial Education Officer Kavuludi would have decreed. It is not a matter to involve the State,” the lawyer advised.

Governor Sonko records remarkable improvement in the latest County Governments’ Performance rating

Nairobi County Governor, Honourable Mike Sonko, has recorded a massive positive improvement in the the latest County Governments’ Performance rating by TIFA research limited. The survey that was conducted between 17th October 2018 and 5th November 2018 shows that the Nairobi County Governor was rated the most improved Governor with a C grade from D+; that he scored in the previous survey; in May 2018. Nairobi residents gave a green light to the Governors improvements in the Central Business District (CBD) painting, street lighting, according to latest poll by the research firm.

The study that focused on Service Delivery in Nairobi, Kisumu, Mombasa, and Kiambu counties, places Kisumu Governor, Professor Anyang’ Nyong’o at the top spot with a rating of a C+ (plus) having an average score of 59% up from 56% in May. Mombasa Governor, Ali Hassan Joho, dropped two points to score an average of 51% down from the 53% garnered in the last survey.

Mike Mbuvi Sonko accumulated an average of 51% up from the previous score of 44%. While, Kiambu Governor, Ferdinand Waititu alias ‘Baba Yao’, scored an average of 53%. The survey’s objectives were: to assess the performance of the county governments, to establish awareness and approval of various programmes in target counties, to establish awareness and approval of the 2/3 gender rule, to establish awareness and approval of the women representative position and to establish approval of the proposed referendum.

The survey focused at such key areas as: Street Lighting, Education Bursaries, ECDE, Trade/ Business environment, Feeder Roads, Youth Polytechnic Education, Public Health Services, Market Centres, Keeping the County clean, Access to clean water and Sewerage systems.

The November 2018 County Score Board- Kisumu County Governor, Prof Anyang’ Nyong’o, leads with a C+

Mombasa governor, Ali Hassan Joho, was given a thumps up for street lighting (63% rating), Education (56%) and Early Childhood Development Education ,ECDE, (55%). He was lowly rated in Sewerage Systems with 37% rating.

Kisumu governor, Anyang’ Nyong’o, scored high ratings  Keeping the County Clean (65%), Street Lighting (64%) and Early Childhood Development Education ,ECDE, (62%). He performed dismally in Sewerage Systems where he scored 47%. On the other hand, Kiambu governor, Ferdinand Waititu, scored 59%, %9% and 57% for Street lighting, Keeping the County clean and Education bursaries respectively. Waititu was disapproved, though, for poor Public Health services in Kiambu County with respondents giving him a rating of 47%.

US Government revokes Fatou Bensouda’s Visa

The United States of America, USA, government has revoked the entry visa for the prosecutor of the International Criminal Court (ICC), Fatou Bensouda.

The decision is thought to be the US Government’s response to Ms Bensouda for carrying out investigations on possible war crimes by American forces and their allies in Afghanistan.

Ms Bensouda’s office confirmed on Thursday 4th April, 2019, that the US government had indeed revoked her entry visa. The prosecutor has, since 2017, been investigating possible war crimes committed in Afghanistan by the US troops. The US is not a member of the ICC which has a total membership of 122 states; worldwide. Ms Bensouda’s office has said, in response, that she will continue discharging her duties without fear.

“There is a shared responsibility to make visible the Court’s efforts to bring justice in accordance with its mandate, most particularly to those directly affected by atrocity crimes. Justice must be done & seen to be done,” Ms Bensouda had earlier told African journalists on Wednesday.

The ICC’s mandate includes: fighting impunity for war crimes, crimes against humanity, genocide and aggression.

The American government has been castigated following the move to revoke Bensouda’s visa. Here are some of the reactions from online users:

Mr.Fredrick Muhanji Mangala alias Douglas Simiyu (pictured below), a man who impersonates to be a National Intelligence Service Officer has been arrested. He is also  the Master Planner of the Fake Tender to supply Laptops to State House was arrested yesterday, Tuesday 4th December- 2018,  in Kakamega. His co-accused has already been charged before Court.

 

NTSA revokes licences to 51 Driving schools- Full list of the affected schools

The National Transport and Safety Authority (NTSA) is mandated to establish systems and procedures for, and over-see the training, testing and licensing of drivers, formulate and review the curriculum of driving schools vide section 4(2) (i) and () of the National Transport and Safety Authority Act 2012.

In implementing its mandate, the Authority undertook a Driving School Licenses Revalidation exercise in order to assess compliance with the
Traffic Driving School Rules. The exercise is intended to weed out driving schools operating without meeting the set requirements. The documents submitted by driving schools are being assessed to establish their compliance levels.

However, the following driving school/branches within Nairobi, Embu, Kisii, Kisumu Kakamega, Mombasa, Meru, Nakuru, Garissa, Thika, Kiambu,
Bungoma, Murang’a, Eldoret, Marsabit and Machakos Counties failed to comply with the directive of the Authority to submit requisite documentation to facilitate the revalidation exercise.

The Authority has therefore revoked their licenses and deactivated their access to the NTSA Driving School Portal.

Police raped about 110 women, girls during and after the 2017 General Elections- KNCHR report says

A total of two hundred and one (201) cases of sexual violence cases were witnessed during and after the protracted 2017 General Elections in Kenya, a report by the Kenya National Commission on Human Rights (KNCHR) indicates.

The report titled ‘Silhouettes of Brutality- An Account of Sexual Violence during and after the 2017 General Elections’, shows that sexual and gender-based violations were perpetrated more by the police at 54.5% compared to civilians at 45.5%. This therefore means the police, who should protect the women and girls, raped about 110 of the women and girls.

“Women, who form the larger percentage of victims and survivors, stated that they were left at home alone with their children as the men fled their homes ahead of the violence, further indicating the vulnerability that women and children suffered during the electioneering period,” the report says.

In what is being viewed as the worst cases of inhumanity, some of the women were raped in front of their children which in most cases led to broken marriages, contraction of Sexually Transmitted Infections (STIs), HIV/ AIDS, prolonged physical and mental injuries and unwanted pregnancies.

“Many women sustained physical injuries and lacked timely medical attention. Most women reported that the injuries they suffered hampered their ability to work and earn a livelihood, which in turn has led to further impoverishment and despair for the women and
children. Because of the stigma and shame associated with sexual violation, most of the women did not disclose their ordeals to family members, especially to their husbands, for fear of rejection, scorn and ridicule. Some women fled leaving behind their marital homes, husbands and children because of the stigma and shame associated with sexual violence,” the report details these damning findings.

KNCHR research targeted Nairobi, Kisumu, Vihiga, Kakamega, Migori, Siaya, Busia, Homa Bay and Bungoma counties. Two incidents were also recorded in Machakos and Uasin Gishu counties during the electioneering period.

Apart from sexual violence, other violations during the 2017 General Elections included: Injuries, Loss and Destruction of Property, Forceful entries, Displacements, Assault, Disappearance, Loss of life and Arbitrary Arrests. Of these, the largest violation was infliction of serious injuries that accounted for 29.34% of the violations.

“In one of the incidences recorded on December 10th 2017 in Mt. Elgon Constituency, Bungoma County a child aged 12 years old was returning from school when she was abducted by a group of unknown people. One of them forcefully defiled her. The child was taken to hospital and provided with post rape care but she suffered fistula damages. The child has become withdrawn and rarely associates with other children because
of the trauma,” says the report. This was one of the six incidents as highlighted by the commission.

Here is an account of the other incidents:

  • “In a similar incident on November 26th 2017 in Ruaraka Constituency, Nairobi County a mother reported that her 16-years-old girl who was in form 2 then had been raped. Following the rape ordeal, the girl developed severe anxiety and fear and consequently her school performance was negatively affected.”
  • “In one of the informal settlements, Obunga within Kisumu County, police were called in, ostensibly to restore law and order after violence had erupted following the release of Presidential election results on August 8th 2017. A mother narrated to KNCHR that the police entered her premises and she was forced to tearfully watch as police defiled her 17 years old daughter. This occured after she had informed the assailants that she was HIV+ so that they couldn’t sexually violate her.”
  • “In another incident in Mathare area, Nairobi County on October 12th 2017 two boys aged 12 years and 15 years defiled a 7years-old girl. The two boys were arrested and later released. The affected girl was taken to the Gender Violence Recovery Center for treatment. The mother confirmed that her daughter soils herself as her anal muscles got damaged during the ordeal. The survivor is yet to receive professional counseling. She
    is still withdrawn and avoids interacting especially with people of the opposite sex.”
  • “One of the male survivors was thoroughly beaten on his private parts by policemen as they shouted at him “Mtu wenu alishindwa na munasema aliibiwa” [Translation: “Your person was defeated but you are insisting that the vote was stolen”]. The man’s grandchild was equally beaten. He went to the hospital for treatment and was admitted for 2 days. Later he went to the police station to request for a P3 forms, which he was denied. This was recorded in Gem Constituency, Siaya County on August 12th 2017.”
  •  And “In one of the sodomy cases recorded, a man who was hiding in his brother’s kiosk was beaten and sodomized after violence had erupted in Embakasi North Constituency, Nairobi County. This is after the annulment of Presidential results on August 18th 2017. The incident happened at 10:00 pm on the material day.”

The worst ordeal was that of a 35-years’-old woman from Dandora, Embakasi North
Constituency (Nairobi County) who told the Commission on how she was gang-raped by five security agents. “On August 15, 2017, at 5.00 p.m while returning home from work, I reached Dandora and found violence had started. I met five policemen and I asked them to escort me to reach home. A short distance later, they told me in Kiswahili, “Wewe ni mboga
yetu leo” (loosely meaning that she would be their meal); a connotation that they would sleep with me. The woman continued her narration thus: “I started resisting but I was severely beaten. They dragged me to a nearby bush and they raped me.
All the five police officers raped me for long hours. After two days, when I went to
the Police Station to report the matter, they instead arrested me for “reporting the government”. I was in custody for two days. After the release I went to a local clinic in Dandora where I received treatment.”

The KNCHR now wants the National Police Service, NPS, to establish an independent special team to investigate complaints against the National Police Service officers alleged to have perpetrated acts of sexual violence during the electoral period. They also want the president to act promptly. “With utmost urgency,We ask the president to establish a Commission of Inquiry to investigate and prosecute cases of the 2017 electoral sexual violence with a view of securing accountability and according justice to the survivors and their families. We recommend to the President to acknowledge the violations of the 2017 electoral related sexual violence and on behalf of his Government, issue an unreserved apology to the survivors,” KNCHR says.

‘Jakadala’ disease claims are false- Migori county health officials say

Migori county health officials have moved to array fears over claims of a deadly viral disease; ‘Jakadala.’ This is after a graphic image of a man purpoted to be from Migori was shared online. The scaring image shows a man on a hospital bed with a badly mutilated genitalia.

According to Dr. Olouch, the Migori County executive in charge of health,  the county diseases surveillance team that has been on the ground for the past one week since the Jakadala outbreak claim started has not been able to come up with verifiable information to inform the outbreak of the disease.

The image shared with accompanying text, that reads in part, thus; “Shock as a sexually transmitted disease called Jakadala spreads fast in Migori, something that has worried medics in the County as they try to analyze the killer STD (Sexually Transmitted Disease)…”

Another version of the explanation reads; “The client admitted at Migori Hospital is a confirmed case of penile cancer and is already booked for penile amputation…”

Dr Oluoch now says the shared information is a  hoax, adding that the  County supplies enough condoms to the locals.

Behold! The government to effect housing scheme deductions next month after striking a deal with COTU

The government will effect deductions from its Workers’ monthly pay to fund the ambitious housing scheme.

According to the Transport, Housing and Infrastructure Cabinet Secretary James Macharia the deductions will be rolled out next month; on 1st March, 2019. Consequently, workers both in the private and public sectors will contribute 1.5 percent, monthly, towards the scheme.

Macharia says the affordable housing project will be implemented after fruitful negotiations with workers’ union and employers. The Central Organization of Trade Unions, COTU, had last year obtained a court injunction stopping the deductions. Macharia, however, did not give details of their agreement with COTU.

“We had injunctions that halted the process but the parties have agreed to withdraw them so we are ready to proceed with the project,” CS Macharia said yesterday. The Kenya National Union of Teachers, KNUT, has also been raising a dissenting voice to the scheme which according to them will lead to reduction in teachers’ earnings.

The CS smnoted that the project will be launched soon. Macharia at the same time indicated that those who may fail to get the housing units will be reimbursed at retirement. “Those who do not get a house or already have one will get their money back when they retire. The only money that will not be refunded is the employers’ deduction,” Mr Macharia assured.

This comes after the government said, last week, that those earning above Ksh 100,000 monthly will now also benefit from the scheme; by acquiring the housing units

Killer Bus- NTSA suspends Grand Bus SACCO after 14 passengers perish (Report).

On Sunday 12th May 2019, at 1130hours at Tula area along Thika Mwingi Road Forty (40) kilometers from Garissa Town), a bus , registration number KCS417A belonging to Grand Bus Services and a semi-trailer, KCE007S/ZF1769 belonging to Five Star Agencies Limited and ASL Credit Limited were involved in a fatal crash that claimed the lives of 14 passengers.

The bus was headed for Garissa from Nairobi County. Preliminary crash analysis and investigations indicate that the semi-trailer carrying cement broke down on the road and the driver had not made any attempts to move off the road. To avoid ramming into the rear of the semi-trailer, the Bus driver swerved and hit the right side of the trailer causing extensive damage to the left hand side of the bus. As a result, 10 passengers lost their lives at the scene of the crash, while 4 others passed away on the way to the hospital.

Another 17 persons who had sustained injuries have been treated and discharged from the Garissa Referral Hospital.

The National Transport and Safety Authority, NTSA, has since carried out preliminary investigations. From the preliminary report, the Authority observes that the trailer driver had not placed any warning signs on the road to alert the oncoming motorists on the presence of the stalled vehicle.

The bus driver drove without due care considering that the road section is straight and flat. The driver should have seen the reflective chevrons and take appropriate action to avoid the crash.

NTSA has consequently taken action against the bus company’s owners. “On its part, the Authority has suspended the Grand Bus Services Sacco Operator’s Licence and the officials are required to submit a comprehensive incident report by 14h May, 2019,” says the Agency.

The agency adds that the Driving Licences of the truck driver, Mr. Abdullahi Sugow Muhuned and the Bus Driver, Mr. Osman Ali Guhad have also been suspended as the investigation continues.

Catholic Bishops insist churches won’t be closed: COVID-19 shutdown

The Kenya Conference of Catholic Bishops, KCCB, has insisted that the Catholic places of worship will not be shut down due to CoronaVirus fears. According to the Bishops, the Churches will remain open so as Faithfuls can find solace and a place to run to. This goes against the Government’s directive on total shutdown of all social places and learning institutions.

“In the wake of the outbreak of Coronavirus (COVID-19) in the Country and the world over, we are aware that there is heightened sensitivity and fear of further infections. On Sunday 8th March 2020, the Government of Kenya issued the directives on containing the spread of the virus. On Saturday 7th March 2020, we as the Bishops’ Conference had given some guidelines on how to curb the spread of the Coronavirus in our places of Worship,” Says Most Rev. Philip Anyolo who is the KCCB Chairperson.

Guidelines 

In an effort to help prevent the spread of the Coronavirus, the Bishops have seen the need to give further Pastoral guidelines and precautionary measures in regard to the celebration of Holy Masses and other Liturgical activities. Here are the guidelines from the Bishops as contained in their signed memo dated March 19, 2020:

  • Catholic churches will remain open; they are not closing. They will be focal point of prayer, where faithfuls will find solace and strength from God.
  • The priests are asked to give Christ Faithful the messages of hope and encouragement. These messages touching on the Coronavirus must not create panic and anxiety, but rather, it should encourage the people to confront the current situation with serenity and courage knowing that we shall overcome the virus with the help of God.
  • The Holy Masses will continue to be celebrated in our churches but the Bishops’ Conference recommends that the Diocesan Bishops grant temporary dispensation from the Sunday Obligation for the next three weeks for any Faithful who may need it (c.f Catechism of the Catholic Church, no. 2181). However, those who are able to attend Sunday Mass may do so observing all the measures of prudence. At the same time, the Priests have asked to exercise caution in regard to large gatherings, that is, keeping the recommended distance of one metre. Priests to strictly exercise caution regarding the large gatherings. However, Masses should be brief.
  • Priests to be available to the Christians for Holy Communion outside the Mass, provided they do so in the Church in accordance with the Communion Rite. All Christians, especially those in restriction, are encouraged to continue benefiting from the Spiritual Communion or Communion of desire.
  • Those Christians who are impeded from attending Sunday Mass can also benefit from Live-streaming of celebration of Holy Mass through Televisions and Radio Stations. Catholic radios are urged to transmit live Masses.
  • The Bishops say there should be measures to discourage big events and Liturgical celebrations involving large gatherings of the Faithful.
  • In administering the Confession sacrament, the bishops discourage face-to-face confessions; and recommend that both the Confessor and the penitent should make use of the Confessionals provided within the linen device and preferably use protective masks.
  • For the time being, they discourage the celebration of the Masses in small Christian communities. Instead, priests can celebrate daily Masses in the main church or the Outstations for the intentions of the Christians taking into consideration one-metre distance.
  • On funerals, weddings, and Way of the Cross, the Bishops encourage the Priests and the Christian Communities to follow the directives given by the Government and the guidelines given by KCCB on limiting the number of participants and avoiding large crowds and common eating. They also ask for the suspension of all major National, Diocesan and Parish gatherings.
  • Those handling church offerings should wear protective devices, like gloves and masks where necessary.
  • The Bishops are asking our dear priests to celebrate Votive Masses of the Mercy of God as provided in the Sacramentary. In addition, they ask all believers to continue praying to God to end the coronavirus pandemic and pray for the quick recovery of the infected persons.
  • For other activities like Spiritual Programmes and Exercises, the priests should use their discretion in consultation with their Local Ordinaries and have recourse to the technology at our disposal.
  • Guidelines on the celebration of Sacraments and the Easter Celebrations will be given in due course.

The Bishops are asking Kenyans to keep observing the basic precautionary hygienic measures given by the Ministry of Health and KCCB that will help minimize the spread of the virus as well as protect oneself from being infected by COVID-19.

Video of girl clinging to father in courtroom causes uproar, Judiciary gives explaination

A video of a girl clinging to her father has gone viral after mother attempts to snatch her away. The video that was shot in a court room has sparked uproar with pundits blaming the mother and police for trying to force her off the father.

But,  in a rejoinder the Judiciary has responded and put the record straight. Read the statement below;

“The Judiciary’s attention has been drawn to a media report carried by a few media houses and also circulating on social media regarding the above case. The video shows a young girl crying and clinging to her father.

The narrative perpetuated is that the court gave custody to the mother but the child is seen supposedly resisting to go with her.

From the onset, it is noted that children cases are always heard in camera and Judiciary makes every effort to shield children from publicity and exposure.

This is in a bid to safeguard children’s rights and to act in the best interests of the child. This clarification will therefore not give the Case Number or parties’ details.

A review of our court records reveal that the mother in the video, filed a court case at Mwingi Law Courts seeking custody of their daughter who was living with her father. The case went through full trial and judgement was delivered on September 12, 2019.

In summary, the court granted equal legal custody for both parents. The mother would stay with the child, but during the school holidays the father would have custody.

The Court observed that since it was September the effective implementation date of the court order would be December 1, 2019 after schools close, so as not to disrupt the minor’s education. The mother
was to pick her on December 1, 2019 which would give them ample time to bond and look for a school for her well before January. Come December 1, and the father refused to hand over the child. The mother returned to court on December 15, 2019 to seek orders that he be compelled to do so and also to show cause why he should not be cited for contempt of court.

More push and pull followed, but on Jan 8, the couple re-appeared in court. They were both represented by advocates who requested to be allowed to negotiate outside court. When they returned, they had a written signed consent where both parents agreed to abide by the court orders. The father was to bring the child the following day, January 9, 2020, and a Children’s Officer was to oversee the handover and ensure the girl had the necessary counselling and preparation.

It was on the material day, January 9, that the video was taken and uploaded on social media with a view to painting the Judiciary in bad light, and as an attempt to reverse the decision of a court unprocedurally.

The Judiciary makes several observations as follows:

  • That when the court communicated its decision on September 12, 2019 the parties were informed of their right of appeal to the High Court, yet no appeal was filed.
  • That the Children Officer in Mwingi, who is the expert on children matters, was involved in every step and aspect, to ensure that the decision was in the best interest of the child.
  • That both parties were represented by advocates, so none of them was legally disadvantaged.
  • That in addition to the court orders both parties, through their advocates on record, signed a consent to comply with court orders
  • There was no application filed to review the court decision, or even for stay of execution.

In this particular case, the social media narrative seems to suggest the mother was away for many years and therefore should not have been given custody. It is noted that all matters of interest and angles of
the case, were canvassed before a competent court.

Moreover a notable aspect is that the child actually lives with her parternal grandparents, since her father works over 70 kilometers away, yet her mother is alive, able and willing to stay with her.

The parties did not inform the Court through any of the above stated options that they had any problem with the court decision.

Obedience of court orders is a key pillar in upholding of the rule of law. If anyone is dissatisfied with a court decision, the way to go is to appeal to a higher court, but not to defy, castigate the judicial officer or mud-sling the Judiciary.

The Judiciary remains committed to its Constitutional mandate of administering justice to all without fear or favour.”

Agencies Oppose Ban On Domestic Workers Going To Gulf

 

Led by their chairperson Mohammed Mwaguzo, the agencies accused social media users responsible for slandering thus asking the government to investigate further on a recent video that went viral on social media where a woman alleged to be a house help in Saudi Arabia was seen breastfeeding puppies.

Mwaguzo noted that the proposed ban on recruitment agencies by Secretary General of Central Organization of Trade Union (COTU) Francis Atwoli is unfair to the accredited employment agencies.

He said that despite the few misfortunes, many Kenyans have benefitted from labour migration to the gulf countries.

“We are really concerned as to why people are producing fake videos on mistreatment in Saudi Arabia. This is a serious issue that needs no social media entertainment for followers. We are calling upon the government to apprehend and arrest those responsible for such videos,” he said.

At the same time, he asked Kenyans who wish to travel abroad for work to use registered agencies to avoid future misfortune. “Travelling through a registered agency is important as they can easily follow up on any incident happening abroad in case the worker is in trouble,” added Mwaguzo.

On his part, Yusuf Ibrahim, a member of Pwani Welfare Association and also an accredited agent based in Mombasa said that they are happy as the new government introduced the State Department of Diaspora Affairs that will help them tackle all the issues happening in Saudi Arabia.

Ibrahim also asked the government to sign the pending bilateral agreement and also negotiate the few terms on labour immigration with the concerned countries.

He also thanked the National Employment Authority (NEA) for their support and the good partnership they have with civil organizations in sensitizing private recruitment agencies on practicing ethical recruitment.

Mathias Shipeta from Haki Africa has asked Kenyans to verify the agencies that take them to the Middle East as some are illegal. “Before you go to the Gulf, find out the details of the signed agreement and who takes you there,” said Shipeta.

He further added that there are not enough job opportunities in Kenya and that is why many people want to travel abroad to at least curb the poverty they face here at home.

Maimuna Hassan, a representative of Asali Commercial Agency said many people think that recruitment agents are criminals and are doing illegal jobs due to how they are portrayed on social media platforms.

She added that most of them only look on the negative side of Saudi Arabia without pointing out the positive side where many Kenyans have benefited from.

Kenya Defense Forces, KDF, officers have began their mission in Somalia. They will focus on medical ethics and principles of nursing care. They are also joining the KDF medical personnel while conducting daily hospital routines to equip them with managerial skills to run the hospital.

The mentorship program which has targeted four main areas of a hospital operations: pharmacy, laboratory technician, clinical officers and nurses is in line with ATMIS’s mandate on capacity building of SSF as they prepare to take on security responsibilities by December 2024 and will be on rotation basis.

Rage Rabi Kulu, SSF clinical officer undertaking the course pointed out that the mentorship program is a game changer in skillset acquisition.

“We are lucky to learn from the KDF medic team. Once we take the security responsibilities, it will be our burden to shoulder now. The skills we get here are vital for our colleagues who will be dependent on us. We are grateful for this gesture of brotherhood,” added Kulu.

The Senior Medical Officer, Kismayu Forward Operating Base (FOB), Lieutenant Colonel Onyango indicated KDF’s commitment to mentoring the SSF in order to take up security responsibilities and other sectors of Somalia.

Governor Okoth Obado freed at last, but with tough conditions

Migori Governor, Hon. Okoth Obado, was, today, freed on a KSh. 5M bail with 2 sureties of similar amount. But, the High Court denied his 2 co-accused bail, saying the prosecution produced enough evidence to deny them bail, though they have the right to appeal.

TOUGH CONDITIONS FOR OBADO

High Court Judge, Justice Jessie Lessit, ordered Obado; to deposit travel documents in court, not to visit the late Sharon Otieno’s murder scene or discuss the incidence on media or political rallies, not to skip any court session and not communicate with the deceased’s family.

The Prosecution has lined up 30 witnesses to testify in the case. Pre-trial conference is set for 14.2.2019, with murder trial hearing set to run from 6th to 17th, May, 2019.

Attackers forced their way into the 14 Riverside Drive by indiscriminately shooting at the guards, today afternoon. They then threw explosives into vehicles and went into DusitD2 hotel. So far, one suspect has been arrested and many people rescued. Inspector General of police, Joseph Boinnet, has given a presser saying the attackers are suspected to be terrorists. Terror Group, Al-Shabaab, has claimed responsibility. Casualties have been reported, with a woman who sustained injuries succumbing at a hospital in Nairobi.

PRESS STATEMENT

We regret to confirm that at approximately 3pm today, a group of armed assailants attacked the Dusit Complex in a suspected terror attack. Security and emergency teams immediately responded to the incident and have cordoned off the area. The situation is being managed and residents are being screened and evacuated from the area. We are aware that armed criminals are holding up in the hotel and specialist forces are now currently flushing them out.

However we regret to inform that there have been injuries in the attack and we are in the process of confirming the numbers and types of injuries incurred. We have been vigilant throughout the holiday season and therefore all public and other hotel premises remain under close watch. Reports from throughout the country indicate that everything remains calm and normal. We urge the public to remain calm and to cooperate with all security forces and to provide any information that they may deem as useful to the security forces.

EDITORIAL – TSC, COME ON, KILL THESE TEACHERS!

It is painful to watch the TSC overreacting to the court order requiring it to promote teachers who are waiting for promotions after acquiring higher academic qualifications. Honestly speaking,these teachers are not making a strange demand. They are sharing stations and staff rooms with fellow teachers who have got promotions on the basis of such qualifications.

Here below,I wish to make some points very clear:
1.The assertions by KEPSHA and KESSHA that the teachers are against the recent court ruling is a white lie. It is the Head teachers,principals and other administrators who are opposing it. This is because the current CBA favoured them at the expense of the assistant teachers who were obviously sidelined.

2.The stopping of promotions of teachers upon acquisition of higher academic qualifications is not in the interests of those teachers. In fact,the court was clear that it is a deviation from the existing schemes of service. TSC last promoted teachers on this scheme of service in January 2014.

3.RESOURCES: These teachers took loans and sold property in a bid to sharpen their skills and thereby benefit from the lawful schemes of service only for the employer to frustrate their aspirations. Some have retired or even died without benefitting despite being qualified. It is stressful that those in service share staff rooms with others who were promoted on the same schemes.

4.KEPSHA and KESSHA: It is ironical that the unions secured a CBA which overly favoured these administrators YET assistant teachers did not stand against it since after all,they too are teachers. This is despite the fact that a number of such heads (particularly in primary) just hold P1 certificates. What makes them think that promotions and better remuneration only belong to the heads, deputies and senior teachers?

The truth is that the main teaching force (assistant teachers) is opposed to the infamous stance taken by these heads. Let them keep off the issue affecting these deserving teachers. Let them shelve their greed.

PASSIONATE APPEAL
TO THE TSC:

Please purpose to feel for and promote these teachers promptly. It’s inhuman to keep on ignoring their plight while the men and women are suffering yet expected to perform well. Promote those whose KCSE grades allowed them to go for further training.

TO THE KNUT:
Be realistic in your demands. TSC is under obligation to promote ONLY THOSE WENT FOR HIGHER EDUCATION WITH THE MINIMUM PREREQUISITE QUALIFICATIONS. Why, for example, would someone pursue a bachelor’s degree without at least a mean grade of C+ in KCSE? Do not present such cases to be considered for promotion thereby causing a mix up!

Mr President,these teachers are neither too many nor do they belong to a lesser god. Do not allow the supremacy battles between KNUT and TSC to continue pushing the qualified teachers into depression and desperation.

CONCLUSION
The TSC has the mandate to vet the teachers to whom it sent acknowledgement letters. Let them be vetted and those qualified promoted as a matter of urgency.
OR
Let all these teachers who have rightfully earned higher academic qualifications be invited to a place and killed all at once. This will end their their suffering and false hopes.

Former US President, George H.W. Bush is dead

Former 41st United State (US) president, George Hebert Walker Bush, died yesterday (Friday 30th November 2018) aged 94 years. This was announced by his family yesterday, who did not give the exact cause of his death. His wife, Barbara, died in April last year aged 92. A day after his wife’s burial on 21st April, George Bush Senior was admitted at Houston Methodist Hospital for a blood infection.

In a statement, his son and Former United States President (the 43rd president) George W. Bush wrote: “Jeb, Neil, Marvin, Doro, and I are saddened to announce that after 94 remarkable years, our dear Dad has died. George H.W. Bush was a man of the highest character and the best dad a son or daughter could ask for.”

George H.W. Bush was born in June 12, 1924, in Massachusets.  His dad, Prescott Bush, served as a Senator; after he was elected to the Senate in 1952.

The Senior Bush is survived by five children (4 sons and one daughter) namely: George W., Jeb, Neil, Marvin and the one daughter, Dorothy Bush Koch.

Immediate former US president, Barack Obama, eulogized Bush Senior saying:

“America has lost a patriot and humble servant in George Herbert Walker Bush. While our hearts are heavy today, they are also filled with gratitude. Our thoughts are with the entire Bush family tonight – and all who were inspired by George and Barbara’s example.”

The Director of Public Prosecutions (DPP) Noordin M. Haji has ordered for the arrests of 28 persons over corruption allegations. The 28 who include the National Treasury Cabinet Secretary, Henry Rotich, and his Principal Secretary Kamau Thugge face charges over corruption at the stalled Kimwarer and Arror Dams.

The following offences have occasioned the arrests directive:
1). Conspiracy to Defraud contrary to section 317 of the Penal Code, Cap 63 Laws of Kenya
2). Wilful Failure to comply with applicable Procedures and Guidelines relating
to Procurement contrary to section 45 (2)(b) as read with section 48 of the Anti-Corruption and Economic Crimes Act No 3 of 2003:
3). Engaging in a project without prior planning contrary to section 45 (2) (c) as read with section 48 of Anti-Corruption and Economic Crimes Act No. 3 of 2003;
4). Abuse of Office contrary to section 46 as read with section 48 of Anti-Corruption and Economic Crimes Act No. 3 of 2003.
5). Committing an offence of financial misconduct contrary to section 197 (1) (0) (i) of the public finance management act no. 18 of 2012.
6). Fraudulent Acquisition of Public Property contrary to section 45 (1) (a) as read with section 48 of the Anti-Corruption and Economic Crimes Act, 2003.
7). Knowingly giving a Misleading Document to Principal contrary to section 41 (2) as read with section 48 of Anti-Corruption and Economic Crimes Act no. 3 of 2003 of the Laws of Kenya.
8). Wilful Neglect to Perform Official Duty contrary to section 128 as read with section 36 of the Penal Code.

KPC gives an explanation over oil spillage at Kiboko area in Makueni County

The Board of Directors of Kenya Pipeline Company Limited (KPC) is aware of, and takes extremely seriously, recent media reports and statements by National & Makueni County Government officials, and by elected leaders, expressing concerns regarding the spillage of fuel from the newly commissioned Mombasa-Nairobi pipeline (Line 5) at Kiboko, Makueni County, and the potential negative effects of this spillage on the Kiboko community, especially on the community’s access to safe drinking water.

The Board regrets deeply the spillage. The leak that led to the spillage was neither expected nor anticipated, given that this is a newly commissioned line that has been in operation for nearly one year, and is operating consistently and satisfactorily at the design rate of transporting 1 million litres per hour. KPC Management are working to establish the cause of the leak, and on the back of these findings will undertake action to ensure non-recurrence.

These findings and remedial actions will be made public. In the meantime, the Board notes and commends the KPC Management’s fast action in mobilising resources to repair the leak.

As a matter of record this repair work took exactly 14 hours 48 minutes from when the leak was first reported to KPC on the morning of March 30, 2019 at 11:20am, to when transport of fuel resumed after repair in the early hours of March 31, 2019 at 02:08am. At no time were fuel supplies to the country in danger of being disrupted

The Board has also endorsed the agreement reached between the
Managements of the Water Resources Authority (WRA), which is the body legally mandated to ensure Kenyans have access to clean, safe and reliable water, and KPC on Wednesday May 15 2019 on how the two organisations will jointly and urgently conduct further tests to establish the extent of the spillage, and whether or not water sources for the community have been contaminated.

Should it turn out that these water sources have indeed been contaminated KPC will work with WRA to restore and safeguard the integrity of the Kiboko community’s water supply

The Board reiterates that KPC will always, promptly and to the full extent required comply with rules and regulations issued from time to time by regulatory and other agencies mandated by law to issue such rules and regulations.

Accordingly, the Board fully supports Management’s resolve to comply with the WRA’s cautionary notice regarding supply of drinking water to the Kiboko community.

As a matter of urgency KPC Management are working with the National and Makueni County Governments to establish the optimal way of supplying the community with clean water.

The Board assures the residents and leaders of Kiboko, and Kenyans as a whole, of its determination that any adverse consequences of this spillage are dealt with decisively.

The Board is also determined to get to the reasons why this spillage occurred and is committed to ensuring that whatever remedial action is required will be undertaken, and further that such action will be made known to the Kenyan people.
