RETIREMENT IN THE PUBLIC INTEREST

The TSC may retire a teacher on grounds of public interest upon considering every available report with regard to the public protests and complaint against the teacher and upon considering that it will be undesirable to retain such a teacher in the teaching service.

An employee whose conduct and behavior may not be conducive for peaceful and effective learning or whose behavior may pose a threat to the well being of learners and fellow teachers may be retired in the Public Interest.

Such a teacher may be retired at any age, provided they are in permanent and pensionable establishment.

A complaint or report to warrant the retirement of a teacher on grounds of public interest shall demonstrate that the teacher has engaged in in acts or omissions that contravene public interest  and policy.

University student and a soldier among those arrested in Eastleigh for abduction offences

The Directorate of Criminal Investigations, DCI, Detectives last night arrested 5 abductors, among them a university student and a soldier, within Eastleigh area and  rescued 3 victims. The abductors were demanding for Ksh.5,000 release fee (ransom) from each victim. The suspects will be arraigned in court today.

Those arrested are:

KNUT issues, yet, another threat to TSC over postponement of today’s meeting

The Kenya National Union of Teachers, KNUT, has issued a threat to take unspecified action if the Teachers service Commission, TSC, does not call them to a meeting in a span of seven days. This comes after the TSC wrote to KNUT, on 17th October 2018, postponing talks that were to be held today (Friday 19 October, 2018); between TSC AND KNUT. In a letter dated 18th October 2018, the KNUT Secretary, Hon. Wilson Sossion, blames TSC for mistrust and mischief over the latter’s move to cancel today’s talks. Today’s meeting was to highlight unresolved industrial issues raised by KNUT. The two sides failed to agree on these issues when they met in Naivasha few weeks ago. “You will note that as early as July 2018, we formally raised several pertinent issues affecting harmonious industrial relationships which called for urgent interventions,” says Sossion in the letter addressed to the TSC Chief Executive Officer, Dr. Nancy Njeri Macharia. “Flowing from the said issues and demands, a meeting was convened on 24th August, 2018, after protracted exchange where certain agreed issues were tabled and way forward agreed. This way forward was to have a retreat in Naivasha where there aborted discussions owing to (the) hard line and unreasonable position taken by (the) Teachers Service Commission (TSC),” Sossion adds. The KNUT Secretary General says that the two sides had on 6th September, 2017, agreed that promotions of teachers by the TSC was mandatory. But, he blames TSC for renegading on this position and introducing ‘CPG Policies and Appraisals which utterly contradicts the Collective Bargaining Agreement (CBA) and code of Regulations for Teachers (CORT), hence illegal.’

Teachers with higher qualifications have been waiting in the cold since 2014 when the TSC freezed promotions on attainment of higher qualifications. KNUT projects the numbers of such teachers at about 30,000. On Tuesday, this week, the KNUT Deputy Secretary General, Mr. Hesbon Otieno, issued a memo to all branch secretaries to collect data on teachers who had submitted their higher qualification credentials to the TSC for promotion. Sossion now wants the Commission to convene a meeting in seven days, effective yesterday, to address the unresolved issues. “In the circumstances, we hereby demand that within the next seven (7) days, a meeting be convened to which steps and actions will be taken without any reference to you,” Sossion, further, says. The letter is copied to the Education Cabinet Secretary, Amb. Amina Mohammed, Hon. Ukur Yatani, the Cabinet Secretary for the Ministry of East African Community, Labour and Social Protection, Hon. Julius Kibiwott Melly, the Chairperson of the Departmental Committee on Education, Research and Technology, among others. This timeline will expire on 25/10/2018 and by then most schools should have closed for forms 1,2 and 3.

Members of the County Education Board, in Kenya

The County Education Board Shall be composed of twelve members as follows:

TSC: THE ROLE OF THE PRINCIPAL IN EXIT/ WHAT THE PRINCIPAL/ HEAD TEACHER IS SUPPOSED TO DO DURING A TEACHER’S EXIT FROM THE SERVICE:

The head of institution/ Principal/ Head teacher plays an integral role during a teacher’s exit from the teaching profession/ service, The head teacher is supposed:

  • To report all exits promptly to avoid overpayments to the teacher.
  • To forward all requests/applications for exit from teaching service.
  • To Advise teachers on exit management.
  • To issue clearance certificates to teachers exiting service.
  • To liaise with next –of- kin to facilitate payment of death gratuities.
  • To report all cases of absenteeism/desertion.
    • NOTE:

    Regulation 168 of the Code of Regulations for  Teachers (2015) states that “A Head of Institution who fails to report a teacher’s exit from service shall be liable to disciplinary action and shall be surcharged  to  the extent of any loss occasioned  to the Commission.

ECONOMIC CRIMES AND SERIOUS OFFENCES.

These are offences against the Anti-Corruption and Serious Crimes Act (2003)

  • Economic crimes include:-
    • Fraudulent payment or excessive payment form public revenues for goods and services which are either rendered or not.
    • Willful failure to comply with any law or applicable procedures and guidelines relating procurement, allocation, sale or disposal of property or tendering of contracts;
    • Management of funds or incurring expenditure or engagement in institutional projects without planning; and
    • Any offence involving dishonesty under any written law providing for maintenance protection of public revenue which constitutes professional misconduct on the part of the teacher.


CONSEQUENCES OF ECONOMIC CRIMES AND OTHER SERIOUS  OFFENCES.

  • Where a teacher who is under suspension is discharged or acquitted of a charge by a court of competent jurisdiction the commission shall lift the suspension and pay to the teacher any benefits that may have been withheld during the period of suspension.
  • A teacher charged with an economic crime or serious offence shall be suspended from service and shall be entitled to one half of the basic salary, with full house and medical allowances with effect from the date of the charge.
  • A teacher who who is held in lawful custody shall be suspended from service without pay for the whole period that she/ he is in custody.

QUALIFICATIONS,REQUIREMENTS, DUTIES AND RESPONSIBILITIES
JOB DESCRIPTION
The Chief Principal will be the lead educator and accounting officer and will be responsible for the operational management of the institution. A holder of this position will be responsible for the provision of leadership in the development and implementation of education plans, policies, programs and curriculum activities.

REQUIREMENTS FOR APPOINTMENT
For appointment to this grade, a teacher must:-
i. have served as Senior Principal at T- Scale 14 or in an equivalent position for a minimum period of three (3) years;
ii. have a Master’s degree in a relevant area;
iii. have satisfactory rating in the performance appraisal and performance contracting process;
iv. have successfully undertaken the relevant TPD modules;
v. meet the requirements of Chapter Six of the Constitution; and
vi. meet any other requirement deemed necessary by the Commission.

DUTIES AND RESPONSIBILITIES
The duties and responsibilities shall be to:-

i. prepare lesson plans, lesson notes, timetables, schemes of work and maintain academic standards in the institution to ensure that the syllabus is covered in time for evaluation;
ii. teach the subjects of specialization to impart knowledge, skills and attitudes to the learners to meet the objectives of the curriculum;
iii. evaluate the learners on subjects of specialization to ensure achievement of learning objectives and prepare them for national and other examinations;
iv. ensure adequate curriculum support materials are available in the classrooms and libraries;
v. oversee the registration of learners for internal and external examinations with relevant examination bodies;
vi. prepare, guide and assess learners on teaching practice;
vii. induct new teachers and ensure orientation of new learners into the institution is undertaken;
viii. oversee academic and professional training programmes for learners;
ix. oversee professional development of teachers;
x. oversee admission of learners to ensure compliance to admission requirements;
xi. oversee the entire examination system and processes for quality and integrity;
xii. ensure safe custody of examination results and certificates;
xiii. oversee the preparation and issuance of transcripts;
xiv. oversee the compilation of the graduation list and presentation of the graduands;
xv. liaise with other relevant education institutions for proper implementation/evaluation of the curriculum;
xvi. ensure learners are adequately prepared, registered and presented for national examinations in accordance with the regulations of the examining body;
xvii. identify the appropriate curriculum for the institution to provide more opportunities to the learners in the optional subjects;
xviii. ensure safety, health and security learners;
xix. interpret and implement policy decisions that pertain to the training, recruitment and deployment of staff for compliance with relevant rules and regulation;
xx. promote linkages between the institution and other stakeholders for positive image as well as relevant support to the institution;
xxi. ensure appraisal of staff in the institution is undertaken;
xxii. promote the welfare of staff and learners within the institution for motivation, personal and professional growth and create sense of belonging;
xxiii. ensure proper succession management for smooth transition at all levels in the institution;
xxiv. manage the maintenance and upgrading of the institution’s physical facilities;
xxv. ensure adherence to the procurement regulations;
xxvi. convene staff, Board of Management, Parent meetings and such other meetings as may be necessary;
xxvii. serve as the Secretary to the Board of Management; and
xxviii. any other duties as may be assigned.

2. Director CEMASTEA

QUALIFICATIONS,REQUIREMENTS, DUTIES AND RESPONSIBILITIES
REQUIREMENTS FOR APPOINTMENT
To qualify for appointment to this grade, a teacher must:-
i. have served as Deputy Director at T-Scale 14 or in an equivalent position for a minimum period of three (3) years;
ii. have a Bachelor’s Degree in Education (Science); or be a holder of a Bachelor’s Degree in Science with a Post Graduate Diploma in Education;
iii. be a holder of a Master’s Degree in relevant area;
iv. have a satisfactory rating in the performance appraisal process;
v. have demonstrated ability to supervise, mentor and provide professional support to other trainers;
vi. meet the requirements of chapter six (6) of the Constitution; and
vii. meet any other requirements deemed necessary by the Commission.

DUTIES AND RESPONSIBILITIES
The duties and responsibilities shall be to:-
i. provide leadership in the development of the Centre’s overall strategy so as to ensure alignment of its activities with set objectives;
ii. coordinate the development of policies, systems and procedures, to guide the operations of the Centre;
iii. oversee the development of work plans for all departments;
iv. oversee the development of the Centre’s budget and financial proposals;
v. ensure security of the Centre’s records, property and resources;
vi. establish risk management mechanisms at the Centre;
vii. initiate, maintain and promote partnerships and collaborations with relevant agencies and organizations;
viii. advise the Government on matters related to development of teachers’ capacity in Science and Mathematics;
ix. ensure efficient and prudent utilization of resources for quality implementation of the Centre’s mandate and strategic activities;
x. oversee the implementation of all activities in teacher capacity development at the Centre;
xi. oversee the implementation of joint activities between the Centre, partners and collaborating bodies;
xii. serve as secretary to the Governing Council of the Centre;
xiii. implement Council decisions;
xiv. mentor and coach staff at the Centre to enhance work performance;
xv. provide leadership in ensuring sound human resource management;
xvi. ensure the procurement of goods and services conforms to the relevant legal provisions;
xvii. oversee the implementation of activities that enhance ethical conduct of staff;
xviii. identify, initiate and oversee required infrastructure development for the Centre;
xix. guide and support performance appraisal at the Centre;
xx. maintain the Centre’s Quality management system;
xxi. develop, present and publish research paper on teaching and learning in mathematics and sciences at least every two years;
xxii. serve as the accounting officer and ensure sound financial management at the Centre; and
xxiii. any other duty as may be assigned.
