Nominated Members to the County Assemblies

 

IN EXERCISE of the powers conferred by Articles 88 (5), 90 and 177 of the Constitution, section 4 (n) of the Independent Electoral and Boundaries Commission Act, 2011 and sections 34, 35, 36 and 37 of the Elections Act, 2011, and Regulations 54, 55 and 56 of the Election (General) Regulations, 2012 and Regulation 26 of the Election (Party Primaries and Party Lists) Regulations, 2017, the Independent Electoral and Boundaries Commission gives notice to the public that the persons listed in the 2nd Column to the schedules stand validly nominated to the County Assemblies representing the Political Parties listed in the respective schedule.

The number of seats referred to in the 7th and 6th Columns to the First and Second Schedules respectively have been allocated to the political party qualifying for the special seats envisaged under Article 177 of the Constitution proportionate to the total seats won during the General Election held on the 9th August, 2022.

Schedule 1 provides for nominated marginalized members to the County Assemblies. Schedule 2 provides for nominated Gender Top Up members to the County Assemblies. And that –

  • The name of the nominated member of the respective Political Party is listed in the Second Column to the Schedules;
  • Every nominated member’s Gender is indicated in the Second Column to the Schedules;
  • Every nominated member’s Truncated Identification Document Number is indicated in the Fourth Column to the Schedules;

Requirements for Elective Post- Independent Candidates

NOTICE is hereby given to the public on the qualifications and requirements for candidates contesting for elective positions together with nominees to Party Lists in the upcoming General Election scheduled to be held on 8th August, 2017

Select position :

General Requirments 

  • A Clearance Certificate from the Registrar of Political Parties certifying that the person was not a member of any political party for the last 3 months before the elections; i.e. as at 7th May, 2017 (Regulation 15(a) (General) Regulations, 2012
  • A soft and a hard copy of a list of at least 2000 supporters for President, 500 supporters for Governor, 2000 supporters for Senate, 1000 supporters for National Assembly (including Woman County Representatives) and 1000 supporters for Ward County Assembly in the prescribed form, submitted to the Commission.
  • A duly filled Form of Intention to Contest in the prescribed form (Regulation 15(b) (General) Regulations, 2012
  • A symbol the candidate intends to use during the election, which has been approved by the Commission 21 days before Commission Day
  • Establish and maintain a functioning office in the respective electoral area where the candidate is contesting, which must be available for inspection by the Commission at least 45 days before the elections. The address, including the physical address of the office must be communicated to the Commission

Requirements

A nomination paper submitted by an Independent Candidates to the Commission shall;

  • Contain the candidate’s name as it appears in the Register of Voters.
  • Be signed by the candidate, proposer and seconded who shall be voters registered in the respective electoral area.
  • The Proposer and Seconder shall not be members of any political party
  • Show the respective electoral area for the proposer and Seconder.
  • Be delivered to the returning officer personally by the candidates himself or herself or by a person authorised by the candidates on the date set for nominations for that election.

Remuneration and Benefits for State Officers in the Full-Time Constitutional Commissions and Independent Offices

IN EXERCISE of the mandate of Salaries and Remuneration Commission (SRC) as set out under Article 230 (4) (a) of the Constitution, SRC has reviewed the remuneration and benefits for State officers in the Full-Time Constitutional Commissions and Independent Offices under the Third Remuneration and Benefits Review Cycle that covers Financial Years (FY) 2021/2022-2024/2025. Consequently:

  • for the period 2021/2022, the remuneration and benefits were retained as set by SRC in Gazette Notice 6519 of 7th July, 2017;
  • for the period 2022/2023, SRC has set the remuneration and benefits as published in this Gazette Notice; and
  • for the period 2023/2024 – 2024/2025, SRC shall set the remuneration and benefits on or before the commencement of FY 2023/2024.

  • A serving State officer and a State officer appointed in Full-Time Constitutional Commission and Independent Office on or after the effective date of this Gazette Notice shall be paid the monthly remuneration set herein.
  • The monthly remuneration set herein is fixed for the term of office of the State officer, unless reviewed and set by the Salaries and Remuneration
  • Salary Market Adjustment is a salary modification that takes into account market positioning, and constitutional and statutory principles on review of remuneration and benefits.
  • For purposes of gratuity and pension, the pensionable emolument shall be based on the monthly basic salary set
  • The basic salary set herein is 60 per cent of the gross salary set
  • The deconsolidated remuneration structure set herein is in compliance with the Judgment of the Court in Nairobi ELRC Petition 29 of
  1. Part-Time and Co-opted Member of Full-Time Constitutional Commissions and Independent Offices: Shall be paid Sitting Allowance at the rate of KES 40,000 per sitting up to a maximum of KES. 320,000 per month.
  2. Benefits for State officers in Full-Time Constitutional Commissions and Independent Offices
    • Official Transport: State officers in Full-Time Constitutional Commissions and Independent Offices shall be provided with an official car of engine capacity not exceeding 3000cc.
    • Medical Benefit: An annual medical cover shall be provided to the State officer, one spouse and up to four children below twenty-five years fully dependent on the State officer, as follows:

Inpatient: KES 10 million Outpatient: KES 300,000

Maternity: KES 150,000

Dental: KES 75,000

Optical: KES 75,000

 

  • Retirement Benefit: There shall be two types of retirement benefits for State officers, pension and gratuity as follows:
  • A State officer serving or appointed on permanent and pensionable terms shall be eligible to pension benefit in line with existing
  • A State officer serving or appointed for a fixed term of office shall be paid a service gratuity at the rate of 31 percent of the annual pensionable emoluments for the term served.

Notes:

  • Where an employer establishes a pension scheme for its State officers appointed for a fixed term of office, the SRC shall review and set the rate of the employer’s contributions to the scheme and any other financial retirement benefits.
  • No State officer shall benefit from both pension and gratuity benefits from the same public body for a similar
    • Group Life Insurance: A State officer shall be covered for a value equivalent to three times of the annual pensionable
    • Group Personal Accident: A State officer shall be covered for a value equivalent to three times of the annual pensionable

Remuneration and Benefits for State Officers in the Executive of the County Government

IN EXERCISE of the mandate of Salaries and Remuneration Commission (SRC) as set out under Article 230 (4) (a) of the Constitution, SRC has reviewed the remuneration and benefits for State officers in the Executive of the County Government under the Third Remuneration and Benefits Review Cycle that covers financial years 2021/2022-2024/2025. Consequently:

  • for the period 2021/2022, the remuneration and benefits were retained as set by SRC in Gazette Notice 6518 of 7th July, 2017;
  • for the period 2022/2023, SRC has set the remuneration and benefits as published in this Gazette Notice; and
  • for the period 2023/2024 – 2024/2025, SRC shall set the remuneration and benefits on or before the commencement of FY 2023/2024.

Notes:

  • A serving State officer and a State officer appointed on or after the effective date of this Gazette Notice shall be paid the monthly deconsolidated remuneration package set herein.
  • The monthly remuneration set herein is fixed for the term of office of the State officer, unless reviewed and set by the Salaries and Remuneration
  • The remuneration set herein takes into account the reviewed job evaluation grading under the third remuneration and benefits review
  • Salary Market Adjustment is a salary modification that takes into account market positioning, and constitutional and statutory principles for review of remuneration and benefits.
  • For purposes of gratuity and pension, the pensionable emolument shall be based on the monthly basic salary set
  • The basic salary set herein is 60 percent of the gross salary set
  • The deconsolidated remuneration structure set herein is in compliance with the Judgment of the Court in Nairobi ELRC Petition 29 of
    1. Benefits for State officers in the Executive of the County Government

 

  • Official Transport: Shall be provided as follows:
    • Governor and Deputy Governor: Shall be provided with official car of engine capacity not exceeding
    • Member of County Executive Committee: Shall be provided with official car of engine capacity not exceeding
  • Medical Benefit: An annual medical cover shall be provided to the State officer, one spouse and up to four children below twenty-five years fully dependent on the State officer, as follows:

  • Retirement Benefit:

There shall be two types of retirement benefits for State officers, pension and gratuity as follows:

  • A State officer serving or appointed on permanent and pensionable terms shall be eligible to pension benefit in line with existing
  • A State officer serving or appointed for a fixed term of office shall be paid a service gratuity at the rate of 31 percent of the annual pensionable emoluments for the term served.

Notes:

  • Where an employer establishes a pension scheme for its State officers appointed for a fixed term of office, the SRC shall review and set the rate of the employer’s contribution to the scheme and any other financial retirement benefits.
  • No State officer shall benefit from both pension and gratuity benefits from the same public body for a similar
    • Group Life Insurance: A State officer shall be covered for a value equivalent to three times of the annual pensionable
    • Group Personal Accident: A State officer shall be covered for a value equivalent to three times of the annual pensionable
    • Car Loan and Mortgage Benefit: Shall be provided as follows:

Notes:

  • The applicable rate of interest shall be three (3) percent per annum on a reducing balance, for the duration of the
  • The car loan shall be recoverable within the contract term of a State
  • The car loan and mortgage schemes shall be administered and managed centrally by the County Treasury, within existing applicable regulations to govern the schemes and subject to availability of funds.
  • Daily Subsistence Allowance for local and foreign travels: Shall be paid to State officers in the Executive of the County Governments as per the rates reviewed and set by SRC from time to time.
  • Airtime: Shall be paid at the following rates:
  • County Governor: Up to KES 20,000 per month
  • Deputy County Governor: Up to KES 15,000 per month
  • Member of County Executive Committee: Up to KES 10,000 per month
  • Official Residence: The County Governor and Deputy County Governor shall be provided with an official residence together with commensurate home utilities and attendants by the county government. The official residence shall be a physical building/house owned by The benefit shall not be commuted to cash in lieu of an official residence.
  • Security: Shall be provided as advised by the Inspector General of Police and shall not be commuted to cash in lieu of

IEBC requirements for Presidential Candidates 2022

Requirements for Elective Post- Presidential Candidates

NOTICE is hereby given to the public on the qualifications and requirements for candidates contesting for elective positions together with nominees to Party Lists in the upcoming General Election scheduled to be held on 8th August, 2017

Select position :

Qualifications:

  • Must be a Kenyan citizen by birth;
  • Is qualified to stand for election as a member of Parliament;
  • Must not owe allegiance to a foreign state;
  • Must be a registered voter;
  • Is a holder of a degree from a University recognized in Kenya;
  • Is nominated by a Political Party or is an independent candidate;
  • Must not be a public officer or acting in any State of public office other than, President, Deputy President or Member of Parliament;
  • Must meet the moral and ethical requirements under the Leadership and Integrity Act;
  • Must not hold dual citizenship unless citizenship of the other country has been obtained by operation of law without capacity to opt out;
  • Must not be an undischarged bankrupt;
  • Must not be a person of unsound mind;
  • Must not be subject to a sentence of imprisonment of at least six months from the date of registration of candidates or date of elections;
  • Must not have been found to have abused or misused state or public office or contravened Chapter Six of the Constitution; and
  • Must not have been dismissed or removed from public office for contravening the provisions of Articles 75, 76, 77 and 78 of the Constitution.

The Candidate must submit the following documents to the Commission during the Commission Nomination:

  • Certified copies of educational qualification certificates, including a Degree Certificate in accordance with Section 22 of the Elections Act, 2011 and Regulation 47 of Elections (General) Regulations, 2012.
  • A copy of a National Identity Card/valid Passport (the document used by the candidate to register as a voter).
  • A Passport size photograph with white background submitted in hard and soft copy.
  • If a Party Candidate, a Nomination Certificate from a fully registered Political Party nominating the candidate, duly dated and signed by an authorized official of the party.
  • A duly signed and dated Code of Conduct (Second Schedule of the Elections Act, 2011)
    • A duly filled Commission Nomination Form, including:
      An original Statutory Declaration Form for purposes of nomination (Regulation 18(3) Elections (General) Regulations, 2012 and an original Self-Declaration Form (Regulation 46 of Elections (General) Regulations, 2012).
    • For both Political Party Candidates and Independent Candidates, an electronic and printed copy of not fewer than 2000 voters from each of the majority of the counties in the prescribed form.
  • Nomination fees in a Banker’s Cheque payable to IEBC:
    • 200,000 for candidates
    • 100,000 for a candidate who is a youth, a woman or a person with a disability.

For an Independent Candidate:

  • A Clearance Certificate from the Registrar of Political Parties certifying that the person was not a member of any political party for the last 3 months before the elections; (Regulation 15(a) (General) Regulations, 2012.
  • An electronic and a printed copy of a list of at least 2000 supporters from each of the majority of the counties in the prescribed form, submitted to the Commission.
  • A duly filled Form of Intention to Contest, prescribed by the Commission.
  • A symbol the candidate intends to use during the election, which has been approved by the Commission 21 days before Nomination day.
  • Establish and maintain a functioning office in the respective electoral area where the candidate is contesting, which must be available for inspection by the Commission at least 45 days before the elections. The address, including the physical address of the office must be communicated to the Commission
