1. DAVID      NJILITHIA MBERIA 12720332 KAREN 1381 ODM The Aspirant was charged in Milimani Anti-Corruption Court  Case  No.  7  of  2019  with  offences  of  bribery under section 6 as read with section 18 of the Bribery Act. He was convicted on three accounts, for which he was sentenced to pay a fine of Kshs. 300,000; Kshs. 200,000 and Kshs. 200,000 respectively and in default to serve 12 months on each account, the sentences to run consecutively. In addition, the court directed that the Aspirant  be forthwith  barred from holding public office,  in  accordance  with  section  18  of  the  Bribery Act. The Aspirant therefore requires to prove that he has  preferred  an  appeal  challenging  the  conviction, and the result thereof.

MUTWIWA     DAVID MAITHA 23797281 KASIKEU 0417 MAENDELEO CHAPCHAP The   Aspirant   was   charged   in   Court   with   counts relating   to   impersonating   an   Ethics   and   Anti- Corruption  Commission  investigator  and  uttering  a false  document.  He  was  convicted  on  the  count  of impersonating   an   investigator   of   the   Commission contrary  to  s.  34(1)  as  read  with  s.  34(2)  of  Anti- Corruption and Economic Crimes Act to a fine of Ksh. 300,000 or in default 1-year imprisonment and to the count of uttering a false document contrary to s.  349 of the Penal Code as read with sec. 353 of the Penal code, to a fine of Kshs. 300,000 or in default 1 year imprisonment.
The Aspirant has further been charged in Court vide Case  No.  ACC.  518  of  2016  with  counts  relating  to allegations of impersonating an EACC investigator and collects bribes from members of public. The matter is pending in court.
3. NYAKUNDI KEPHA SAGINI 29123201 KEGOGI 1340 UNITED PROGRESSIVE ALLIANCE The   Aspirant   was   charged   at   the   Eldoret   Anti- Corruption vide Case No. ACC 2 of 2022 with counts relating  to  forgery  of  his  academic  certificates  and personating  a  person  named  in  a  certificate.  The matter is pending in court.

The investigation was concluded and the Aspirant and others were charged in Meru vide Case No. Meru ACC No. 10 of 2015. The matter is pending before court.

BALLA ABDI SORA 13868383 GARBATULLA JUBILEE The Commission received and investigated allegations that the aspirant made a false document purporting to be     supplementary     budget     of     Isiolo     County Government. The investigation was concluded and the Aspirant and others were charged in Meru vide Case No. Meru ACC No. 10 of 2015. The matter is pending before court.

The charges are linked to irregular payment of kshs. 68,000,000/=  made  by  Nairobi  City  County  to  M/S Wachira Mburu, Mwangi & Co. Advocates.
The matter is pending before court.

Recruited IEBC Staff (POs, DPOs and Clerks) 2022

The Independent Electoral Boundaries Commission (IEBC) has recruited 295 Presiding Officers (POs) and 2,021 polling clerks in Naivasha Constituency as part of the preparations for the August 9 General Elections.

Speaking to KNA, Naivasha Constituency IEBC Returning Officer (RO); Ms. Agnes Muriuki said 287 presiding officers will man the 287 polling stations in the constituency while the remaining eight POs will be stationed at the tallying centre.

She further noted similar number of Deputy Presiding officers (DPOs) have been recruited to help man the 287 polling stations.

The RO also said that each polling station will have seven polling clerks who will be performing different roles during the Election Day.

Muriuki said the recruitment went on smoothly without any hitches except for a few incidences where one or two young people tried to present academic papers that were not authentic or altered and they were now gearing for the trainings which start next week.

The trainings start with that of the of the Returning Officers(ROs) and their deputies who will in turn train the Presiding Officers (POs) and their deputies before the training goes to the polling clerks.

The qualifications for POs was a degree or Diploma in any field with that of polling clerks being an aggregate of C- (C Minus ) and above in Kenya Certificate of Secondary Education (KCSE).

Last month, IEBC cleared 10 aspirants to vie for the Naivasha parliamentary seat in the coming General Elections.

According to Muriuki six of the aspirants were cleared to vie for the Naivasha parliamentary seat on political party tickets.

The R.O. said they cleared 67 aspirants to fight it out for the eight seats of Member of the County Assembly (MCA) in Naivasha Constituency as independents and on various political parties.

Latest data from IEBC shows Naivasha Constituency has 157,128 registered voters and 287 polling stations, serving the eight electoral wards in the constituency.

The country goes to polls on August 9 with over 22 million registered voters expected to elect their leaders at six levels which include; the presidential, gubernatorial, senatorial, county women representatives, members of parliament and members of county assemblies.

During voting ensure you have the right ballot papers that have an IEBC stamp at the back top- center. Only stamped ballot papers will be counted as valid.

When marking you are only allowed to use the following marks:

How Counting of votes will be done by the Presiding Officer, PO, at the polling station

Counting of Results

The Presiding Officer shall adhere to the following steps before counting;

  • Allow a health break of at least 15 minutes after close of polling and before setting up the station for counting
  • Re-arrange the room for counting
  • Assign duties to DPO and Clerks
  • Position Police Officers strategically to secure the room
  • Brief Agents on what constitutes a valid vote, rejected, rejection objected to ballots, and disputed votes.
  • Inform agents and observers on the commencement of vote counting.

Persons allowed in the Counting Room

  • Election officials
  • Police Officers on duty
  • IEBC Commissioners and staff
  • Candidates and their running mates
  • Accredited Media
  • Accredited polling/counting agents
  • Accredited Observers

SEQUENCE OF COUNTING/ ORDER OF COUNTING VOTES

The counting and announcement of votes shall be done in the following order:

  1. President (Form 34A)
  2. Member of the National Assembly (Form 35A)
  3. Member of the County Assembly (Form 36A)
  4. Senator (Form 38A)
  5. County Woman Member to National Assembly (Form 39A)
  6. County Governor (Form 37A)

N.B : The opening, counting, filling of forms, packaging, sealing of ballot box and announcement of election result for an elective position shall be completed before commencing the next elective position.

Rejected ballot papers

This is a ballot paper which does not qualify to be a vote because:

  • It does not bear the security features determined by the Commission;
  • It appears to be marked against the names of, more than one candidate;
  • It is not clear to whom the vote has been marked;
  • It bears a serial number different from the serial number of the respective polling station ballot papers and which cannot be verified from the counterfoil of ballot papers used at that polling station;
  • It is unmarked,

Rejected ballot papers

This is a ballot paper which does not qualify to be a vote because:

  • It is marked by more than one mark;
  • It bears marks or writing which may identify the voter
  • It is marked elsewhere other than in the proper place;

A rejected ballot paper is stamped “IEBC REJECTED” on the face. The serial number of a rejected ballot paper and the reason for rejection are recorded in the Statement of Rejected Ballot papers (Form 41)

Rejection Objection to ballot papers

  • This is a rejected ballot paper objected to by agent(s).
  • It is stamped “IEBC REJECTION OBJECTED TO” on the face of the ballot paper.
  • This ballot paper remains rejected ballot and is also recorded in Form 41 as rejected ballot paper.
  • This ballot paper has two stamps e. ‘Rejected’ and ‘Rejection Objected Paper’

Disputed vote

  • This is a vote awarded to a candidate but disputed by an The PO shall indicate the serial number of the disputed vote and the candidate to whom it has been awarded and this is recorded in the result declaration form.
  • It is stamped “IEBC DISPUTED” on the face of the ballot paper and remains valid, and is tallied in the Form 33(tally sheet) in favor of the candidate so awarded

Sorting and Counting Procedures

  • The Presiding Officer should:
  • Open the ballot boxes
  • Break the security seals on the ballot box EXCEPT the seals on the aperture
  • Empty contents onto the counting surface in full view of agents or observers and election officials
  • Unfold each ballot paper and place face down
  • Check if the ballot paper has an IEBC stamp at the back
  • Fill in the Form 41 Statement of Rejected ballot papers if you come across rejected ballot papers
  • Sort the ballot papers in bundles per candidate by picking the ballot papers one by one and raise to display the mark on each ballot paper
  • Count loudly the votes for each candidate in the order they appear on the ballot paper
  • Mark every vote counted on Form 33 (Tallying Sheet)
  • Bundle the ballot papers for each candidate in sets of 50 and tie using a rubber
  • Immediately after counting for each candidate, record the total number of valid votes in the appropriate polling station result declaration form
  • Put the valid votes, the rejected ballot papers and the disputed votes separately in the labelled tamperproof envelopes
  • Fill in the PSD ‘Record of Packets’ table

Settlement of disputes during votes counting at the Polling Station

  • The PO will make a determination on “Disputed Votes”, “Rejected Ballots” and “Rejection Objected to Ballots”
  • A candidate or agent present during counting may request for a recount if there are compelling reasons
  • The PO may on his or her own initiative have the votes recounted
  • A recount of votes shall not take place more than twice
  • The filling of result declaration form commences after the count/recounts

Results Transmission And Presentation (RTS)


RTS is a system for transmitting provisional results electronically to an observation centre.

At the end of voting and when votes have been counted and tallied, the Presiding Officers (Pos) enter the data on the signed results sheet (Form 35) into a specially configured mobile phones and transmits the results simultaneous to the election results centres at the constituency, county and national level.

  • Enhance transparency through electronic transmission of provisional results from the polling stations
  • Display and visualize provisional results at the tally centers
  • Provide access to provisional elections data to media and other stakeholders in real time

IEBC 2022 RECRUITMENT.

The Independent Electoral and Boundaries Commission (IEBC) is hiring 7540 Clerks and 580 ICT supervisors countrywide on a short term basis to help in the upcoming mass voter registration that will take place soon and other functions of the commission.The general public is hereby informed of the positions advertised and encouraged to apply online for them.
The Commission is embarking on recruitment and training of successful personnel in the  two categories indicated below.

VACANT POSITIONSThe personnel are divided into two categories, namely;

  • Constituency ICT Clerks (580)
  • Clerks (7,540)

REQUIREMENTS

The following are the requirements for various positions.

(I) CLERKS

  • Must be a Kenyan Voter of good conduct and responsible citizen.
  • At least form four level of education with a minimum of C- or equivalent
  • Must have legible, neat handwriting
  • Must be residents of the sub-locations, preferably the polling station they vote in or a nearby one.
  • Aged between 18 and 50 years old
  • Must have a national identify card
  • Fluent in the main local language/dialect.

(II) SUPERVISORS/ICT CLERKS.

  • Should be mature and responsible citizens, preferably teachers, government officers, or university graduates with management experience.Any past working experience with IEBC will be an added advantage.
  • Must be residents of the locations they wish to work in
  • Aged between 25 years and 50 years Must have a national identity card
  • Fluent in the main local language/dialect
  • Must have good communication and training skills
  • Must have good public relations.
