IEBC Kenya – All Details

The Independent Electoral and Boundaries Commission, IEBC, is the commission in charge of elections in Kenya.

Functions of the IEBC

  1. Conducting or supervising referenda and elections.
  2. Registering eligible citizens as voters
  3. Announcing elections dates and time. It also sets date for by-election.
  4. Drawing the boundaries of constituencies and wards.
  5. Regulating the process by which parties nominate candidates for elections.
  6. Settling electoral disputes.
  7. Observing, monitoring and evaluating elections.
  8. Developing a code of conduct for contesting candidates and parties.
  9. Registering of the candidates for elections.
  10. Educating voters.
  11. Maintaining and regularly updating voters register.
  12. Determining and reviewing the boundaries of constituencies and wards.

IEBC Kenya – All That You Need To Know

The Independent Electoral and Boundaries Commission, IEBC, is the commission in charge of elections in Kenya.

– The commission comprises of the following members:

i) The chairperson

ii) The vice-chairperson

iii) A minimum of one and a maximum of seven commissoners.

  • The commissioners are nominated by the parliament select committee;approved and confirmed by the National Assembly then appointed by the President.
  • Each member serves a six year term after which they will not be re-appointed again once the term is over. By law no commissioner can be a member of a political party. The commission is headed by the chairperson.

Functions of the IEBC

  1. Conducting or supervising referenda and elections.
  2. Registering eligible citizens as voters
  3. Announcing elections dates and time. It also sets date for by-election.
  4. Drawing the boundaries of constituencies and wards.
  5. Regulating the process by which parties nominate candidates for elections.
  6. Settling electoral disputes.
  7. Observing, monitoring and evaluating elections.
  8. Developing a code of conduct for contesting candidates and parties.
  9. Registering of the candidates for elections.
  10. Educating voters.
  11. Maintaining and regularly updating voters register.
  12. Determining and reviewing the boundaries of constituencies and wards.

1. COMMISSION SECRETARY/CHIEF EXECUTIVE OFFICER

The Commission Secretary shall, in the performance of the functions and duties of the office,
be responsible, answerable and report to the Commission and shall be the chief executive
officer and the accounting officer of the Commission. The Commission Secretary/CEO is the
head of the secretariat and Chief Elections Officer responsible for day to operations of the
Commission. A key part of the responsibilities for this office is to ensure prudent
management of the commissions resources, integrity and professional performance of all
commission functions.
DUTIES AND RESPONSIBILITIES
a) Provide requisite leadership to the Secretariat to ensure the Commission attains high level
of professionalism and ethical standards;
b) Provide guidance to the Secretariat for day to day administrative functions of the
Commission;
c) Oversee development of the Commission’s annual work plans and annual operating
budgets;
d) Oversee financial and administrative management of the Commission;
e) Enhance and maintain proper internal control systems and procedures;
f) Drive the Commission’s vision, mission, objectives and goals through the implementation
of its strategic plan;
g) Ensure effective management of Commission’s resources and accountability;
h) Ensure continuous improvements in quality and compliance with legislations adopted by
the Commission from time to time;
i) Ensure safe custody of all the Commissions documents as the chief custodian; and

j) Serve as Secretary to the Commission Plenary
QUALIFICATIONS, SKILLS AND EXPERIENCE FOR APPOINTMENT
a) Must be a citizen of Kenya;
b) Possesses a degree from a recognized university;
c) Has had at least five years’ proven experience at management level
d) Has proven relevant experience in either; electoral matters; management; finance;
governance; public administration; law; or political science; and
e) Must meet the requirements of Chapter 6 of the Constitution.
f) Must have Membership of a recognized professional body and in good standing;
g) Proven experience in leadership, management and corporate governance will be added
advantage.
h) Proven working knowledge and thorough understanding of Public Finance Management
Act and Public Procurement and Asset Disposal Act will be an added advantage;
i) Must be computer literate.

2. DEPUTY COMMISSION SECRETARY/OPERATIONS

The Deputy Commission Secretary (operations) role is to deputize the Commission Secretary
in the management of the secretariat, and is responsible for advising and providing strategic
direction to the Commission’s core function of electoral operations and management
including voter registration, voter education and operational planning and other related
electoral operations activities
DUTIES AND RESPONSIBILITIES
a) Responsible to the Commission Secretary for management and coordination of the
Commission’s field services;
b) Responsible for electoral cycle and operational planning of electoral events including
development of proposals for reforms and change initiatives;
c) Monitor and ensure the effective and efficient performance of core functions including;
voter education, voter registration, boundary databases, electoral operations and electoral
dispute resolution;
d) Responsible for integration of appropriate technology in electoral operations;
e) Oversee the development and management of electoral reporting system, and ensure the
development of key policies and strategies for the respective electoral divisions;
f) Oversee the development of a voter registration plan, structures and processes to deliver
a certified and credible National Voters Register;
g) Oversee the development of voter education plans, strategies and collaborations;
h) Coordinate the development of the electoral calendar and manage its execution; and
i) Review findings on monitoring and evaluation of all electoral events with a view to
recommending areas for improvements.
REQUIREMENTS FOR APPOINTMENT
a) Must have a Master’s degree in social Sciences, Law or Public/Business Administration or
related field from a recognized university/institution;
b) Must have a Bachelor’s degree in social Sciences, Law or Public/Business Administration or
related field from a recognized university/institution;
c) Must have a minimum of ten (10) years’ relevant experience, five (5) of which must be at
senior management level in a large organization;
d) Must be a Member of a relevant professional body and in good standing; and

e) Must have demonstrated track record in delivering significant strategic
initiatives/experience or a strong appreciation of electoral administration or electoral
reform is desirable.

Terms of Service Permanent and Pensionable
Reporting to the Director Voter Registration through the respective County Election
Managers, the Senior Elections Officer shall be responsible for all matters pertaining to
administration of elections in their constituencies of deployment.
DUTIES AND RESPONSIBILITIES
a) Provide management support, develop and oversee the implementation of strategies,
policies, plans and budgets at the constituency level while ensuring the alignment of these
to the regional and overall Commission strategies;
b) Ensure that election operation activities at the constituency level comply with internal
controls and budget restrictions;
c) Ensure provision of administrative support services at the constituency level including
distribution of election materials, transport management, implementation of security
policies and protocols and ensuring the safe custody of the Commission’s assets;
d) Be responsible for sound financial management and prudent use of all Commission funds
at constituency level in line with Commission’s financial policies;
e) Liaise with the County Election Manager to implement training programmes for
registration and election officials at the constituency level;
f) Identify, inspect suitable polling, nominations and tallying centers;
g) Liaise with regional administrative and security officials at the constituency level to ensure
safety of Commission Assets;
h) Undertake the verification, compilation and revision of Constituency voter’s register as
required by law from time to time;

i) Liaise with political parties with respect to elections and related activities;
j) Develop accountability measures, monitor the performance indicators at the constituency
levels and ensure the timely preparation of periodic reports;
k) Be the Returning Officer during elections and the Voter Registration Officer during voter
registration exercise;
l) Perform any other duties as assigned by the Commission.
REQUIREMENTS FOR APPOINTMENT
a) Must have a Bachelor’s degree from a recognized university;
b) Proven experience in results-based management, monitoring and evaluation or managing
election process is an added advantage;
c) Must have a minimum of Six (6) years working experience, two (2) of which must be at
management level;
d) Additional training, professional qualifications and experience of fieldwork will be an
advantage;
e) Must be proficient in computer literate;
f) Should possess good negotiation, planning and coordination skills;
g) Must be a team player and possess good management and leadership skills;
h) Must be a person of undoubted integrity

5. COUNTY ACCOUNTANT – TURKANA COUNTY

This position is responsible for supporting the County Elections Manager (CEM) on day to
day operations and preparation of all books of accounts in the County office.
DUTIES AND RESPONSIBILITIES
a) Initiate payment process, prepare and examine vouchers received from the Constituency
Office Clerks in the County;
b) Prepare payroll for the temporary hired election officials for the County;
c) Maintain cashbooks and bank reconciliation for the County;
d) Disbursement of funds to constituency offices within the County and check off returns;
e) Advise the CEM on all County financial matters;
f) Certify and verify returns and vouchers in the County;
g) Write cheques and arranging for withdrawal of cash for County office use;

h) Ensure settlement of bills for the services and goods supplied to the County offices;
i) Handle leave records, office accommodation, medical issues, and any other
administrative matters in the County;
j) Manage and update the risk register on electoral operations in the County;
k) Maintain leases, County assets titles and ensure security of IEBC owned and hired
premises;
l) Deal with procurement matters promptly as may be directed in collaboration with
Supply Chain Management Assistant;
m) Identify constituency needs and supplies and address them for the County;
n) Coordinate and maintain proper staff files, personnel, and accounting records;
o) Certify and verify returns from the constituencies;
p) Prepare expenditure returns in the County.
REQUIREMENTS FOR APPOINTMENT
a) Have Bachelor’s degree in, Finance, Commerce or equivalent from a recognized
institution;
b) Must be a Certified Public Accountant (CPA) (K) or its equivalent qualifications;
c) Must be a member of ICPAK;
d) Must have at least three (3) years relevant work experience in a reputable organization;
e) Must have good interpersonal and communication skills;
f) Must be proficiency in Computer Applications;
g) Must be a person of undoubted integrity
h) Must hail from the County he/she is applying for as indicated in national identity card;
6. COUNTY SUPPLY CHAIN MANAGEMENT ASSISTANT, NYERI COUNTY

b) Assist in procurement, preparation of procurement plans, market survey and research;
c) Assist in stock taking, reconciliation, preparation and maintenance of records;
d) Ensure proper record keeping of all stores/equipment in the warehouse and safe keeping
of the same;

regulations and procedures;
f) Prepare monthly and annual Supply Chain Management reports/returns and forward to
Headquarter through the CEM.
REQUIREMENTS FOR APPOINTMENT
a) Must have a minimum Diploma in Supplies Management or Procurement Management
from a recognized Institution;
b) A degree in a relevant field will be an added advantage;
c) Must be a member of a professional body (KISM) and in good standing;
d) Must have a minimum of three (3) years of relevant work experience
e) Must have good interpersonal and communication skills and a team player;
f) Must be computer literate and possess good analytical skills;
g) Must be a person of undoubted integrity.
h) Must hail from the Constituency applied for as indicated in the National Identity card;

Terms of Service Permanent and Pensionable
Reporting to the Senior Election Officer, the Assistant Election Officer II shall be responsible
for all matters pertaining the administration of the Constituency Offices where they shall be
deployed.
DUTIES AND RESPONSIBILITIES
a) Oversee general management of constituency office in absence of Senior Election Officer;
b) Completing voter registration control sheets and control registers;
c) Keep up to date statistics on voter registration exercise;
d) Updating regularly and maintaining and updated register of electors and making sure it is
always accurate;
e) Checking that all electoral materials and equipment are in good working condition;
f) Assist the Senior Election Officer in mapping of polling stations/registration centres;
g) Assist in publicity of voter registration of voters, elections, inspection of the register and
any other activity to be undertaken by the Commission;
h) Quality control the work done by registration and polling officer on voter registration;
i) Receive, distribute, maintain an inventory of materials & equipment to registration
centres;

j) Replacing lost and defaced voters cards with duplicate cards;
k) Assist in preparation of work plans, security plans, transport, and logistical plans;
l) Safeguarding registration data;
m) Assist in verifying the register of visitors;
n) Ensuring security of office records, equipment and documents, including classified
materials; and preparing responses to basic routine correspondence;
o) Perform any other duties as assigned by the Commission.
REQUIREMENTS FOR APPOINTMENT
a) Must have a Bachelor’s degree from a recognized university;
b) Must have three (3) years relevant working experience in a busy organization;
c) Must hail from the Constituency applied for as indicated in the National Identity card;
d) Should be competent and confident in handling office records and processes;
e) Must have good interpersonal and communication skills and a team player;
f) Must be computer literate and possess good analytical skills;
g) Must be a person of undoubted integrity.

DISQUALIFY AND REJECT INDIVIDUALS WITH QUESTIONABLE INTEGRITY IN THE AUGUST 2022 POLLS
PRESS RELEASE AND METHODOLOGICAL NOTE
Sunday, 22nd May 2022, Nairobi
We,  Civil  Society  Organisations,  under  the  banner  of  the  National  Integrity  Alliance  (NIA)  have  been  closely monitoring key developments in regard to the enforcement of Chapter 6 of the Constitution on leadership and integrity. With the 9th August 2022 general elections drawing closer, we note that various political formations have nominated candidates to vie for elective seats, and various individuals have also presented themselves to contest
as independent candidates. Regrettably a number of these political aspirants have tainted integrity.
At stake in this year’s polls is the risk of electing to public office individuals who are in breach of the leadership and integrity tenets as enshrined in Chapter 6 of the Constitution of Kenya 2010, those named adversely by statutory agencies or prosecuted for corruption, economic crimes and abuse of office or other criminal offences. The cost of electing  such  leaders  is  borne  by  citizens  through  broken  promises  to  provide  effective  public  services,  like witnessed  recently when we  experienced  a surge  in  the cost  of  living  due to  rising  food  and  fuel prices  in  the country. Even worse, the country is losing a third of its budget annually to corruption and caving under a high level
of public debt.
The Red Card Campaign
To stop such individuals from ascending to public office and transforming the seeds of corruption into trunks of impunity, we have today launched the Red Card Campaign 2022. This is a continuation of the Red Card Campaign 2017 – a citizens’ driven campaign to rally public support against corrupt and unethical leadership, raise awareness and compel electoral vetting institutions to implement Chapter Six of the Constitution of Kenya on Leadership and
Integrity.
Updates on the 2017 Red Carded individuals
In 2017, we Red Carded 20 individuals that should not have been cleared to participate in the general elections on grounds of integrity and corruption. Some of those red carded, who were unfortunately elected such as, Ferdinand Waititu – former Kiambu County Governor, Mike Sonko – former Nairobi County Governor, Zakaria Okoth Obado – Migori County Governor and Anne Waiguru -Kirinyaga County Governor, were eventually impeached and others are in court following new corruption and criminal charges, while some are subjects of ongoing criminal investigations. These outcomes have lent
credence to our past efforts to block individuals unfit to hold public office.
Red Carded Individuals in 2022
The 25 individuals listed below have been Red Carded after an objective and impartial investigation, we hold that they are not fit to serve in any appointive or elective public office. Some of these individuals in Red Card 2022 were also Red Carded in 2017. The list is presented in alphabetical order and not in order of the severity of
offences or cases.

The comprehensive Red Card list can be accessed on the National Integrity Alliance (NIA) website. The list above is not exhaustive, given that many of those who have declared their interest to seek elective positions in the
August 2022 general elections have either been adversely mentioned by investigative institutions, face
prosecution or are already convicted.  This is a continuous campaign, and we are still reviewing a number of
reports and we will update and publicise the Red Card 2022 list.
How did we arrive at the list for Red Card 2022
The Red Card 2022 list has been generated from authentic and verifiable investigative reports. It includes information gathered from existing reports by oversight institutions including, the Office of the Auditor General (OAG), the Ethics & Anti-Corruption Commission (EACC), Kenya National Commission on Human Rights (KNCHR), the Office of the Director of Public Prosecutions (ODPP), National Cohesion and Integration Commission (NCIC),
Parliament and various cases before the courts both concluded and active.  The process also involved the
people’s vetting commission, comprised of credible civil society and faith-based organizations who scrutinized and validated the list.
The Red Card 2022 list is anchored on the Constitution of Kenya 2010. The guiding criteria is generated from the national values as envisaged in Article 1 and Article 10 of the Constitution; the principles of leadership and integrity under Chapter Six of the Constitution; the principles of public finance in Article 201, values of public services in Article 232 and qualifications for election, moral and ethical requirements referred to under Articles 99 (1) (b) and 193(1)(b) of the Constitution. Other subsidiary legislations include the Public Finance Management Act 2012, Anti- Corruption and Economic Crimes Act 2011, the Leadership and Integrity Act 2012,  the Elections Act 2011 and the
Public Procurement and Disposal Act 2015; the NCIC Act and KNCHR Act.
Our rallying call
We call on electoral vetting institutions to exercise their mandate and bar all corrupt and unethical aspirants from vying in the elections. We shall complement this effort by raising awareness of the importance of ethical choices. We have currently filed a petition in court seeking a legal interpretation on the minimum integrity threshold of candidates seeking elective and appointive positions in the public service, as well as the final custodian institution for Chapter 6 of the Constitution.
To disrupt the real and present danger to the Nation, we call on Kenyans to join us in a 70-day campaign, beginning today, to Red Card all corrupt and unethical political aspirants. Citizens should flash red cards at any corrupt and unethical aspirants in their rallies and political activities to express their discontent with such individuals.
Beginning next week, we will launch an online petition on change.org; we ask the public to sign the petition which we will present together with the list of Red Carded individuals to the EACC and IEBC. We must hold all current and aspiring leaders accountable to Chapter 6 of the Constitution. In case these corrupt and unethical
political aspirant’s sieve through the vetting institutions, we call on voters to reject them at the ballot.
We extend our hands of cooperation and partnership to all who seek to place Chapter 6 at the heart of our democracy. We commit to work with political parties, vetting and other relevant institutions to sensitize citizens on the minimum integrity threshold for current and future leaders.
Lastly, Kenyans have been made to abandon their ideals every time we have an election because politicians set the agenda making the quest for integrity subservient to other interests. On 9th of August 2022, Kenyans have a date with destiny; we have one more chance to vote for integrity.

WHAT IS THE REDCARD CAMPAIGN
The #RedCard Campaign seeks to bar aspirants that fall short of the ethical standards of integrity from assuming elective or appointive office. The new spirit of active citizenship across all levels of society and government must be catalysed to enforce existing robust laws and institutions and roll back the future abuse of public office and theft of public resources. The Red Card Campaign has three objectives for the next 70 days. They are 1.) Public education against corruption and abuse of office 2.) De-campaign aspirants who fall short of the ethical threshold of Chapter 6, and 3.) Institute legal proceedings for the removal of those who win the elections despite their demonstrated unethical behaviour.

IEBC scrutiny report on 15 polling stations presidential results

Scrutiny Report.

A total of 45 presidential ballot boxes were availed for scrutiny. While 54 ballot boxes were expected, IEBC indicated that 9 fell on what they termed ‘non-existent’ polling stations and were therefore not available, this could probably be attributed to typos in the order/request or mismatch.
On arrival of the ballot boxes, we did visual inspects and noted that:

1. The boxes looked intact and clean, and the seals were in place;
2. Majority of the boxes did not have form 34A affixed to them as is the norm;
3. Each ballot box was accompanied by the Polling Station Diary.

After receipt of the ballot boxes, actual scrutiny commenced on each ballot box.
Generally, the following observations were cross-cutting in numerous ballot boxes:

1. In numerous ballot boxes, the serial numbers of seals affixed to the ballot boxes did not match those indicated in the Polling Station Diary. In other cases, the entries in the Polling Station Diary had been overwritten to hide the true serial numbers for the seals.
2. In numerous ballot boxes, the duplicate of form 34A was not available inside the ballot box thus casting doubt on the credibility of the “original” form 34A used to declare results when the duplicate is not independently available within the box to confirm its authenticity.
3. Book 2 of Form 34A was supposed to be securely sealed within the ballot box, unused. In numerous cases the book was missing within the box. This cast doubt on where the book was and whether it had been used elsewhere against IEBC’s own commitment that it won’t be used during the elections.
4. In numerous cases, the manual register was not available within the box. This casts doubt on how the manual register was used, or how many entries were made therein. This was contrary to IEBC’s own directions to the officers as communicated to presidential candidates.
5. It was also observed that in majority of the cases there was no form 32 within the ballot boxes. The form could confirm how the manual register was used thus give accurate figures on those identified through the manual register.
6. In numerous cases, the various materials were not secured within sealed envelopes. Within the evidence of seals being inconsistent, this cast doubt on credibility of the contents of the ballot boxes.

Specific to the ballot boxes:

1. Majengo Primary School Station 1 – the following were observed:
a. There was no record of the aperture seal serial number in the Polling Station Diary. The authenticity of the seal on the ballot box could not therefore be confirmed.
b. The ballot box did not have form 34A affixed to its wall.
c. All the seals on the ballot box had serial numbers recorded in the Polling Station Diary but the same were overwritten and altered to make them ineligible and cast doubt on their authenticity.
d. There was no Form 32 in the ballot to confirm how the manual register was used.
e. The duplicate of form 34A was not placed inside the ballot box and was therefore not available.
f. Book 2 of form 34A was not available in the ballot box.
g. A count of ballots attained by Raila Odinga showed he had 129 votes, while the form 34A on the IEBC portal showed a less vote of 128.
2. Majengo Primary School Station 2 – the following were observed:
a. There was no record of the aperture seal serial number in the Polling Station Diary. The authenticity of the seal on the ballot box could not therefore be confirmed.
b. The ballot box did not have form 34A affixed to its wall.
c. There was no Form 32 in the ballot to confirm how the manual register was used.
d. The duplicate of form 34A was not placed inside the ballot box and was therefore not available.
e. Unused Book 2 of form 34A was available in the ballot box.
3. Mvita Primary School Station 1 – the following were observed:
a. There was no record of the aperture seal serial number in the Polling Station Diary. The authenticity of the seal on the ballot box could not therefore be confirmed.
b. The ballot box did not have form 34A affixed to its wall.

6. Mvita Primary School Station 4 – the following were observed:
a. The ballot box did not have form 34A affixed to its wall.
b. The duplicate of form 34A was available but not stamped.
c. Unused Book 2 of form 34A was not available in the ballot box.
d. Form 32 was not available to confirm use of manual register.
7. Mvita Primary School Station 5 – the following were observed:
a. The aperture seal’s serial number was different from the one recorded in the Polling Station Diary thus lending doubt to the authenticity of the seal or credibility of the content of the ballot box.
b. The ballot seals’ serial numbers recorded in the Polling Station Diary were altered and overwritten thus casting doubt on their credibility.
c. Form 32 was not available to confirm use of manual register.
8. Mvita Primary School Station 6 – the following were observed:
a. The ballot box did not have form 34A affixed to its wall.
b. The duplicate of form 34A was available but not stamped.
c. Form 32 was not available to confirm use of manual register yet the manual register itself was available with 232 crossings indicating it was used but without the required statutory forms.
9. Mvita Primary School Station 7 – the following were observed:
a. The ballot box did not have form 34A affixed to its wall.
b. The ballot papers and contents of the ballot box were not secured in sealed envelopes.
c. The manual register was not enclosed in the ballot box.
d. The duplicate of form 34A was available but not stamped.
e. Unused Book 2 of form 34A was not available in the ballot box.
f. Form 32 was not available to confirm use of manual register.
g. There was inconsistency in the number of registered voters as recorded in form 34A and as presented in the register.

QUEUING CLERK

  • Deployed where there are two or more polling stations in a registration centre
  • Allocated to the odd number polling station
  • Labels the polling stations according to the polling stations’ registers, which includes the number, alphabets that fall in respective polling station
  • Welcomes and directs the voter’s to their respective polling station using their first
  • Informs the PO on voters with special needs like PWD, pregnant mothers, drunkards etc
  • Ensures the queues are orderly.

2022 Presidential Petition Judgement by Supreme Court of Kenya

My explainer on the Supreme Court Verdict:
1. The technology deployed by IEBC met the requirements for integrity, verifiability, security and transparency to guarantee accurate and verifiable results.

2. There was no interference with the uploading and transmission of form 34As from the polling stations to the IEBC public portal.

3. There was no difference in the forms 34As uploaded on the IEBC public portal and the forms 34As delivered at the National Tallying Centre and the forms 34 As issued to the agents at the polling station.

4. The postponement of gubernatorial, parliamentary and Ward elections in various parts of the country did not amount to voter suppression

5. There were unexplainable differences/discrepancies between votes cast for presidential candidates and those cast for other elective positions

6. The counting, tallying, verification and declaration of results was done in accordance with Article 138 of the Constitution

7. The President-Elect did not fail to meet 50%+1 threshold required by article 138 of the constitution.

8. There were no irregularities and illegalities to such a magnitude as to have affected the declared final results of the elections

9. Reliefs:

1. A declaration that the President Elect was Validly elected.

2. An order that the Parliament set up an inquiry into the working/dysfunction in IEBC

3. An order that Parliament set up a special inquiry into the allegations that NSAC attempted to influence the outcome of the election.
