Kebirigo Boys High school 2021/2022 KCSE Results Analysis, Grade Count

Kebirigo Boys High school recorded an impressive result in the 2021 KCSE exams. The school recorded a mean score of 9.174 points which is a B (plain).

Out of the 311 candidates who sat for the 2021 KCSE exams,  a total of 310 candidates attained the direct university entry grade. This translates to 99.67846% direct entry.

Updating Teacher Profile at the TSC Online Portal; Step by step guide

The Teachers Service Commission (TSC) expects all teachers to update their profiles, online. In case you have not updated your profile, then you have no reason to worry as this article will guide you. Update your profile at the TSC Online Portal by following the steps below, here.

Profile Updating Process.

To update your profile;

  • Visit the TSC online portal by using the link; https://tsconline.tsc.go.ke/register/update-profile. You will see the window below;

  • Now, Fill in the following details and Click Next Page Button to Continue: ID Number/Passport Number,
  • Please enter the 4-digit verification code sent by TSC via SMS: This code enables the Commission to ensure that it is the respective teacher filling the online form before it updates your profile. Enter the code in the window below and click ‘verify’. In an event you failed to receive the code, select ‘send code again’. The code is a four-digit number.

  • Proceed to edit your application. The following basic details will be required. Most details have been pre-loaded for you. Click ‘Next’ once done. You will see the success message ‘Your basic details have been updated, proceed to upload other documents’.

  • In the new window (see image below), you will update your Academic Qualifications Details. You will also be expected to upload a Minimum of 3 documents and a Maximum of 4. To update a document, click ‘choose file’. Locate the appropriate file in your storage and double click on it to upload it automatically. Click ‘save documents’ every time you upload a document. Repeat this process until you upload all the required documents.

Important Notes for Teachers (TSC Accepts only soft copy documents).

  1. All sections of this online form MUST be completed in full.
  2. Please fill in all the required information.
  3. It is a serious offence to willfully give false information to the Teachers Service Commission. The law provides that any person convicted of the offence may be fined up to Ksh 100,000 or imprisoned for Twelve (12) months or both (Section 44 of TSC Act No. 20 of 2012).
  4. You can save part of this form and complete it on a later time if necessary.
  5. Scan and Upload Only the  Required Documents:
  • Only certified copies of original documents should be scanned and uploaded.
  • For Expatriate Teachers, attach a letter of clearance from Ministry of Education Vetting Committee.

The Teachers Service Commission, TSC, has effected the December 2019 delocalization exercise for school heads. The handing/ taking over exercise for the administrators is expected to be completed before schools open for first tern on January 6, 2020.

Those moved are heads and principals and their deputies serving in their home counties and those who have served in the same station for a long period. Also on the move are new administrators who were appointed after the just concluded interviews .

Teachers with medical conditions have been spared from the ongoing delocalization exercise. Also spared are teachers aged above 56 years and those set to retire.

The Commission kicked off the delocalization exercise in January, 2018. Other massive deployments would then follow in April, August and December of the same year. Though in April, 2019 the Commission slowed down the transfers as only a handful administrators were moved.

GUIDELINES ON MANAGEMENT OF PAYROLL CHECK-OFF FACILITY

 

1.        INTRODUCTION.

 

  • The Teachers Service Commission (“the Commission”) is established under Article 237 (1) of the Article 237 (2) of the Constitution mandates the Commission to: register trained teachers; recruit and employ registered teachers; and assign teachers under its employment to serve in public schools/institutions. The operations of the Commission are further guided by the Provisions of the Teachers Service Commission Act No. 20 of 2012 (“the Act”).

 

  • Under the Act, the Commission is further empowered to formulate policies to achieve its mandate; provide strategic direction, leadership and oversight to the secretariat; manage the payroll of its employees; and do all other things as may be necessary for the effective discharge of its functions and the exercise of its

 

  • Similarly, the Employment Act and the Labour Relations Act requires the Commission as an employer to uphold and promote good industrial relations with its employees and other stakeholders so as to promote sound Labour

 

  • The Commission in 2014 developed guidelines to aid in the management of payroll check-off These guidelines have been in use for 6 years and there is a need to be review them to address emerging issues. The review has also been necessitated by the newly developed T-Pay platform currently being used by the Commission in management of Third Party check off facility.

 

2.        DEFINITIONS OF TERMS

 

  • These Guidelines may be cited as the “Teachers’ Service Commission Guidelines on Management of the Payroll Check-Off ”
  • In these Guidelines: –

 

“ability” means having the financial means of at least one-third 1/3 of the basic salary drawn by an employee or such limit or criteria as may be set by the Government from time to time to accommodate a deduction.

“applicable law” means any law, rule or regulation having the force of law that guides the check-off facility.

 

“by-product” refers a report of a transaction or a series of transactions containing a report/ data extracted from the payroll.

“check-off system” refers to a payroll facility that an employer uses to deduct a portion of an employee’s salary/remuneration to effect statutory and voluntary deductions.

Commission” means the Teachers Service Commission. “employer” means the Teachers Service Commission.

contact person” means a person designated by the organizations/institutions to manage the check-off facility.

“data” means information required to effect the deductions on the check off facility.

deduction code” means a unique identity issued by Government to authorize the holder to use the check-off facility in the Government payroll.

deduction code holder” means a firm or institution holding or authorized or issued with a code by the government to use on the payroll check off facility.

“employee” means a person who for the time being is in the employment of Teachers Service Commission.

“guarantor” means an employee who assumes financial responsibility of another in the event of default or failure on the part of the employee to meet his/ her financial obligations.

one third (1/3) rule” means the net amount an employee must retain after all deductions have been made.

data schedule” means the format in which the 3rd party’s data or information for check-off is submitted.

memorandum of understanding” is the instrument signed between the Commission and the 3rd party on the management of check-off services.

“major complaint” means complaints where fraud is seen, or the issues in question is weighty, complex and requires a detailed analysis and consideration.

 

statutory obligations” means deductions due to the Government pursuant to the operation of the laws and shall include deductions accruing on account of a court order or fulfillment of any obligation under the law.

stop order” means instructions issued by the 3rd party or the employee and duly considered by the Commission to stop a specific deduction on the payroll.

“3rd party” means a company or firm or organization or any entity who is a deduction code holder and has met the requirements set by the Commission for accessing the check-off facility.

“voluntary deductions” means any deductions of salary under the written authority of the employee.

discharged liability’’ means where a party to an agreement has paid or has cleared the amount due in the agreement.

trade union dues” means monthly subscriptions paid by a duly registered member of a union as a condition of membership.

confidential information” means all information, data and documents including but not limited to financial status, passwords, personal information, and processes concerning all parties.

3.        RATIONALE

  • In undertaking its mandate to manage its payroll, the Commission has experienced the following challenges with regard to the third Party

 

  • Consistent and numerous complaints from employees regarding irregular and unauthorized deduction of their salaries towards 3rd Party
  • The use of fictitious, forged, erroneous and inaccurate documents by 3rd Parties allegedly from employees for

 

 

  • Failure by Third Party firms to undertake due diligence and physically verify teacher’s identity through Heads of Institutions, thereby giving out loans to impersonators/fraudsters.

 

  • Emerging of online/mobile loans issued by Third Party firms without signed contractual
  • Negligence/ignorance of employees to safeguard T-Pay system passwords which exposes them to fraudsters.
  • Failure of employees to read through and understand loan contracts/agreements with Third Party firms thereby complaining later that they were
  • Delay/failure by Third Party firms to stop deductions where an employee has discharged

 

  • The above challenges have impacted negatively on integrity of payroll data and have strained the Commission’s resources in the overall administration of 3rd Parties deductions. These inherent challenges have compelled the Commission to review these Guidelines to ensure efficient and effective management of the third party

 

  • The Guidelines shall provide administrative procedures to guide the check-off facility

 

4.        OBJECTIVES

 

The overall objective of the Guidelines is to provide regulations on the management of Teachers Service Commission payroll check-off facility.

5.        PURPOSE

 

  • To streamline and regulate the management of the Teachers Service Commission (TSC) payroll check- off
  • To establish standard guidelines for managing the facility and mechanisms for enforcing compliance with stipulated Guidelines relating to the payroll check-off
  • To protect TSC employees from exploitation by 3rd

 

 

6.        APPLICATION

These Guidelines shall apply to all 3rdparties who are transacting on the Commission’s Check off facility. They shall take effect with effect from 1st April, 2021.

 

7.        ESTABLISHMENT OF 3rd PARTY MANAGEMENT COMMITTEE

 

  • The Commission shall establish a Committee known as Third Party Management Committee, hereinafter referred to as the committee, comprising of the following members:-

 

  • The Director Human Resource Management and Development who shall be the Chairperson;
  • The head of IPPD Division who shall be the secretary to the Committee;
  • The Director ICT or a representative;
  • The Director Finance and Accounts or a representative;
  • The Director Legal, Labour and Industrial Relations or a representative;
  • The Head of Risk Management Division or a Representative;
  • The Head of Integrity Division
  • The Head of Corporate Communications
  • One officer designated to the Committee by the Director HRM & D

 

  • The quorum of the committee shall be five
  • Sittings of the committee shall be held at the Commission’s headquarters at any time as the need may arise and proceedings of such meetings shall be
  • The Committee shall regulate its own

 

  • The Terms of Reference of the Committee shall be as follows:-

 

  • To receive all applications from prospective third parties;

 

  • To vet all applications received from third parties as per the Third Party Guidelines and other criteria as may be issued by the Commission;
  • To maintain proper records and documentation for each third party;
  • Ensure each third party admitted into the check of system executes a con- tract with the Commission;
  • To evaluate and prepare a report of performance of third parties
  • To sanction and terminate contracts with third parties
  • To receive and forward complaints from employees to Audit Directorate
  • Put in place internal control systems to prevent fraudulent activities on the check off facility;
  • Receive Investigation Reports from Audit Directorate and act on recom- mendations thereon;
  • To act on major complaints and communication the same to the third par- ties;
  • Ensure that the provisions of the third Party Guidelines and contractual agreements are implemented;

 

  • The Committee shall present quarterly reports to management detailing among others:

 

  • Any fraudulent activities reported during the quarter and actions taken by the Committee;

 

  • The status of the check off facility system including challenges, success, and

 

8.        ADMISSION TO THE TSC CHECK OFF FACILITY

 

  • An entity that desires to be admitted to the check of facility must meet the follow- ing mandatory

 

  • Income Tax (PIN) Certificate;
  • Tax Compliance Certificate from Kenya Revenue Authority;
  • Certificate of Incorporation or Registration;
  • Deduction Code Holder Authorization Letter from DPSM;
  • Trading Licenses issued by relevant Government Agencies;
  • By Laws for SACCOs and Affiliated Social Welfare Associations;
  • Letter of confirmation from Regulatory Authority of the firm;

 

  • In addition to the above, for a third party to be admitted in the Commission’s check off system it must:-

 

  • Have been in operation in the Republic of Kenya for a period of at least five (5) years;
  • Provide certified audited accounts or latest financial statements;
  • Provide a letter of Recommendation from its Regulatory Authority;
  • Provide a list of at least three (3) government institutions where it has been granted a check off facility system;
  • Provide evidence of presence and branch network in at least fifteen (15) Counties except for region based cooperative

 

  • All third parties admitted into the Check off Facility shall execute an agreement setting out the terms and conditions of Such terms shall include but not limited to:-

 

  • Obligations of the parties (Third parties and TSC);

 

  • Period of engagement and renewal clauses; (Renewal should be after every five (5) years subject to positive performance report developed by the com- mittee;
  • conditions of engagement;
  • Termination clauses;
  • Review clause
  • Fees payable;

 

 

9.        ONLINE T-PAY (TEACHERS-PAY) SYSTEM

  • The Commission developed the online T-Pay application platform for employees and Third-party firms to transact check-off deductions. The application has enhanced efficiency in management of Third Party check of

 

  • The System further seeks to:-

 

  • Enforce the one third rule as per the provisions of Employment Act (2007).
  • Minimize fraudulent transactions through inbuilt controls;
  • Empower employees to have control over Third Party deductions against their salary;
  • Enable Third Party firms manage their data, minimize data entry errors and enhance accountability on deductions against an employee’s salary;
  • Have Real time data capture hence a reduction on transaction turnaround time;
  • Reduce operational

 

  • The users of online T-Pay application are the employees, the employer and the Third-Party

 

  • The obligation of the Employee shall include:-

 

  • To initiate all transactions with the preferred Third Party firm, by sending his/her pay slip
  • To complete the process by approving the captured transactions to be deducted against his/her salary before they are loaded on
  • To take responsibility and safeguard their online T-Pay system
  • To provide authentic documents when seeking check-off
  • To read and understand the contract terms and conditions before signing the legally binding contract/agreement with the Third-Party
  • To notify the Commission in writing when joining or withdrawing from a third party.

 

  • The obligation of the Third-Party firm shall include to:-

 

  • Obtain legitimate authority from employees before transacting any facility in the T-Pay system;
  • Capture, adjust and stop all deductions online for the respective employee as per the signed legally bidding agreement/contract between the employee and the
  • To upload a soft copy of the contractual agreement at the point of uploading the loan at the T-PAY system
  • Safeguard employee’s data and confidential information that it has been entrusted with and use it for only the intended purpose as per the Data Protection Act,
  • Be held accountable for integrity of data captured on the T-pay
  • Submit accurate data to the Commission to facilitate 3rd party deductions;
  • Reconcile its deduction requests against the by-products to avoid duplication or double deduction of the same transaction;
  • Undertake due diligence to ensure that the documents and data submitted are valid and accurate to facilitate the deductions;

 

  • Return/refund the erroneous or irregular remittances to the Commission upon demand or upon detection of the irregularity;
  • Stop deductions for a discharged liability not later than three (3) days from the date of such clearance by the employee;
  • Adhere to the Provisions of the Third-party

 

 

                    The obligation of the Commission shall be to:-

  • Extract all approved data on T-Pay application, verify the same and upload on the payroll;
  • Receive complaints from employees and forward them to human resource management and development directorate for
  • Stop any unauthorized deduction and inform the relevant third party of the complaint and stoppage of
  • Blacklist and deregister any third party firm and/or entity who has been established to be involved in fraudulent deductions in the T-pay system in accordance with the provisions of the
  • Reduce from the 3rd party’s subsequent monthly remittances any fictitious, inaccurate or irregular deduction erroneously effected on an employee’s salary whether caused by the 3rd party’s negligence or otherwise and refunded to the affected employee;

 

  • The Commission reserves the right to verify and confirm the authenticity and accuracy of any data submitted by 3rd parties before the same is affected on

 

10.    ONE THIRD (1/3) RULE

  • The Commission shall only effect deductions (both statutory and voluntary) up to a maximum of two thirds (2/3) of an employee’s basic salary through the check- off

 

  • It shall be the responsibility of the 3rd parties to ensure that the proposed deduction(s) from individual employees meet the one third (1/3) requirement as

 

provided for under the Employment Act (2007) and to confirm the ability of the employee to meet his/her obligation.

 

11.    TRADE UNION DUES AND AGENCY FEE

  • A trade union which has signed a recognition agreement with the Commission as required by law shall have its dues deducted in accordance with Part VI of the Labour Relations Act 14 of 2007 from the salaries of its members who have voluntarily joined, signed and submitted a prescribed membership form and authorized union dues to be deducted at source by the Commission
  • The Commission shall deduct and pay to a trade union an agency fee from the salary of each union sable employee, who is not a member of the union, but who has benefited from a Collective Agreement negotiated and concluded between the union and the Commission in accordance with Part VI of the Labour Relations Act 14 of 2007

 

12.    STOP ORDER

  • It shall be the responsibility of a Third Party to stop deductions of an employee who has discharged his/her liabilities with the
  • A third party shall stop deductions for a discharged liability not later than three

(3) days from the date of such clearance by the employee.

 

  • In the event that a third party fails to stop a deduction as provided in sub clause

12.1 above, the Commission, upon receipt of authenticated instructions from the employee, shall stop the deduction without reference to the third party.

  • In the event a stop order that is not effected and an over payment is made to the third party, the same shall be recovered from the third party’s subsequent remittance and refunded to the employee.
  • An employee may discontinue voluntary payroll deductions by providing a written notification to the Third-Party firm. For the purposes of this sub-section, voluntary contribution shall not include the un-discharged liabilities of the
  • The Commission reserves the right to stop any deduction regardless of whether the third party has issued a stop order or not.

 

 

13.                   ACTION AGAINST DEFAULTERS

  • A third party shall exhaust all avenues within its means, including legal action against a
  • A third party shall notify any Guarantor in writing of the intention to recover the defaulted loan/credit facility.
  • It shall be an act of misconduct on the part of an employee who willingly or knowingly fails to meet obligations in respect of un-discharged liabilities and the Commission shall exercise disciplinary action against such an employee as per existing regulations.

 

14.                   ADMISSION TO THE CHECK-OFF FACILITY

 

  • A third party shall seek authority from the Commission to use the TSC check- off facility through formal application by filling the prescribed Application Form (annexed as second schedule) and paying the admission fee at rates that will be determined by the Commission from time to time

  • The successful third party will be required to pay Admission fee within 30 days, failure to which the application becomes null and
  • The Commission shall reserve the right to admit a third party into its payroll check-off facility through the T-Pay

 

15.             RENEWAL OF ADMISSION TO THE CHECK-OFF FACILITY

  • An existing Third Party shall every five (5) years after admission into the system seek renewal of admission from the Commission to continue accessing the check-off
  • The Third Party shall follow the application procedure for Authorization of check-off facility as outlined in clause (14) of these Guidelines/
  • The Applicant shall pay a renewal fee at the rate determined by the Commission from time to
  • Failure to apply for re-admission within 3 months prior to the expiry of the subsisting access to check off facility, will result into the Commission barring the Third Party from submitting any fresh deduction requests, provided that the existing deductions shall continue to subsist to full term, thereafter the Third Party shall stand deactivated from the TSC check-off facility through the T-Pay
  • Upon approval of the new guidelines all the existing Third Party firms are expected to apply for renewal of admission within thirty (30) days, failure to which they will be barred from undertaking any transactions with the Commission as outlined in subsection 15 .4
  • The Commission shall reserve the right to re-admit a Third Party into the Check off

 

16.             SERVICE CHARGE

 

  • A third party shall pay a service charge for processing of deductions, data, information, reports, and/or any other service provided by the Commission;
  • The Third party shall fully absorb the service charge cost without passing it to the employee;
  • The applicable rates for service charge shall be as indicated under the schedule 3 and shall take effect from the date of these guidelines;
  • Service charge shall be reduced from the remittances of the third party at the end of every month;

 

  • These rates shall be determined by the Commission from time to

 

 

17.             TERMINATION OF THE CHECK-OFF FACILITY

 

  • Check-off facility shall be terminated by the Commission in any of the following circumstances: –
    • Failure by the third party to comply with the statutory provisions as well as any Government Regulations and rules relating to third party
    • In the event that any applicable rules and regulations makes a deduction illegal or not permissible from an employee’s
    • In the event the third party becomes bankrupt or is de-registered under the
    • If the third party engages in any practice deemed by the Commission to be fraudulent or illegal on the part of the third
    • For purposes of this section, the Commission shall give or issue fourteen

(14) days notice of its intention to terminate the relationship with the third party.

  • In the event a third party is refused, barred, suspended or terminated from the use of the check-off facility by the Commission, the third party may appeal in writing, to the Commission for a review of the decision within twenty-one (21)

18.             CONTACT PERSONS

  • A third party shall designate contact person(s) to manage check-off facility matters as shall be provided for in the application
  • The Commission shall designate officer(s) to manage the third party matters relating to the check-off facility. All correspondence on matters relating to third party deductions shall be addressed to the Secretary/Chief

 

19.                   GENERAL PROVISIONS

  • All third parties and employees shall be subject to these Guidelines and any other regulations which may be developed from time to time in respect of the check-off facility through the T-Pay
  • Failure by any party to ensure integrity and accuracy of data provided for purposes of the check-off services will be subjected to sanctions stipulated in these
  • An employee who engages or encourages or perpetuates any fraudulent practices in respect of the check off facility shall be subject to the disciplinary proceedings as per existing regulations;
  • In the event that an existing Third Party fails to meet the requirements as stipulated in these Guidelines, such a Third Party shall be barred from submitting any fresh deduction requests, provided that the existing deductions shall continue to subsist to full term, thereafter the Third Party shall stand deactivated from the TSC check-off facility through the T-Pay
  • Offences with regard to Third Party deductions shall include offences prescribed in the first schedule or any other relevant
  • The Commission, upon establishing a breach of these regulations, may take any or a combination of the following sanctions against the defaulting party: –
    • Warning in

 

  • Instituting disciplinary process on the

 

  • Suspension of the Third Party from the use of the Check-off Facility through the T-Pay application
  • Barring the Third party from using the Check-off Facility through the T-Pay

 

FIRST SCHEDULE OFFENCES AND ACTS OF MISCONDUCT

For the purpose of these regulations, the following will constitute offences and acts of misconduct in the management of the Check- off Facility.

  1. Submission through T-Pay of inaccurate or misleading data by the Third

 

  1. Submission of forged documents by the 3rd party and the employee to access check – off
  2. Violation of the one third (1/3) statutory requirement by the

 

  1. Failure on the part of the 3rd party to stop deduction in respect of a discharged liability within the stipulated
  2. Failure on the part of the 3rd party to notify a guarantor in writing of intention to recover the defaulted loan/credit
  3. Willingly or knowingly failing on the part of the employee to meet obligations in respect to un-discharged
  4. Any act or omission on the part of the 3rd party or employee, which in the opinion of the Commission contravenes these guidelines or any other written
  5. Unauthorized access to an employee’s T-Pay

(i)                  Consideration for approval of the Application will be based on information provided in this form.

(ii)              Please attach the following documents dully certified by a Commissioner of Oaths/ Notaries Public: –

Mandatory Requirements

1.        Income Tax (PIN) Certificate;

2.        Tax Compliance Certificate from Kenya Revenue Authority;

3.        Certificate of Incorporation or Registration;

4.        Deduction Code Holder Authorization Letter from DPSM;

5.        Trading Licenses issued by relevant Government Agencies;

6.        By Laws for SACCOs and Affiliated Social Welfare Associations;

7.        Letter of confirmation from Regulatory Authority of the firm;

8.        IFMIS Number

 

In addition to the above, for a third party to be admitted in the Commission’s check off system it must:-

1.        Have been in operation in the Republic of Kenya for a period of at

least 3 years;

 

2.        Provide certified audited accounts or financial statements for at least three (3) years;

3.        Provide a letter of Recommendation from its Regulatory Authority;

4.        Provide a list of at least three () government institutions where it has been granted a check off facility system;

5.        Provide evidence of presence and branch network in at least 15 Coun- ties except for region based cooperative societies;

For Trade Unions

1.        Registration Certificate as a Trade Union.

2.        Order from the Cabinet Secretary for Labour instructing the Commission to commence deductions

3.        A copy of the Registered Recognition Agreement with the Commission.

  • That the Third Party shall act dutifully and undertakes to take full responsibility of the T-Pay Password(s) given and to further use it responsibly and for the intended purpose only during the
  • The Third Party shall comply with all laws, guidelines and regulations affecting the subject matter of this agreement, and in particular abide by the rules, requirements and procedures set out in the Guidelines on Management of Payroll Check-off Facility.

 

  • That the Third Party shall not be entitled to assign or transfer any of its rights or duties herein to any person without the prior written approval of the Commission

(3)     COMMISSION’S OBLIGATIONS

 

(7) That the Commission shall without undue delay train the Third Party on the usage and operations of the T-Pay Application upon successful admission to the Check-off facility.

(4)     CONFIDENTIALITY

 

  • Any confidential information relating to the Commission and the employees made available to the Third Party will not be disclosed to any unauthorized persons and/or used by the Third Party or any of its employees without prior consent from the

Teachers and Police Officers Suffering in Silence as hospitals deny them Medical Services

Teachers and law enforcement officers are enduring hardships in silence as a crisis affects their medical insurance plans.

The well-being of over one million educators, police personnel, and their dependents is jeopardized as hospitals refuse to provide services due to delayed payments.

For the past seven months, medical facilities have not received payments from state-sponsored health insurance schemes, forcing some of them to refuse treatment to patients who are unable to pay out of pocket.

The hospitals contracted are owed Sh11 billion for the medical coverage for teachers, resulting in 403,522 educators and 969,638 dependents experiencing difficulties.

Likewise, the medical schemes for more than 110,000 police officers and their dependents under the National Police Service (NPS) and Kenya Prisons Service are non-functional.

At least six hospitals have halted services for teachers covered under the Teachers Service Commission (TSC) medical scheme. A notification from Tenwek Hospital in Bomet County, for instance, indicated that it ceased providing medical services on credit as of February 1. Other hospitals affected include Kisii Referral Hospital and Reale Hospital in Uasin Gishu County.

Hospitals attribute the predicament to non-payments by the now-defunct National Hospital Insurance Fund, its successor Social Health Authority, and Medical Administrators Kenya Limited, which manages the teachers’ medical plan through Minet Kenya.

Some educators have reported that certain facilities are refusing them treatment despite not issuing official notifications. According to the contract, hospitals are required to provide a seven-day notice prior to suspending services.

Minet oversees around 600 medical providers nationwide, but more hospitals may take similar actions if the situation is not remedied.

On Tuesday, Minet Kenya Chief Executive Officer, Sammy Muthui, stated they are collaborating with the government to ensure the outstanding balance is addressed.

“It is a matter impacting all sectors due to financial flow issues in the country. There is a significant outstanding balance, but some promising progress has been made by TSC in discussions to settle the debt,” he remarked.

In a similar vein, police officers under APA Insurance, which assumed control of their medical scheme from CIC Insurance in April of last year, have reported deteriorating conditions.

“I manage a chronic illness that requires regular check-ups. The last visit to Nairobi West resulted in being told to wait an additional two weeks for my next consultation. How can you ask a sick person to wait 14 days? Does sickness wait? ” expressed an officer who wished to remain anonymous.

The situation is even graver for officers stationed in remote locations. “My wife was ill and needed to be taken to a hospital, but the insurance provider denied approval for treatment. I was hundreds of kilometers away, unable to assist, and they had to pay out of their own pockets,” recounted an officer posted in Lamu.

Both the Kenya National Union of Teachers and the Kenya Union of Post Primary Education Teachers have cautioned that this crisis might disrupt educational processes.

“What is transpiring in the teaching profession is unacceptable. We demand immediate action from Treasury Cabinet Secretary John Mbadi to address this crisis,” stated Moses Nthurima, the acting secretary general of the union.
Knut Secretary-General Collins Oyuu expressed that the situation was stripping teachers of their dignity, pointing out that those with chronic illnesses were the most impacted.

“We will not remain passive while our teachers endure suffering. It is essential to have a detailed plan from the government on how it intends to settle the outstanding balances with hospitals and also to engage in discussions with the hospitals so that teachers receive the services they rightfully deserve,” he remarked.

For police officers, the frustrations have escalated to a critical point, resulting in concerns about a possible go-slow.

A video that spread widely online last week showed a heated argument between a junior officer and a senior officer during a meeting aimed at addressing the insurance issue.

The junior officer accused the administration of neglecting their struggles, emphasizing the case of a colleague whose wife was refused treatment while he was on duty.

His peers in the room seemed to cheer in support, a rare instance of open defiance within the disciplined forces.

Despite numerous complaints, police officers claim they receive only vague promises that “the issue is being addressed. ”

Many are now advocating for the elimination of third-party brokers from the medical coverage system, asserting that direct relationships between hospitals and insurers functioned more effectively.

The teachers’ medical scheme, established in 2015, replaced a direct medical allowance that had previously been given to teachers.
Teachers and their dependents have rights to outpatient, inpatient, maternity, dental, optical, psychiatric, and counseling services, along with air and road evacuation, funeral benefits, international referrals, and travel allowances.

However, as a result of the government’s failure to make payments, hospitals have refused to provide these services, leaving teachers in a difficult position.

The teachers’ unions and police are insisting on prompt action from the Treasury, cautioning that further delays could lead to severe consequences.

“Teachers’ health is crucial. Delaying their access to healthcare infringes on their right to healthcare and undermines the right to human dignity. A sick teacher cannot be effective in the classroom,” stated Nthurima.

Teachers still suffering.

Teachers in Kenya are encountering major difficulties in obtaining medical care due to problems with their health insurance coverage.

Those who depend on the medical insurance plan provided by the Teachers Service Commission (TSC) have reported that private hospitals are no longer accepting their insurance.

Consequently, many teachers are turning to pharmacies for medical help or paying for healthcare out of their own pockets, leading to both financial and emotional stress for those impacted.

The medical insurance program for teachers is generally funded and overseen by the Teachers Service Commission (TSC), which is responsible for hiring, training, and managing teachers in Kenya.

This situation is causing significant distress among teachers, who now have to either shoulder the financial burden of medical expenses or experience delays in receiving essential care.

Some teachers have mentioned that even basic medical check-ups or consultations have become challenging to access.

Merry X-mas message to teachers, Staff by the TSC boss

The Teachers Service Commission, TSC, boss (Dr. Nancy Macharia) has wished teachers and staff a merry X-Mas and Happy new year. In a note sent to the media, Dr. Nancy says:

There has always been a, perceived, frosty relationship between teachers and their employer, TSC, with teachers blaming the TSC of high handedness when it comes to matters policy and disciplining of teachers. Teachers feel the employer acts harshly when unleashing disciplinary action on them.

Last week, the TSC boss announced that a total of 62 teachers were facing disciplinary action for involvement in alleged exam malpractices; during the administration process of the 2018 Kenya Certificate of Secondary Education (KCSE) exams.

The Teachers Service Commission, TSC, has released merit lists for the teachers shortlisted for the recruitment process.

The shortlisted applicants for all secondary and primary school teaching vacancies are included on the lists.

The Teachers Service Commission Recruitment Guidelines 2022 shall Apply.

According to the Commission, all teachers who are hired will serve under permanent and pensionable employment terms

“Interested and qualified candidates should submit their applications online through the Teachers Service Commission’s website, www.tsc.go.ke under ‘Careers or teachersonline.tsc.go.ke not later than 7 July, 2022,” the Commission said.

In the breakdown, 5,000 teaching positions will assist the government’s policy on achieving a 100 percent transition of students from primary to secondary schools and the current teacher shortage.

Of the 5, 000 vacancies, 3, 972 will be filled by recruits for secondary schools, 28 for teacher training colleges, and 1,000 positions are set aside for primary school teachers.

“The list of shortlisted candidates, interview dates and venues will be published on the Teachers Service Commission website by July 15, 2022,” the Commission said.

The Commission has also declared 8, 230 vacancies to replace teachers who exited service through attrition. 6, 539 posts will be for primary and 1, 691 posts for secondary schools.

Proposed legislation will provide teachers with new allowances.

If the Teachers Service Commission (TSC) Amendment Bill, 2024, is approved by Parliament, Kenyan teachers may soon be eligible for a number of additional allowances. To address the financial well-being of educators, the bill, which was sponsored by Mandera South MP Abdul Haro, proposes nine distinct allowances that are suited to the different jobs and issues in the field.

The suggested benefits include a housing allowance for all instructors, which will be maintained for those subject to interdiction until their cases are decided. Commuter allowances are also suggested, but instructors who are subject to interdiction or suspension would not be eligible.

Furthermore, a hardship allowance is set aside for instructors who teach in specified hardship districts, like some regions of Turkana, Garissa, and Baringo counties.

Special duty allowances would be given to teachers who take on administrative responsibilities outside of their grade or who work in dry or semi-arid regions. A responsibility allowance, which becomes pensionable if earned right before retirement, would be granted to heads of institutions, deputy heads, and senior teachers in job group ‘K’ and below.

In addition, instructors with expertise in special education who are assigned to specialized schools or units would be eligible for a special school allowance.

Additional proposed allowances, authorized by the National Council of Persons with Disabilities, include a reader’s facilitation or aid allowance for instructors with impairments.

Additionally, the bill includes a transfer allowance for instructors relocated by the TSC and an annual leave allotment. In order to guarantee fair compensation throughout the board, these actions attempt to acknowledge the varied responsibilities and difficulties that teachers experience.

Since 2003 when the law requiring Public Officers to declare their Income, Assets and Liabilities (IAL) was enacted, the mode of declaration has been manual. With regard to the declaration, the Commission wishes to communicate the following information.

I. MODE OF DECLARATION.

In order to enhance efficiency, the Commission has introduced an online
declaration portal to be used in the declaration period. In this regard,
all teachers are expected to fill an online Declaration by the set deadline; following steps outlined in the Wealth Declaration Instruction Manual.

II. ACCESSING ONLINE PORTAL

The Declaration Form can be filled and submitted by accessing the Teachers Online Portal through; https://tsconline.tsc.go.ke/site/index. Please note that you can access this information using a smart phone

This can be downloaded from the TSC website; www.tsc.go.ke under downloads, immediately next to the Declaration link.
Otherwise one can complete the Declaration process by following the prompts in the form after logging in.

IV MONITORING OF THE DECLARATION

All Heads of Institution are required to monitor the declaration progress in their respective institutions and report on non-Compliance as reflected in line with the
provision in Part B in the Wealth Declaration Instruction Manual.

V ADDITIONAL INFORMATION

(a) All teachers in employment of TSC are required to declare their Income, Assets and Liabilities. These include teachers on:
1). Any kind of leave
2). Interdiction
3). Suspension
4). Sick leave

(b) Any teacher in the TSC employment who fails to submit a declaration or gives
false or misleading information is liable to a fine of Kshs 1,000,000 or be imprisoned for a term not exceeding one year or both upon conviction.
(c) It is mandatory for all teachers to have a working email address which will be vital for setting, accessing and resetting individual passwords for the Declaration as applicable.
A copy of the submitted Declaration is automatically be sent to one’s email account.
(d) All sections of the declaration must be completed. Incomplete Declaration Forms
will be rejected.

TSC POLICY ON APPOINTMENT AND DEPLOYMENT OF INSTITUTIONAL ADMINISTRATORS

Read through this document to find the latest criteria used by the Teachers Service Commission (TSC) in appointing school administrators plus requirements for such appointments. Most importantly, check the tables towards the bottom of the article.

FOREWORD

Article 237 of the Kenya Constitution establishes the Teachers Service Commission as a constitutional Commission with the mandate to appoint, promote, transfer and deploy teachers to public learning institutions among others functions.

Further, the Act empowers the Commission to ensure compliance with the teaching standards; facilitate career progression and professional development of teachers; and to monitor the conduct and performance in the teaching service.

Accordingly, in exercising its Constitutional and statutory mandate, the Commission has developed the Policy on “Appointment and Deployment of Institutional Administrators”.

The Policy is aimed at streamlining the identification process to ensure that prerequisite skills and competencies are considered in the appointment and deployment of administrators. It is also aimed at aligning the institutional administrators to their roles and responsibilities to ensure accountability.

Further, the policy provides a standard procedure for identification, selection, appointment and deployment of institutional administrators. It also provides management structures and requirements for appointments to various positions in the different categories of public primary, post primary and tertiary institutions,.

The formulation of this Policy is partly informed by the recommendations of the Job Evaluation Report which was undertaken by the Salaries and Remuneration Commission (SRC) in consultation with the Commission in November 2016.

The Job Evaluation determined the relative worth of jobs in the teaching service and set remuneration on the basis of job content, responsibilities, minimum qualifications, level of decision making required, accountability and working conditions.

The Policy has also underpinned the constitutional principles of fair competition and merit, integrity, transparency and accountability, equity, fairness and impartiality, inclusiveness and non discrimination, gender equity and regional balance in the appointment and deployment of institutional administrators.

This Policy resonates with the Commission’s reform agenda, particularly the enhancement of learning outcomes through strengthening the management of learning institutions.

PREFACE

The performance of any learning institution depends on the quality and capacity of the
administrators to organize, manage and optimally utilize the available resources in order to enhance delivery of teaching programmes.

In the implementation of this policy, the Commission will endeavor to match every position with qualifications, experience and performance of every appointee in order to continuously improve the quality of supervision, teaching and learning outcomes.

The Policy on Appointment and Deployment of Institutional Administrators provides for clear career progression structures to ensure systematic progression, growth and professional development for all teachers. It outlines the experience, academic and professional requirements necessary for appointment and deployment of institutional administrators and further sets the process for career advancement and succession management in institutions.

A teacher at primary school level can now advance from the lowest administrative grade of Senior Teacher II (T-Scale 7) and gradually progress to the position of Senior Head Teacher (T-Scale 11).

Similarly, a teacher in a Post-Primary Institution will enter administrative position as a
Senior Master III (T-Scale 10) and progress to the level of Chief Principal (T-Scale 15).

In implementing the policy, the Commission will seek to attract and retain some of the best available institutional managers through substantive appointments and commensurate remuneration. Teachers appointed as institutional administrators will be expected to provide leadership and mentorship in their respective positions in order to respond to the dynamic pedagogy necessitated by Competency Based Curriculum.

Moreover, the policy is anchored on the Commissions statutory responsibility in Section 4 of the TSC Act 2012 to, at all times act in the best interests of the learners.

1.0 INTRODUCTION AND BACKGROUND

The re-establishment of the TSC under the Constitution of Kenya (2010) through Article 237 redefined and expanded the Commission’s mandate to; register trained teachers; recruit and employ registered teachers; assign teachers employed by the commission for service in any public learning institutions; promote and transfer teachers and exercise disciplinary control over the teachers.

The Commission was also mandated to; review the standards of education and training of persons entering the teaching service; review the demand and supply of teachers and advise the national government on matters relating to the teaching profession. In addition, the Teachers Service Commission Act, 2012 was enacted with additional functions, which included the responsibility to monitor the conduct and performance of teachers and ensure they comply with the teaching standards.

Equally important, the Commission is required to facilitate career progression and professional development of teachers, including the appointment of head teachers and principals.

Accordingly, the Policy on Appointment and Deployment of Institutional Administrators has been reviewed in line with the broad Constitutional principles that guide appointments to public office and the values expected of public officers. The Policy will also be in tandem with the Job Evaluation Report (2016), which focused on the worth of every job in the teaching service.

1.1 Rationale

The Policy on Appointment and Deployment of Institutional Administrators seeks to harmonize the constitutional requirements, provisions of the Code of Regulations for Teachers (CORT) and recommendations of the Job Evaluation Report (2016).

This is aimed at providing standard operating procedures for the identification, selection, substantive appointment and deployment of Institutional Administrators with a view to realizing the values and Principles embodied in the Constitution, the Act and the Code of regulations for teachers.

2.0 POLICY STATEMENT

The Commission is committed to appointment and deployment of qualified institutional
Administrators in all public primary, post primary and tertiary institutions across the country.

Efforts will be made to ensure that teachers deployed in administrative positions are appointed on merit through well-defined criteria.

3.0 AUTHORITY

The Policy derives its authority from:

i. The Constitution of Kenya
ii. TSC Act (Cap 212) Laws of Kenya
iii. The Basic Education Act (Cap 211) Laws of Kenya
iv. Code of Regulations for Teachers (Revised 2015); and
v. The TSC Code of Conduct and Ethics (2015)

4.0 OBJECTIVES OF THE POLICY

4.1 General objective

To promote efficiency in the deployment of institutional administrators to all basic public primary, post primary and tertiary institutions in the country through a competitive selection and appointment

4.2 Specific objectives

The Specific objectives of this policy are to;

i. Create an implementation framework for the appointment and deployment of institutional administrators in the teaching service
ii. Set out the academic and professional qualifications and other requirements necessary for selection and deployment of institutional administrators
iii. Provide standards to ensure that institutional administrative positions are competitively filled
iv. Facilitate succession management in institutional administration

5.0 GUIDING PRINCIPLES

Article 10 of the Constitution establishes the National Values and Principles of Governance that guide every state organ when making or implementing policy decisions.

Similarly,  Article 232 of the Constitution sets out the Values and Principles of Public Service, which bind all state organs. Accordingly, the Commission has adopted the following values and principles to guide in the implementation of this Policy.

6.0 SCOPE

The Policy shall apply to all teachers in the employment of the Commission. It provides for identification, selection, appointment, deployment and performance of institutional administrators.

7.0 POLICY GUIDELINES

7.1 Overriding powers of the Commission

Nothing in this Policy will be construed to limit, diminish, extinguish or in any other way curtail the Constitutional and statutory powers granted to the Commission to transfer, deploy or assign an administrator to a public learning institution as it deems appropriate.

Specifically, and notwithstanding any other provision in this policy, the Commission reserves the right to transfer an administrator from one institution to another regardless of the number of years served in the station.

7.2 Performance of duty

i. In the execution of assigned duties, Institutional administrators shall be bound by the Constitution, TSC Act, the Code of Regulations for Teachers, the Code of Conduct and
Ethics for Teachers, relevant statutes, and all relevant administrative circulars issued by the Commission and other government agencies from time to time.

ii. The appointment, deployment and retention of administrators will be subject to the satisfactory performance of assigned duties.

iii. Each administrator shall be appraised with a view to evaluating and determining his or her performance levels in accordance with Regulation 52 of the Code. Any administrator who fails to meet their performance targets as provided in their performance contracting and/or appraisal instruments may have their services terminated following the due process encapsulated under the Code of regulations for teachers.

7.3 Identification and Selection Process

The following procedures shall apply in the identification and selection of institutional
administrators: –

i. Establishment of vacancies
ii. Development of guidelines where necessary
iii. Advertisement of vacancies and invitation of applications
iv. Short listing of applicants in accordance with this Policy and/or any other guidelines issued by the Commission
v. Conducting interviews for shortlisted applicants
vi. Selection of the candidates for appointment and deployment
vii. Communication of results to the interviewed applicants

7.4 Appointment and deployment of Heads of Post Primary Institution

The following considerations shall be made during the deployment of institutional
administrators:

i. Category of institution
ii. Size and level of enrolment
iii. Academic and professional qualifications
iv. Current grade
v. Relevant experience in the teaching service
vi. Gender balance
vii. Any other criteria the Commission may deem appropriate

7.5 Criteria for appointment and deployment of Heads of Post Primary Institution

The Commission shall:

i. Substantively appoint and deploy heads of institution to the institutions commensurate
to their grade;
ii. Ensure that heads of institution do not serve in their Home Counties
iii. Be guided by the teacher’s performance contract and/or annual appraisal reports
iv. Ensure that heads of institution do not serve in one station for a period exceeding nine (9) continuous years.

7.6 Requirements for Appointment as Head of Post- Primary Institution

To qualify for consideration as a head of a Post-Primary Institution, a teacher must;

i. Be a holder of Bachelor’s degree in Education or any other recognized equivalent qualification
ii. be a holder of a Master’s degree in a relevant area
iii. have demonstrated competence and ability both as a classroom teacher and as a deputy head or equivalent position in a post primary institution
iv. have served as deputy head or equivalent position in a post primary institution for a minimum period of three (3) years
v. have successfully undertaken the relevant Teacher Professional Development (TPD) Modules
vi. Meet the requirements of Chapter six (6) of the Constitution and any other requirement deemed necessary by the Commission.

7.7 Appointment and deployment of deputy heads of Post- Primary Institutions

In the appointment and deployment of Deputy Heads of Post-Primary Institutions, the Commission shall:

i. Substantively appoint and deploy teachers to institutions that commensurate to their grade,
ii. Ensure that teachers do not serve in their home counties and in one station for a period exceeding six (6) continuous years
iii. Consider their individual Annual Performance Appraisal reports

7.8 Requirements for appointment as deputy heads of Post Primary Institution

To qualify for consideration as a Deputy Head, a teacher must:

i. be holder of Bachelor’s degree in Education or any other recognized equivalent qualification;
ii. have demonstrated competence and ability both as a classroom teacher and as a Senior Master or equivalent position in a Post Primary Institution;
iii. have served as a Senior Master or equivalent position in a Post Primary Institution for a minimum period of three (3) years;
iv. have successfully undertaken the relevant Teacher Professional Development (TPD) Modules;
v. Meet the requirements of Chapter six (6) of the Constitution and any other requirement deemed necessary by the Commission.

7.9 Appointment and deployment of Dean/ Registrar of Tertiary Institutions

In the appointment and deployment of the Deans and Registrars of Tertiary Institutions, the Commission shall:

i. Substantively appoint and deploy teachers to institutions commensurate to their grades
ii. Ensure that they do not serve in their home counties and in one station for a period exceeding six (6) continuous years
iii. Consider their annual performance appraisal reports

7.10 Requirements for appointment as Dean/ Registrar of Tertiary Institutions

To qualify for consideration as a Dean or Registrar of a tertiary institution, a teacher must:

i. be a holder of Bachelor’s degree in Education or any other recognized equivalent qualification;
ii. have a Master’s Degree in a relevant area;
iii. have demonstrated competence and ability both as an assistant teacher and as a Senior Master or equivalent position in a post primary/tertiary Institution;
iv. have served as a Senior Master or equivalent position in a post primary/tertiary Institution for a minimum period of three (3) years
v. have successfully undertaken the relevant Teacher Professional Development (TPD) Modules;
vi. Meet the requirements of Chapter six (6) of the Constitution and any other requirement deemed necessary by the Commission.

7.11 Appointment and deployment of Senior Masters

In the appointment and deployment of Senior Masters, the Commission shall: –

i. Substantively appoint and deploy them to institutions commensurate to their grade;
ii. Consider their annual appraisal reports; and
iii. Ensure that they do not serve in one station for a period exceeding six (6) continuous years

7.12 Requirements for appointment as Senior Master

To qualify for consideration as a Senior Master, a teacher must:

i. be a holder of Bachelor’s degree in Education or any other recognized equivalent qualification
ii. have demonstrated competence and ability as a classroom teacher in a post primary/tertiary institution
iii. have served as a Secondary Teacher I or its equivalent in a post primary institution for a minimum period of three (3) years
iv. have successfully undertaken the relevant Teacher Professional Development (TPD) Modules
v. Meet the requirements of Chapter six (6) of the Constitution and any other requirement deemed necessary by the Commission.

7.13 Appointment and deployment of Head Teachers

In the appointment and deployment of head teachers, the Commission shall: –

i. Substantively appoint and deploy teachers to institutions that commensurate to their grades;
ii. Ensure that teachers do not serve in their home counties and serve in one station for a period exceeding nine (9) continuous years
iii. Consider their individual Performance Contract and/or Annual Appraisal reports

7.14 Requirements for appointment as Head Teacher

To qualify for appointment as a head teacher, a teacher must;

i. be a holder of Primary Teacher Education (PTE) Certificate
ii. be a holder of a Bachelor’s degree in Education or its equivalent;
iii. have served as a Deputy Head teacher for a minimum period of three (3) years;
iv. have demonstrated competence and ability as a classroom teacher in a primary institution;
v. have successfully undertaken the relevant Teacher Professional Development (TPD) Modules;
vi. Meet the requirements of Chapter six (6) of the Constitution and any other requirement Commission deems necessary

7.15 Appointment and deployment of Deputy Head Teachers

In the appointment and deployment of Deputy Head teachers, the Commission shall;

i. Substantively appoint and deploy them to institutions commensurate to their grades;
ii. Ensure that they do not serve in their home counties;
iii. Consider their individual annual performance appraisal reports
iv. Ensure that they do not serve in one station for a period exceeding six (6) continuous years.

7.16 Requirements for appointment as Deputy Head Teacher

To qualify for appointment as a deputy head teacher, a teacher must;

i. be a holder of a PTE Certificate
ii. be a holder of a Bachelor of Education Degree
iii. have served as a Senior Teacher for a minimum period three (3) years
iv. have demonstrated competence and ability as an assistant teacher in a primary institution
v. have successfully undertaken the relevant Teacher Professional Development (TPD) Modules
vi. Meet with the requirements of Chapter six (6) of the Constitution and any other requirement deemed necessary by the Commission.

7.17 Appointment and deployment of Senior Teachers

In appointing and deploying Senior Teachers, the Commission shall;

i. Substantively appoint and deploy them to institutions commensurate to their grade;
ii. Consider their individual annual appraisal reports; and
iii. Ensure that they do not serve in one station for a period exceeding six (6) continuous years.

7.18 Requirements for appointment as a Senior Teacher

To qualify for appointment as a Senior Teacher, a teacher must;

i. be a holder of a PTE Certificate
ii. have demonstrated competence and ability as a classroom teacher
iii. have served as Primary Teacher I for a minimum period of three (3) years
iv. have successfully undertaken the relevant TPD Modules
v. Meet the requirements of Chapter six of the Constitution.

7.19 Transition

i. All serving institutional administrators shall be substantively appointed and placed in institutions that commensurate to their grades upon full implementation of this Policy
ii. Serving institutional administrators who decline transfer or resign from administrative positions shall be exited from service
iii. An institutional administrator who is unable to perform their duties on the account of physical infirmity may be retired from service on medical grounds in accordance with the provisions of the Code of Regulations for Teachers
iv. Teachers who were converted to grades that are commensurate to administrative positions as at 1st July, 2017 will be deployed as such, subject to availability of vacancies and successfully undertaking suitability interviews.
v. All teachers, who were converted to grades that are commensurate to administrative positions will be deployed as such upon full implementation of this policy
vi. Any other matter relating to appointment and deployment of institutional administrators not specifically provided for under this Policy shall be addressed through administrative circulars issued by the Commission from time to time.

8.0 STAFFING LEVELS IN PRIMARY, SECONDARY & TERTIARY LEARNING INSTITUTIONS
