What Does the KUPPET Constitution Cover?

The constitution sets out the rules and procedures that guide the running of the Kenya Union of Post-Primary Education Teachers. It establishes the union’s governing structures and explains how decisions are made at national, regional and branch levels.

Its provisions cover several important areas, including:

  • KUPPET membership and subscription fees.
  • The union’s national and branch leadership structures.
  • Duties and responsibilities of elected officials.
  • National and branch elections.
  • Nomination fees for union positions.
  • Financial management and accountability.
  • Disciplinary procedures and appeals.
  • Industrial disputes and engagement with the employer.
  • Constitutional amendments and dissolution.

1. KUPPET Membership Requirements and Subscription Fees

The constitution provides for membership by teachers and trainers working in post-primary and tertiary institutions, subject to the professional qualification, licensing or authorisation requirements set out in the document.

The membership provisions include:

  • A one-time entry fee of KSh 50.
  • Monthly union subscriptions equivalent to 1.8 per cent of basic salary.
  • Collection of subscriptions through the check-off system where possible.

The constitution also provides for the retention of membership after retirement or resignation, subject to the applicable subscription requirements.

It recognises honorary and associate membership, although such members do not enjoy voting rights or eligibility to hold union office.

Members interested in the changes introduced in earlier versions can also read the final amended KUPPET Constitution 2024/2025.

2. KUPPET National Leadership and Governance Structure

The constitution establishes different organs responsible for the administration and governance of the union.

These include:

  1. Annual Delegates Conference (ADC).
  2. National Advisory Council (NAC).
  3. National Governing Council (NGC).
  4. National Executive Board (NEB).
  5. Regional Councils.
  6. Branch General Assembly (BGA).
  7. Branch General Council (BGC).
  8. Branch Executive Committee (BEC).
  9. Board of Trustees.
  10. School and institution representatives.

The Annual Delegates Conference is the union’s supreme authority. It provides a platform through which delegates deliberate on important union matters and exercise the powers assigned to the conference under the constitution.

The National Executive Board is responsible for the day-to-day running of the union, implementing policies, managing union affairs and handling negotiations with the employer.

3. The KUPPET National Executive Board and Elected Positions

The constitution provides for a 14-member National Executive Board comprising elected national officials.

The positions include the National Chairperson, National Vice Chairperson, Secretary General, Deputy Secretary General, National Treasurer, Assistant National Treasurer and other officials responsible for gender, organising, secondary, tertiary and junior secondary education matters.

The expanded leadership structure provides for additional assistant gender secretaries and an Assistant National Secretary for Junior Secondary.

The National Executive Board performs important responsibilities, including:

  • Managing the daily affairs of the union.
  • Implementing resolutions and policies.
  • Coordinating union activities.
  • Negotiating Collective Bargaining Agreements (CBAs).
  • Managing union finances and the secretariat.
  • Overseeing the implementation of decisions made by the union’s governing organs.

For more information, read this related report on KUPPET’s expanded leadership structure, including women and Junior Secondary representatives.

4. KUPPET’s Eight Administrative Regions

The constitution establishes eight regions to support union administration and representation across the country.

  1. Coast Region
  2. North Eastern Region
  3. Eastern Region
  4. Central Region
  5. Rift Valley Region
  6. Western Region
  7. Nyanza Region
  8. Nairobi Region

The regional structure provides an additional level of coordination between the national leadership and county branches. Regional Councils are expected to address union and teacher welfare matters within their respective areas.

5. KUPPET Elections and Terms of Office

The constitution provides for elections every five years. National officials are elected through a Special Delegates Conference, while branch officials are elected through Branch General Assemblies.

Elections are conducted by secret ballot and are subject to the eligibility and procedures provided in the constitution.

Some of the important election provisions include:

  • Union officials serve five-year terms and are eligible for re-election.
  • A member seeking a national position must qualify as a delegate.
  • A branch official contesting for a national position must resign from the branch position at least 31 days before the national elections.
  • Members whose subscription arrears exceed 13 weeks are not eligible to vote.
  • Government labour officers supervise the elections.
  • Branch elections are conducted before national elections.

The constitution also sets the retirement age for union officials at 65 years.

7. KUPPET Finances, Accounts and Gratuity

The constitution also provides rules on the management of union resources and financial accountability.

Among the provisions are:

  • Union financial accounts close on December 31 each year.
  • Audits are to be conducted by March 31.
  • A provision is made for 65 per cent of monthly membership dues to be remitted to branches, subject to the permitted variations.
  • Paid-up members may inspect certified union financial books in accordance with the constitution.
  • Audited accounts are to be made available through the union’s website.

The constitution further provides for a dedicated gratuity account funded through an allocation equivalent to 5 per cent of monthly union income. Eligible officials receive gratuity in accordance with the applicable by-laws.

8. KUPPET Disciplinary Procedures and Penalties

Article 21 addresses discipline within the union. It establishes a standing five-member disciplinary committee and outlines conduct that may attract disciplinary action.

The offences covered include misuse of union funds or property, negligence resulting in loss, bribery, soliciting favours, sexual harassment and economic crimes.

Depending on the circumstances and applicable procedures, disciplinary measures may include:

  • Caution.
  • Warning.
  • Surcharge or fine.
  • Suspension.
  • Expulsion.
  • Deregistration of a branch.
  • Judicial prosecution where applicable.

The constitution also provides for the right to be heard and an appeal process within 14 days.

9. KUPPET Rules on Industrial Disputes and Strikes

The constitution sets out procedures for handling industrial disputes and communicating workplace grievances.

Members are expected to report disputes through the relevant branch structures, beginning with the Branch Executive Committee.

It also provides that cessation of work should not take place without the sanction of the National Governing Council. A strike should not be called off without the required authorisation.

Improvement claims are to be channelled through the Branch Executive Secretary.

These provisions are particularly important when considering the union’s engagement with the Teachers Service Commission (TSC) over teachers’ working conditions, remuneration and other employment matters.

10. How Can the KUPPET Constitution Be Amended?

The constitution provides a procedure for making amendments to its provisions.

Amendments must be considered through the Annual Delegates Conference or Special Delegates Conference, as provided in the document. Adoption requires a two-thirds majority vote.

An amendment must also be registered by the Registrar of Trade Unions before it takes effect.

This requirement ensures that constitutional changes follow the prescribed union and registration procedures.

11. Why KUPPET Members Should Download and Read the Constitution

The constitution is an important reference document for members who want to understand their rights, responsibilities and role in the union.

It is particularly useful to:

  • Teachers who are registered KUPPET members.
  • Branch officials and national union leaders.
  • Members intending to contest union elections.
  • Delegates attending union conferences.
  • Teachers interested in union governance and administration.
  • Members seeking clarification on disciplinary and financial procedures.

Reading the document enables members to understand the rules governing union leadership, representation, elections and decision-making.
