TSC Teacher discipline process; Interdiction, investigations, case and dismissal details

Teacher interdiction and dismissal is real in Kenya! A number of teachers are disciplined by the Teachers Service Commission (TSC) for committing a number of offences that have been outlawed in the Code of Regulations for Teachers and the TSC Code of Conduct and Ethics.

Teachers who violate the provisions of the Code of Regulations for Teachers and the TSC Code of Conduct and Ethics will face disciplinary action which may include warning or interdiction.

TSC Teacher Disciplinary Process

  1. A Head of institution may initially issue a verbal warning or caution the teacher in writing on minor breaches.
  2. In case of persistent misbehaviour, the teacher may be required to show cause why disciplinary action should not be taken against him/her.
  3. From the teacher’s response, the head of institution may serve the teacher with a warning or present the case before the agent.

The agent shall;

  1. Investigate and assemble relevant evidence.
  2. Invite the accused teacher in writing to defend himself/herself against specified allegation.
  3. Call witnesses to give evidence in the presence of the accused teacher.
  4. Allow the teacher to cross-examine each witness.
  5. In case of desertion where teacher’s whereabouts is unknown, the agent will interdict without any delay.

After the preliminary hearing the agent may reach any of the following decisions;

  1. No case to answer.
  2. Warn the teacher administratively.
  3. Interdict the teacher.

NB: In some cases TSC or agent can interdict a teacher without inviting him/her for preliminary hearing.

An interdicted teacher should write a defense statement within 21 days from the date of interdiction and provide contact address. A case will normally be heard within three months after interdiction. In case of delay the teacher is advised to make enquiries.

Salary during interdiction

Teachers interdicted on cases of incitement, insubordination, infamous conduct and negligence of duty will be paid half salary during the period of interdiction.

Determination of a Discipline Case

After interdiction and submission of the required evidence the teacher shall be given a chance to defend himself/herself in person before the Commission. A case shall be heard and determined in the absence of the teacher if he/she fails to appear during the hearing. From the evidence gathered, the Commission may;

  1. Revoke the interdiction.
  2. Warn the teacher.
  3. Suspend the teacher from duty.
  4. Dismiss the teacher from service.
  5. Retire the teacher in the public interest.
  6. Dismiss and remove from the register of teachers.

It is an offence for a teacher to engage in teaching in any institutions (public or otherwise) during the period of interdiction or suspension or on removal from the registry of teachers.

Where a teacher has been suspended from duty, he/she will be posted 14 days before the expiry of the suspension.

A teacher will be posted immediately in cases of revocation and warning. A teacher who does not receive communication within 28 days after hearing should make enquiries to the Commission Headquarters in person.

Nature of TSC Offences

The Commission may take disciplinary action against a teacher who commits any of the following offences:

Immoral behaviour, including but not restricted to:

  1. Sexual intercourse
  2. Sodomy
  3. Lesbianism and
  4. Sexual harrasment

Proffesional misconduct including but not restricted to:

  1. Negligence of duty
  2. Lateness to duty
  3. Chronic absenteeism
  4. Desertion Incitement and
  5. Insurbordination

Infamous conduct including but not restricted to:

  1. Drunkeness
  2. Fighting
  3. Conduct or behaviour which in the opinion of the Commission contradicts the spirit and tenor of Chapter six of the Constitution
  4. Forgery/ presentation of forged documents
  5. Mismanagement, misappropriation and embezzlement of public funds
  6. Any other act of conduct that is incompatible with the teaching proffession.

TSC list of causes f teacher absenteeism in schools

The Teachers Service Commission (TSC) has released a list of main causes for teacher absenteeism in schools. The Commission treats Teacher Chronic Absenteeism as a serious offence that can lead to interdiction and disciplinary action.

According to TSC, Teacher absenteeism is characterized by Persistent/repeated absence from duty without permission and Lateness for duty.

In taking disciplinary action, the Commission requires the following pieces of Evidence from the Head of Institution:

  • Casualty returns
  • Letters from authorities reporting the teachers absence.
  • Monthly staff returns.
  • Warning/show cause letters for absenteeism.
  • Daily attendance registers/clock in register.

After conducting a survey, recently, the Commission discovered that Illness was the main cause of teacher absenteeism in schools at 70 percent.

Other teachers skip lessons to attending burials while some have excess workload causing burn out.

Other reasons for teacher absenteeism include:

  • Over committed salaries leading to stress and inability to travel to school,
  • Domestic issues – marital/family disagreements,
  • Stress,
  • Alcoholism,
  • Following up issues at TSC offices,
  • Low morale as a result of low pay and lack of promotions,
  • Engaging in income generating activities; commonly known as side hustles,
  • Insecurity more so in hardship areas,
  • Running income generation activities,
  • Engaging in politics and
  • Confinement in police cell or prison.

To curb absenteeism the Commission introduced the Teacher Performance Appraisal and Development (TPAD).

Among the activities that have worked in TPAD is maintenance of daily school and teacher attendance registers are important documents or records for teachers’ accountability and proof of performance for both the appraisees and appraisers.

Maintenance of these records helps to keep track of appraisee performance in lesson attendance, lessons missed and lessons recovered.

Teacher’s Attendance Register is a document that records the regularity of teacher presence in school and in teaching. Teachers regularly sign this register as proof of their presence at school. It shows the number and nature of leave taken by teachers which include casual leaves, sick leaves, and leave without pay.

The TSC Disciplinary Process: Interdiction, Hearing of cases

Here is a list of top ten mistakes to avoid as a teacher:

(1.) Don’t send a learner away from your class during teaching and learning as a result of bad behavior. This is because you cannot account for what the student may be doing outside and this can count against you if an accident occurs.

(2.) Don’t touch a learner inordinately. This is because the learner might claim he or she was abused either sexually/physically.You may not be able to refute it.

(3.) Don’t give assignments you don’t have time to mark. Unmarked assignments or home work indicate incompetency/unprofessionalism.

(4.) Don’t give emotional punishment to your learners. It reduces their chances of becoming a better learner.

(5.) Don’t just teach within the period given to you, especially when you are preparing learners for external examinations. Do create more contact time for your learners.

(6.) Don’t stay with a learner alone in a class, laboratory, office etc. Child’s protection policy forbids it. Try and avoid “one corner” teaching.

(7.) Don’t ask a child to kneel down for too long a time. He or she might have a health challenge you are not aware of.

(8.) Don’t conspire against your school head( Head of Department, academic head etc). What goes around, comes around.

(9.) Don’t be a difficult educator and avoid transferred aggression on any learner. Pocket your personal challenges and always be full of life.

(10.) Don’t treat learners unequally. There should be nothing like favourite learner. Every child matters.

LATEST LIST OF OFFENCES THAT CAN LEAD TO REMOVAL FROM THE TSC REGISTER

A number of offences can lead to a teacher’s removal from the Teachers Service Commission, TSC, register. To be on the safe side, it is good that you understand these offences so as to avoid disciplinary action from the Commission. As it is said, ‘prevention is better than cure’, please be advised.

1. Negligence of duty

This includes;

a) Willful neglect to perform any work or careless or improper performance of any work assigned to the teacher.

b)Failure to teach scheduled lessons .

c) Failure to prepare professional documents e. g. schemes of work.

d) Allowing examination cheating.

e) Grading fake marks or favouring some students

f) Failure to perform duties of the teachers on duty

g) Failure to attend school assemblies and official
meetings requested by B.O.M.

2.Chronic absenteeism

If the teacher is involved in persistent or repeated absence from
duty without permission or lateness in duty. This could lead him/her to be deregistered from the list of teachers by TSC.

3. Desertion of duty

Absence from duty for 14 continuous days ( without written permission) including weekends and public holidays. These may include:

a) Failure to report for posting after expiry of study leave.

b) Proceed on study leave without approval.

c) Failure to report to new station after release.

4.Insubordination

Failure to obey instructions from supervisors e.g. Commission Secretary, Heads of Institution, County Directors e.t.c. These includes;

a)Failing to respond to letters from supervisors.

b) Failure to take up posting after disciplinary process/transfer/deployment.

c) Proceeding on transfer without formal release.

d) Failure to forward correspondence by teachers to and from the Commission.

e) Failure to handover/takeover an institution upon transfer.

f) Failure to submit books of accounts.

5. Infamous conduct of any professional respect

If a teacher is involved in the following actions ;

a) Drunkenness or any form of intoxication during working hours.

b) Fighting in public or any violent actions.

c) Behavior that may bring the profession to disrepute.

d) Conduct or behavior which contravenes chapter Six (6) of the Constitution.

6. Forgery/impersonation and corrupt deals / bribery

If the teacher indulges himself/ herself in forgery, impersonation presenting forged documents to the teachers service commission or if a teacher obtains employment through fraud or bribery. These may include;

a) Causing payment of salary to teachers not on duty e.g. desertions, deceased persons.

b) Forged signatures/stamps.

c) Obtaining registration through fraudulent means

d) Submission of forged certificates.

e) Misrepresentation/falsifying information.

f) Some exam malpractices/irregularities.

7. Mismanagement/misappropriation and embezzlement of public funds

Mismanagement is handling of public funds or property in an inefficient,
irregular or in any manner likely to cause loss to the institution.

Misappropriation is use of public funds for unauthorized purposes by a teacher.
Embezzlement is the fraudulent conversion of public funds and property entrusted to a
teacher to personal use.

7. Conviction of criminal offence

A teacher is deregistered upon conviction or being found guilty of a criminal offence( Jailed/fine or non custodial sentence) that may render him or her unfit to perform their duties.

9.Incitement

If a teacher is involved in any way of inciting students to do delinquent deeds like strikes or fires in school.

10.Immoral behavior

Immoral behavior includes sexual intercourse, sodomy, lesbianism, sexual harassment/flirtation and exposure to pornographic materials. If one is found committing such an offence with a fellow colleague or student it leads to deregistration by the teachers service commission.

D. Insubordination

Failure to obey official/instructions from supervisors e.g. Commission Secretary, Heads of Institution, County Directors and Sub-County Directors . e.g.:

  • Failure to respond to letters from supervisors.
  • Failure to take up posting after disciplinary process/transfer/deployment.
  • Proceeding on transfer without formal release.
  • Failure to forward correspondence by teachers to and from the Commission.
  • Failure to handover/takeover an institution upon transfer.
  • Failure to submit books of accounts.

  • Written reports by agents/County Directors/Supervisors.
  • Letters giving directives/instructions and evidence of failure to adhere.
  • Statement from witnesses.
  • Minutes of the full BOM, minutes where the teacher and witnesses were
    interviewed.
  • Minutes of disciplinary panel.
  • Investigation reports.
  • Staff meeting minutes.
  • Police reports.
  • Medical reports.

E. Infamous Conduct in any Professional Respect

  • Drunkenness or any form of intoxication during working hours.

  • behavior that may bring the profession to disrepute.

G. Mismanagement/Misappropriation/Embezzlement of Public Funds

Mismanagement is handling of public funds and /or property in an inefficient,
irregular or in any manner likely to cause loss to the institution.
Misappropriation is use of public funds for unauthorized purposes by a teacher.
Embezzlement is the fraudulent conversion of public funds and property entrusted to a
teacher to personal use.

  • Loss of public funds through negligence.
  • Failure to account for public funds as per
    the Law.

Evidence required

  • Financial reports presented to BOM and minutes.
  • Final audited accounts/Annual audited reports/interim audited accounts, promissory notes.
  • Investigation reports, relevant financial and accounting documents.

H. Conviction of Criminal Offense

A teacher is interdicted upon conviction (being found guilty of a criminal offence). Jailed/fine or non custodial sentence.

  • Conviction of a sexual offence or any offence against a learner.
  • Conviction of a criminal offence which in the opinion of the
  • Commission renders the person unfit to be a teacher.

Evidence required

  • Casualty return showing the date arrest/imprisonment.
  • Copy of charge sheet showing nature of offence.
  • Certified copies of court proceedings and judgment (CPJ).
  • Letters from authority reporting the arrest/reports.
