New Salaries For All Commissions Officers: TSC, IEBC, SRC, PSC, KNHRC, NLC, CRA and NPSC

Remuneration and Benefits for State Officers in the Full-Time Constitutional Commissions and Independent Offices

IN EXERCISE of the mandate of Salaries and Remuneration Commission (SRC) as set out under Article 230 (4) (a) of the Constitution, SRC has reviewed the remuneration and benefits for State officers in the Full-Time Constitutional Commissions and Independent Offices under the Third Remuneration and Benefits Review Cycle that covers Financial Years (FY) 2021/2022-2024/2025. Consequently:

  • for the period 2021/2022, the remuneration and benefits were retained as set by SRC in Gazette Notice 6519 of 7th July, 2017;
  • for the period 2022/2023, SRC has set the remuneration and benefits as published in this Gazette Notice; and
  • for the period 2023/2024 – 2024/2025, SRC shall set the remuneration and benefits on or before the commencement of FY 2023/2024.

Notes:

  • A serving State officer and a State officer appointed in Full-Time Constitutional Commission and Independent Office on or after the effective date of this Gazette Notice shall be paid the monthly remuneration set herein.
  • The monthly remuneration set herein is fixed for the term of office of the State officer, unless reviewed and set by the Salaries and Remuneration
  • Salary Market Adjustment is a salary modification that takes into account market positioning, and constitutional and statutory principles on review of remuneration and benefits.
  • For purposes of gratuity and pension, the pensionable emolument shall be based on the monthly basic salary set
  • The basic salary set herein is 60 per cent of the gross salary set
  • The deconsolidated remuneration structure set herein is in compliance with the Judgment of the Court in Nairobi ELRC Petition 29 of
  1. Part-Time and Co-opted Member of Full-Time Constitutional Commissions and Independent Offices: Shall be paid Sitting Allowance at the rate of KES 40,000 per sitting up to a maximum of KES. 320,000 per month.
  2. Benefits for State officers in Full-Time Constitutional Commissions and Independent Offices
    • Official Transport: State officers in Full-Time Constitutional Commissions and Independent Offices shall be provided with an official car of engine capacity not exceeding 3000cc.
    • Medical Benefit: An annual medical cover shall be provided to the State officer, one spouse and up to four children below twenty-five years fully dependent on the State officer, as follows:

Inpatient: KES 10 million Outpatient: KES 300,000

Maternity: KES 150,000

Dental: KES 75,000

Optical: KES 75,000

 

  • Retirement Benefit: There shall be two types of retirement benefits for State officers, pension and gratuity as follows:
  • A State officer serving or appointed on permanent and pensionable terms shall be eligible to pension benefit in line with existing
  • A State officer serving or appointed for a fixed term of office shall be paid a service gratuity at the rate of 31 percent of the annual pensionable emoluments for the term served.

Notes:

  • Where an employer establishes a pension scheme for its State officers appointed for a fixed term of office, the SRC shall review and set the rate of the employer’s contributions to the scheme and any other financial retirement benefits.
  • No State officer shall benefit from both pension and gratuity benefits from the same public body for a similar
    • Group Life Insurance: A State officer shall be covered for a value equivalent to three times of the annual pensionable
    • Group Personal Accident: A State officer shall be covered for a value equivalent to three times of the annual pensionable
    • Car Loan and Mortgage Benefit: Shall be provided, as follows:

The Commission is responsible for conducting or supervising referenda and elections to any elective body or office established by the Constitution, and any other elections as prescribed by an Act of Parliament and, in particular, for;

      • The continuous registration of voters and revision of the voter’s roll;
      • The delimitation of constituencies and wards;
      • The regulation of political parties process;
      • The settlement of electoral disputes;
      • The registration of candidates for elections;
      • Voter education;
      • The facilitation of the observation, monitoring and evaluation of elections;
      • The regulation of money spent by a candidate or party in respect of any election;

Requirements for Elective Post- Nominees of Party Lists


NOTICE is hereby given to the public on the qualifications and requirements for candidates contesting for elective positions together with nominees to Party Lists in the upcoming General Election scheduled to be held on 8th August, 2017

Select position :

Qualifications for Nominees of Party Lists under Articles 97(1) (c) and 98 (1) (b), (c) and (d), and for the members of county assemblies under Article 177 (1) (b) and (c)

The following:

  • Nominees to the National Assembly –
  • Nominees to the Senate
  • Youth Nominees to the Senate
  • Persons with Disability Nominees to the Senate
  • Marginalized Group Nominees to the County Assembly
  • Gender Special Seats Nominees to the County Assembly (For Gender Top Up)

Qualifications:

  • Must have been a Kenyan citizen for at least 10 years before the election;
  • Must be a registered voter;
  • Must not owe allegiance to a foreign state;
  • Certification of Disability from the relevant institution as prescribed by the Commission;
  • Must meet the statutory moral and ethical requirements under the Leadership and Integrity Act;
  • Must not be a public officer or acting in any State of public office other than a Member of the County Assembly or National Assembly as the case may be.
  • Must not hold dual citizenship unless citizenship of the other country has been obtained by operation of law without capacity to opt out;
  • Must not be an undischarged bankrupt;
  • Must not be a person of unsound mind;
  • Must not be subject to a sentence of imprisonment of at least six months from the date of registration of candidates or date of elections;
  • Must not have been found to have abused or misused state or public office or contravened Chapter Six of the Constitution; and
  • Must not have been dismissed or removed from public office for contravening the provisions of Articles 75, 76, 77 and 78 of the Constitution

Requirements:

A Political Party must submit the following documents to the Commission during the date set for delivery of party lists to the Commission:

  1. Party Lists containing nominees appointed in accordance with Articles 97(1)(c), 98(1)(b), (c) and 177(1)(c) and (c) of the Constitution in the manner prescribed by the Commission and by authorized signatories of the nominating Political Party.
  2. Duly signed copies of Letters of Acceptance executed by the Nominees.

Results Transmission And Presentation (RTS)


RTS is a system for transmitting provisional results electronically to an observation centre.

At the end of voting and when votes have been counted and tallied, the Presiding Officers (Pos) enter the data on the signed results sheet (Form 35) into a specially configured mobile phones and transmits the results simultaneous to the election results centres at the constituency, county and national level.

  • Enhance transparency through electronic transmission of provisional results from the polling stations
  • Display and visualize provisional results at the tally centers
  • Provide access to provisional elections data to media and other stakeholders in real time

Requirements:

The Candidate must submit the following documents to the Commission during the Commission Nomination:

  • A copy of a National Identity Card/valid Passport (the document used by the candidate to register as a voter)
  • A Passport size photograph with white background submitted in hard and soft copy.
  • If a Party Candidate, a Nomination Certificate from a fully registered political party nominating the candidate, duly signed by an authorized official of the party
  • A duly signed and dated Code of Conduct (Second Schedule of the Elections Act, 2011)
  • A duly filled Commission Nomination Form, including an original Statutory Declaration Form for purposes of nomination (Regulation 18(3) Elections (General) Regulations, 2012) and an original Self-Declaration Form (Regulation 46 of Elections (General) Regulations, 2012)
  • Nomination fees in a Banker’s Cheque payable to IEBC:
    • 50,000 for candidates
    • Kshs. 25,000 for a candidate who is a youth, a woman or a person with a disability

For an Independent Candidate

  • A Clearance Certificate from the Registrar of Political Parties certifying that the person was not a member of any political party for the last 3 months before the elections;(Regulation 15(a) (General) Regulations, 2012
  • An electronic and a printed copy soft and a hard copy of a list of at least 2000 supporters in the prescribed form, submitted to the Commission.
  • A duly filled Form of Intention to Contest submitted to the Commission in the prescribed form,
  • A symbol the candidate intends to use during the election, which has been approved by the Commission
  • Establish and maintain a functioning office in the respective electoral area where the candidate is contesting, which must be available for inspection by the Commission at least 45 days before the elections. The address, including the physical address of the office must be communicated to the Commission.

Remuneration and Benefits for State Officers in the Senate and National Assembly

IN EXERCISE of the mandate of Salaries and Remuneration Commission (SRC) as set out under Article 230 (4) (a) of the Constitution, SRC has reviewed the remuneration and benefits for State officers in the Senate and National Assembly under the Third Remuneration and Benefits Review Cycle that covers Financial Years (FY) 2021/2022-2024/2025. Consequently:

  • for the period 2021/2022, as applicable during the second remuneration review cycle;
  • for the period 2022/2023, SRC has set the remuneration and benefits as published in this Gazette Notice; and
  • for the period 2023/2024 – 2024/2025, SRC shall set the remuneration and benefits on or before the commencement of FY 2023/2024.

    • Committee Sitting Allowance

State officers in the Senate and National Assembly who serve in Committees shall be paid Committee Sitting Allowance as follows:

  • Chairperson: KES 15,000 per sitting up to a maximum of KES 240,000 per
  • Vice-Chairperson: KES 12,000 per sitting up to a maximum of KES 192,000 per
  • Member: KES 7,500 per sitting up to a maximum of KES 120,000 per
  • Official Transport:
    • The Speakers of the Senate and National Assembly Shall be provided with an official car of engine capacity not exceeding
    • Member of Parliament: Shall be provided with a Motor Vehicle Reimbursement of KES 7,550,000 for purchase of a car of engine capacity not exceeding 3000cc to undertake official duties as a Member of Parliament. The Motor Vehicle Reimbursement shall be payable to a Member of Parliament once in a parliamentary term.
    • Car Maintenance Allowance: Shall be paid to a Member of Parliament at the rate of KES 356,525 per
    • Mileage Claim: A Member of Parliament shall be reimbursed a claimable mileage of one return journey per a week from the National Assembly (Nairobi) to his/her constituency office at the rate of KES 116.63 per kilometre, based on a car of engine capacity not exceeding
    • The Claimable Mileage Allowance is zoned into two, and claimable based on actual distance in kilometers (Km) from the National Assembly (Nairobi) to respective constituency office as follows:

Notes:

  • The maximum monthly reimbursable mileage shall be calculated based on 52 weeks in a year as follows: Maximum monthly reimbursable mileage = (maximum weekly return journey in km X 52 weeks X KES 116.63)/12 months.
  • The Parliamentary Service Commission shall ensure that Members of Parliament are reimbursed within the maximum actual distance from the National Assembly (Nairobi) to respective constituency office.
  • Special Parliamentary Duty Allowance: Shall be paid up to a maximum of KES 150,000 per month to State officers in the Senate and National Assembly whose duties involve added Parliamentary Leadership over and above the duties stipulated in one’s terms of service for which a regular salary is paid.

Note: The Parliamentary Service Commission shall apportion the rate of Special Parliamentary Duty Allowance, up to a maximum of KES 150,000 per month, to each of the designated state officer with leadership duties in parliament based on seniority as provided by the Constitution, Legislation or Standing Orders.

  • Medical Benefit: An annual medical cover shall be provided to the State officer, one spouse and up to five children below twenty-five years fully dependent on the State officer, subject to a maximum cover limit as follows:

Inpatient: KES 10 million Outpatient: KES 300,000

Maternity: KES 150,000

Dental: KES 100,000

Optical: KES 100,000

 

  • Retirement Benefit: Parliamentary Pensions Act Chapter 196 Revised Edition 2012 (1985), shall apply subject to note on setting of the monthly remuneration in (1)(e) above.
  • Group Life Insurance: A State officer shall be covered for a value equivalent to three times of the annual pensionable
  • Group Personal Accident: A State officer shall be covered for a value equivalent to three times of the annual pensionable
  • Car Loan and Mortgage Benefit: To be provided to State officers in the Senate and National Assembly once during a parliamentary term, as follows:

  • The car loan and mortgage shall be administered and managed centrally by the Parliamentary Service Commission within the existing applicable regulations to govern the schemes, and subject to availability of funds.

1. PAUL        KARUNGO THANGWA 21979996 KIAMBU 022 UNITED DEMOCTRATIC ALLIANCE The Aspirant was an appointed state officer serving in the  County  Government  of  Kiambu,  where  he  was removed from  office  by  way  of  impeachment by  the County   Assembly   of   Kiambu.   The   High   Court   in Nairobi  Petition  No.  E234  of  2022   has  issued  a temporary  order  barring  the  IEBC  from  clearing  the Aspirant  to  contest  the  position  of  Senator  in  the County of Kiambu, pending determination of the case challenging the eligibility of the Aspirant to vie.
2. OBADO    ZACHARIA OKOTH 2742774 MIGORI 044 PEOPLES DEMOCRATIC PARTY The  Aspirant  was  charged  in  Nairobi  Anti-Corruption Court   vide   ACC/8/2020   with   four   counts   namely Conspiracy  to  commit  an  offence  of  economic  crime contrary to section 47A; Conflict of Interest contrary to   section   42(3);   Money   Laundering   contrary   to section  3  (A)  (i)  as  read  with  section  16  of  the Proceeds of Crime and Anti- Money Laundering; and Unlawful  acquisition  of  Public  Property  contrary  to section 45(1) (a) as read with section 48 of the Anti- Corruption and Economic Crimes Act no 3 of 2003.
A  civil  case  for  recovery  of  illegally  and  corruptly acquired  assets  has  also  been  instituted  vide  ACEC E010 of 2021. Both matters are pending before court.
3. MUNGATANA DANSON BUYA 10311859 TANA RIVER 004 UNITED DEMOCTRATIC ALLIANCE The aspirant was charged in court with the offence of conspiracy to commit an economic crime contrary to section  47A  of  the  Anti-Corruption  and  Economic Crimes Act no 3 of 2003 vide Malindi ACC. 4 of 2019. The matter is pending before court.
4. ONYONKA  RICHARD MOMOIMA 300027 KISII 045 ORANGE DEMOCRATIC MOVEMENT The Commission received and investigated allegations that the aspirant failed to remit taxes totaling to Kshs 21 Million relating to the purchase  of sugar for IDPs worth  Kshs.  132  M  from  Chemelil  Sugar  Company using   CDF.   Investigations    established   that   the Aspirant  was  culpable.  He  was  charged  in  court  in Kisumu vide ACC 1 of 2014.   He was acquitted under section  215  of  the  CPC.  The  State  has  lodged  an appeal and the matter is pending in court.
5. CHILUMO BENJAMIN KAI 1126527 KILIFI 003 PAA The Commission has instituted recovery suits against the  aspirant  in  civil  suits  filed  in  the  High  Court  of Kenya at Nairobi Nos. 29 of 2017 and 7 of 2018 for the  recovery  of  Kshs.  252,864,833.17  lost  by  the County  Government  of  Kilifi  between  1st  July  2015 and 31st December 2015 through irregular payments for    goods/services    not    provided/delivered.    The matters are pending before court.
6. MBOGO         LILIAN WANJA MUTHONI 13406241 EMBU 014 JUBILEE PARTY The  Aspirant  is  a  former  Principal  Secretary  in  the Ministry  of  Public Service,  Youth  and Gender Affairs. She  was  part  of  investigations  by  the  DCI  which culminated  in  her  arrest  and  prosecution  alongside several  staff  and  suppliers  of  the  National  Youth Service (NYS) in criminal cases Nairobi Criminal Case Nos. ACC 8 of 2018, ACC 10 of 2018, ACC 12 of 2018,
ACC 13 of 2018, ACC 16 of 2018 and ACC 17 of 2018,
linked to loss theft of public funds amounting to Kshs 467,896,993/= from the NYS, a State Department in the  Ministry  of  Public  Service,  Youth  and  Gender Affairs.
The     Asset     Recovery     Agency     instituted     civil proceedings  through  ACC  No.  58  of  2018  for  the recovery of funds from accounts held in the names of the  Aspirant,  companies  in  which  the  Aspirant  is  a joint director and from her accounts in the names of her children.
On   15th   April   2020,   the   court  entered  judgment against  the  Applicant  and  granted  orders  declaring that    a    total    of    USD    105,293.7    and    Kshs. 22,445,487.74    held    in    several    bank    accounts belonging  to  or  associated  with  the  Aspirant    are proceeds of crime and therefore liable for forfeiture to the State.
