IEBC requirements for Presidential Candidates 2022

Requirements for Elective Post- Presidential Candidates


NOTICE is hereby given to the public on the qualifications and requirements for candidates contesting for elective positions together with nominees to Party Lists in the upcoming General Election scheduled to be held on 8th August, 2017

Select position :

Qualifications:

  • Must be a Kenyan citizen by birth;
  • Is qualified to stand for election as a member of Parliament;
  • Must not owe allegiance to a foreign state;
  • Must be a registered voter;
  • Is a holder of a degree from a University recognized in Kenya;
  • Is nominated by a Political Party or is an independent candidate;
  • Must not be a public officer or acting in any State of public office other than, President, Deputy President or Member of Parliament;
  • Must meet the moral and ethical requirements under the Leadership and Integrity Act;
  • Must not hold dual citizenship unless citizenship of the other country has been obtained by operation of law without capacity to opt out;
  • Must not be an undischarged bankrupt;
  • Must not be a person of unsound mind;
  • Must not be subject to a sentence of imprisonment of at least six months from the date of registration of candidates or date of elections;
  • Must not have been found to have abused or misused state or public office or contravened Chapter Six of the Constitution; and
  • Must not have been dismissed or removed from public office for contravening the provisions of Articles 75, 76, 77 and 78 of the Constitution.

The Candidate must submit the following documents to the Commission during the Commission Nomination:

  • Certified copies of educational qualification certificates, including a Degree Certificate in accordance with Section 22 of the Elections Act, 2011 and Regulation 47 of Elections (General) Regulations, 2012.
  • A copy of a National Identity Card/valid Passport (the document used by the candidate to register as a voter).
  • A Passport size photograph with white background submitted in hard and soft copy.
  • If a Party Candidate, a Nomination Certificate from a fully registered Political Party nominating the candidate, duly dated and signed by an authorized official of the party.
  • A duly signed and dated Code of Conduct (Second Schedule of the Elections Act, 2011)
    • A duly filled Commission Nomination Form, including:
      An original Statutory Declaration Form for purposes of nomination (Regulation 18(3) Elections (General) Regulations, 2012 and an original Self-Declaration Form (Regulation 46 of Elections (General) Regulations, 2012).
    • For both Political Party Candidates and Independent Candidates, an electronic and printed copy of not fewer than 2000 voters from each of the majority of the counties in the prescribed form.
  • Nomination fees in a Banker’s Cheque payable to IEBC:
    • 200,000 for candidates
    • 100,000 for a candidate who is a youth, a woman or a person with a disability.

For an Independent Candidate:

  • A Clearance Certificate from the Registrar of Political Parties certifying that the person was not a member of any political party for the last 3 months before the elections; (Regulation 15(a) (General) Regulations, 2012.
  • An electronic and a printed copy of a list of at least 2000 supporters from each of the majority of the counties in the prescribed form, submitted to the Commission.
  • A duly filled Form of Intention to Contest, prescribed by the Commission.
  • A symbol the candidate intends to use during the election, which has been approved by the Commission 21 days before Nomination day.
  • Establish and maintain a functioning office in the respective electoral area where the candidate is contesting, which must be available for inspection by the Commission at least 45 days before the elections. The address, including the physical address of the office must be communicated to the Commission

INDEPENDENT ELECTORAL AND BOUNDARIES ACCREDITATION OF OBSERVERS, MEDIA AND VOTER EDUCATION PROVIDERS

The Independent Electoral and Boundaries Commission (IEBC) is in the process of accrediting Election Observers, Media and Voter Education Providers for the 8th December, 2022 and the 5th January, 2023 by-elections.

Senatorial by-election in Bungoma County and County Assembly Ward (CAW) by-elections in Ololmasani (Narok County), Kyome/Thaana Ward (Kitui County), Utawala (Nairobi City County), Mumias North (Kakamega County) & South Gem (Siaya County) will be held on Thursday, 8th December, 2022.

Senatorial by-election in Elgeyo Marakwet County, County Assembly Ward (CAW) by election in Shella Ward (Lamu County) and Members of National Assembly (MNA) by elections in Kandara and Garissa Township Constituencies will be held on Thursday, 5th January, 2023.

To aid processing of applications, the Commission has automated the accreditation process through the development and deployment of an online Accreditation Management System (AMS) which is simple and easy to use.

All interested organizations are therefore required to login into the AMS to submit
https://ams.iebc.or.ke/ by Friday 2nd December, 2022 at 5.00pm

Applicants are advised to ensure they have a stable and reliable internet connection when doing the application.

All inquiries concerning this process should be channeled through the Directorate of Voter Education and Partnerships via Tel (020) 2877000 EXT 113/445.

Accredited organizations shall be issued with identification badges, certificates and support materials by the Commission, and shall attend briefing sessions prior to and at established times in the course of their work.

He was convicted on three accounts, for which he was sentenced to pay a fine of Kshs. 300,000; Kshs. 200,000 and Kshs. 200,000 respectively and in default to serve 12 months on each account, the sentences to run consecutively. In addition, the court directed that the Aspirant  be forthwith  barred from holding public office,  in  accordance  with  section  18  of  the  Bribery Act. The Aspirant therefore requires to prove that he has  preferred  an  appeal  challenging  the  conviction, and the result thereof.
2. MUTWIWA     DAVID MAITHA 23797281 KASIKEU 0417 MAENDELEO CHAPCHAP The   Aspirant   was   charged   in   Court   with   counts relating   to   impersonating   an   Ethics   and   Anti- Corruption  Commission  investigator  and  uttering  a false  document.  He  was  convicted  on  the  count  of impersonating   an   investigator   of   the   Commission contrary  to  s.  34(1)  as  read  with  s.  34(2)  of  Anti- Corruption and Economic Crimes Act to a fine of Ksh. 300,000 or in default 1-year imprisonment and to the count of uttering a false document contrary to s.  349 of the Penal Code as read with sec. 353 of the Penal code, to a fine of Kshs. 300,000 or in default 1 year imprisonment.
The Aspirant has further been charged in Court vide Case  No.  ACC.  518  of  2016  with  counts  relating  to allegations of impersonating an EACC investigator and collects bribes from members of public. The matter is pending in court.
3. NYAKUNDI KEPHA SAGINI 29123201 KEGOGI 1340 UNITED PROGRESSIVE ALLIANCE The   Aspirant   was   charged   at   the   Eldoret   Anti- Corruption vide Case No. ACC 2 of 2022 with counts relating  to  forgery  of  his  academic  certificates  and personating  a  person  named  in  a  certificate.  The matter is pending in court.

OBIMBIRA LENARD WANDA 7421158 BUNYALA WEST 1154 FORD KENYA The  Aspirant  was  charged  at  the  Nairobi,  Milimani Anti-Corruption  Courts  vide  case  No.  ACC  23/2018 Republic  vs.  Sospeter  Ojaamong  and  8  Others  with counts relating to abuse of office and failure to follow procurement  laws  contrary  to  Anti-Corruption  and Economic  Crimes  Act.  The  matter  is  pending  before court.
6. KAJIAMBO MTILI SAIDI 24031282 KINANGO 0046 PARTY OF DEMOCRATIC UNITY The Aspirant was charged in Court vide Case No. ACC
1   of   2021   with   offences   relating   to   fraudulent acquisition of public property contrary to section 45(1)
(a) as read with section 48 of the Anti-Corruption and Economic  Crimes  Act,  2003.  The  matter  is  pending before court
7. OMONDI IBRAHIM OYUGI 14553133 AIRPORT 0003 INDEPENDENT The  Aspirant  was  charged  vide  Case  No.  ACC  1  of 2022 with offences relating to embezzlement of Kshs. 100,000 from ward office to his personal account and irregularly employing his wife as Ward Office Manager contrary to the Anti-Corruption and Economic Crimes Act.
8. DAVID LEMANTILE 22861811 OLDO/NYIRO 0247 KANU The Commission received and investigated allegations that the aspirant made a false document purporting to be     supplementary     budget     of     Isiolo     County Government. The investigation was concluded and the Aspirant and others were charged in Meru vide Case No. Meru ACC No. 10 of 2015. The matter is pending before court.
9. BALLA ABDI SORA 13868383 GARBATULLA JUBILEE The Commission received and investigated allegations that the aspirant made a false document purporting to be     supplementary     budget     of     Isiolo     County Government. The investigation was concluded and the Aspirant and others were charged in Meru vide Case No. Meru ACC No. 10 of 2015. The matter is pending before court.
10. GICHUHI JACKSON KABINGU 10733582 MAGUTU 0478 UNITED DEMOCRATIC ALLIANCE The Aspirant failed to honour witness summons in a corruption  matter  in  court  where  he  is  a  witness  in ACC  No.  18  of  2014.  A  warrant  of  arrest  has  been issued against the aspirant.

KUTITILA   ANDREW SICHANGI 14554066 SIKHENDU 0692 DEMOCRATIC ACTION PARTY- KENYA The  Aspirant  was  charged  in  Eldoret  vide  case  No. Eldoret 2 of 2017 together with others for a count of abuse  of  office  relating  to  the  misappropriation  of Ksh.  3  million  allocated  to  the  Trans  Nzoia  County Assembly by the County Government.   The matter is pending in court

NOTICE is hereby given to the public on the qualifications and requirements for candidates contesting for elective positions together with nominees to Party Lists in the upcoming General Election scheduled to be held on 8th August, 2017

Select position :

Qualifications:

  • Must have been a Kenyan citizen for at least 10 years before the election;
  • Must not hold allegiance to a foreign state;
  • Must be a registered voter;
  • Is nominated by a Political Party or is an independent candidate;
  • Must meet the statutory moral and ethical requirements under the Leadership and Integrity Act;
  • Must not be a public officer or acting in any State of public office other than a Member of Parliament;
  • Must not hold dual citizenship unless citizenship of the other country has been obtained by operation of law without capacity to opt out;
  • Must not be an undischarged bankrupt;
  • Must not be a person of unsound mind;
  • Must not be subject to a sentence of imprisonment of at least six months from the date of registration of candidates or date of elections;
  • Must not have been found to have abused or misused state or public office or contravened Chapter Six of the Constitution; and
  • Must not have been dismissed or removed from public office for contravening the provisions of Articles 75, 76, 77 and 78 of the Constitution
  • Nomination fees in a Banker’s Cheque payable to IEBC:
    • 20,000 for candidates
    • Kshs. 10,000 for a candidate who is a youth, a woman or a person with a disability

Requirements:

The Candidate must submit the following documents to the Commission during the Commission Nomination:

  • A copy of a National Identity Card/valid Passport (the document used by the candidate to register as a voter)
  • A Passport size photograph with white background submitted in electronic and printed copy.
  • If a Party Candidate, a Nomination Certificate from a fully registered political party nominating the candidate, duly signed by an authorized official of the party
  • A duly signed and dated Code of Conduct (Second Schedule of the Elections Act, 2011)
  • A duly filled Commission Nomination Form, including an original Statutory Declaration Form for purposes of nomination (Regulation 18(3) Elections (General) Regulations, 2012) and an original Self-Declaration Form (Regulation 46 of Elections (General) Regulations, 2012)

For an Independent Candidate

  • A Clearance Certificate from the Registrar of Political Parties certifying that the person was not a member of any political party for the last 3 months before the elections; (Regulation 15(a) (General) Regulations, 2012
  • An electronic and a printed copy of a list of at least 1000 supporters in the prescribed form, submitted to the Commission.
  • A duly filled Form of Intention to Contest submitted to the Commission in the prescribed form.
  • A symbol the candidate intends to use during the election, which has been approved by the Commission
  • Establish and maintain a functioning office in the respective electoral area where the candidate is contesting, which must be available for inspection by the Commission at least 45 days before the elections. The address, including the physical address of the office must be communicated to the Commission.

policies, plans and budgets at the constituency level while ensuring the alignment of these
to the regional and overall Commission strategies;
b) Ensure that election operation activities at the constituency level comply with internal
controls and budget restrictions;
c) Ensure provision of administrative support services at the constituency level including
distribution of election materials, transport management, implementation of security
policies and protocols and ensuring the safe custody of the Commission’s assets;
d) Be responsible for sound financial management and prudent use of all Commission funds
at constituency level in line with Commission’s financial policies;
e) Liaise with the County Election Manager to implement training programmes for
registration and election officials at the constituency level;
f) Identify, inspect suitable polling, nominations and tallying centers;

Transmission of IEBC Presidential results – Step by Step Guide

Transmission of Presidential results

The PO shall:

  • Launch the RTS application on the KIEMS tablet by scanning RTS QR code on the Register of Voters for that specific Polling station
  • Capture a clear and focused image of the DULY FILLED AND PO STAMPED declaration Form 34A using the KIEMS kit and verify accuracy
  • Display image to the agents
  • Take a screen shot of the captured image using your phone and send to the RO
  • Transmit the scanned image of Form 34A using the KIEMS kit and wait for the confirmation message.
