Why the DPP has ordered for the arrest of Kiambu Governor Waititu, his wife and others; full list

The Director of Public Prosecutions, Noordin Haji, has instructed the police to arrest vibrant Kiambu Governor Ferdinand Waititu aka ‘Baba Yao’ over alleged embezzlement of Ksh. 588million public funds. Waititu is to arrested alongside his wife Susan Wangari Ndung’u

The DPP said he is satisfied with evidence against Waititu and 12 other suspects linked to irregular procurement for upgrading several roads in Kiambu County.

“I find that the award of the contract for Ksh.588,198,328.20 in respect to tender No.CGK/RTPW&U/142/2017-2018- for the upgrading of various gravel roads to Bitumen surface in Thika, Limuru, Gatundu North, Juja and Ruiru sub-counties was skewed in favour of M/s Testimony Enterprises Ltd, and the county government officials were culpable. The directors of M/s Testimony Enterprises Ltd were close associates of Ferdinand Ndung’u Waititu Babayao, the Governor of Kiambu County. The total amount of Ksh.147,274,055.39 have so far been irregularly paid to Testimony Enterprises Ltd in relation to the subject tender,” reads the DPP’s statement.

Waititu and his co-accused are facing charges that include: conflict of interest, dealing with suspect property, fraudulent acquisition of public property, money laundering abuse of office, wilful failure to comply with the law relating to procurement and engaging in fraudulent practice.

The seemingly controversial Governor; Waititu, defeated William Kabogo to clinch the Kiambu Gubernatorial seat in the last General election.

The Directorate of Criminal Investigations, DCI, has directed interdicted officials from the Kenya Revenue Authority, KRA, to report to its offices immediately. The 75 KRA officers were interdicted on suspicion of abetting tax evasion, bribery, and corruption. They were sent packing on Friday 10th May, 2019.

“The following listed suspects who are connected with the ongoing investigations KRA, are hereby compelled to report DCI Headquarters~Investigations Bureau(IB Block) on Monday 13th May 2019 by 7:00 AM without fail,” reads a presser from the DCI.

Fraudulent ‘Aden Duale’ Bursaries; Nyamira Man running fake Majority Leader Social Media accounts arrested

Police have arrested a man suspected to be running fake social media accounts under the name of majority leader in the National Assembly, Hon Aden Duale. James Ombui Oire, from Nyamira, runs a fake Facebook page that impersonates Hon Duale. He cons Kenyans by asking them to send Kshs. 2,000 registration fees using the phone number 0720886964 and 0722134712. Mr Oire has since been apprehended by the DCI to answer charges of impersonating Hon Duale.

Hon Duale has issued a warning to the public saying he does not run such bursary schemes. “Members of the public are advised to ignore messages circulating on social media indicating that the Office of the Majority Leader of the National Assembly of Kenya, Hon. Aden Duale is offering 10,000 scholarships to students across the country,” he said.

One of the fraudulent posts by the imposter, Mr Oire, claiming that Hon Aden Duale will run out a bursary scheme in which beneficiaries will get Kes 10,000 each.

Duale adds that the scheme was hatched with the intention of conning Kenyans. “This is a well-orchestrated plan to con unsuspecting Kenyans hatched by James Ombui Oire from Nyamira County. He is deceiving Kenyans he is Hon. Duale’s Personal Assistant,” adds Hon Duale.

Latest news on the 2019 Census job adverts, KNBS issues warning

‘Ignore fake Census job adverts doing rounds on Social media platforms,’ is the latest warning from the Kenya National Bureau of Statistics, KNBS. KNBS via a presser has thus notified the general public that recruitment for this year’s census officials will be done in June. “Job advertisements will only be placed on the local newspapers and the official KNBS website – https://t.co/AIxuCPupLy in June 2019. Anything prior to this date is unfortunately fake,” KNBS has warned.

KNBS says no one should pay for recruitment to Census jobs. “KNBS does not require any payment for any job application,” KNBS adds.

KNBS is currently undertaking the cartographic mapping exercise in Nairobi County until 31st May 2019. This is in preparation for the upcoming national Census exercise.

A number of fake adverts have been doing rounds on Social media with some aimed at conning unsuspecting job hopefuls.

The Ministry of State for Planning, National Development and Vision 2030, through the Kenya National Bureau of Statistics (KNBS), will conduct the National Population and Housing Census in 2019 in accordance with the Statistics Act 2006.
The Bureau is embarking on recruitment and training of the field personnel that will be involved in the enumeration exercise.

The mandatory digitization of all firearms in the hands of civilians is on course- Police say.

The National Police Service, NPS, has insisted that the mandatory digitization of all firearms in the hands of civilians is firmly on course. Here is the Presser by the Inspector General of the NPS, Hillary Mutyambai;

‘The National Police Service would like to categorically state that the mandatory digitization of all firearms in the hands of civilians is on course, and has now extended to the registration of firearms in the hands of all National Police reservists without exception.

Following the deadline of registration, anyone found in possession of an unregistered firearm will be treated as a combatant. While the handling, trading or possession of firearms without a license is criminalized under Kenyan law indeed, is with great concern that we have observed the proliferation of unregistered firearms in the hands of police reservists that has unfortunately continued unabated over the last 50 years.

It is no secret that unregistered guns can and have been easily used for criminal activities and it is much harder for security agencies to trace such activities when gun owners cannot be identified. The stemming of unregistered guns can therefore not be an option for a country such as ours, surrounded by unstable neighbours in the region. This situation also poses a significant threat to national security, as there is a clear and present danger to the lives and livelihoods of many Kenyans.

We therefore urge every genuine and peace loving police reservist to submit themselves to the verification and registration process which involve, ballistic analysis by the Directorate of Criminal Investigations, biometric registration, labelling of weapons, shooting practice among others.

The aim of the vetting is first and foremost, the complete elimination of guns in the wrong hands. We will also talk to, train and re-register the guns in the hands of the reservists in the entire country; ensuring guns are in the hands of well trained and qualified persons.

The vetting exercise will help in weeding out reservists who might be compromised and those advanced in age. The disarming of police reservists will immediately take priority in the North Rift which has recently experienced a spike of artificial criminal and politically instigated inter communal tensions.
Last week, we sent a contingent of GSU, ASTU. and RDU officers to support the Rift Valley security team as a precursor to stiff measures to be undertaken to curb further escalation of the cattle rustling and inter-communal strife in the area.

The team confirmed the presence of a ring of cartels involved in cattle rustling, for selfish economic gain, and who sometimes use unregistered KPR ammunitions to intimidate, maim, and even kill innocent victims. The government will not allow the senseless arming of citizens against other citizens, and we warn all concerned not to test our resolve.

As such, I directed that officers be deployed in the following areas to provide security buffers to warring neighbouring communities, ASTU officers have set camp in Kamilei, Mwiteta and Wagwachi along the border of Baringo and Laikipia counties. GSU officers have been deployed at Kabyego between West Pokot and Marakwet counties, Tiati in Baringo South, Kapedo and Lokori along Pokot and Turkana counties.

GSU camp at Shaba has been moved to Archers post. RDU has been deployed to Mlango, a corridor between Isiolo and Laikipia counties. Further a patrol base at Kainuk has been beefed with heavy presence of police offices.

We further implore politicians and other leaders, specifically those from the North Rift communities to exercise sobriety and encourage their constituents to engage in constructive social economic activities; as well as peaceful coexistence and neighbourliness as a better option to strife which ends up leaving communities more vulnerable and despondent.

Indeed the above steps are part of moves taken to bolster police reforms in the country. Other reforms in the sector have already taken shape and have seen the digital registration of all police officers, Kenya Prisons Service officers as well as those serving in the National Government as Administration Officers.

In the ongoing registration of civilian firearm holders, the government has recorded the recovery of 24,000 rounds of ammunition. In addion 90,000 rounds of ammunition have been recovered from NPR’s.
It remains the constitutional mandate of the Police to protect members of our communities and their properties.

We therefore wish to ask for cooperation amongst members of the general public during this exercise.’

Hon Savula and co- accused released on bond

Former Broadcasting and Telecommunications PS Sammy Itemere, Lugari Member of Parliament, MP, Ayub Savula and 22 others were today charged with conspiracy to defraud the Government Advertising Agency, GAA, of KSh122 Million. They, all, denied the charges.

The former PS and 22 others were released on KSh. 2 million bond with surety or Kshs. 1 million bail.

Hon. Savula was granted a Kshs. 1 million bond with surety or bail of KShs .5 million on behalf of his 7 companies. He was personally given a KShs. 1 million bond with surety of KShs.5 million. All the accused persons were directed to deposit their travel documents in court.
Hon. Savula was arrested on Friday, last week.

Mention of the case is slated for 12/11/18, while the
Pretrial shall be on 6/12/18.

Why teachers should just reject the Government’s housing scheme; Details

Affordable housing is one of President Uhuru kenyatta’s big four agenda; others being Enhancing Manufacturing, Food Security & Nutrition and Universal Health care. The housing scheme has already been given a green light by the president, when he signed the 2018 Finance act, recently. Under the Affordable housing scheme, employees will contribute 1.5 percent of their monthly basic salaries towards the National Housing Development Fund while the employer tops up with an equal amount; provided that the sum of the employer and employee’s contributions do not exceed Kshs. 5,000 per month.

The Deputy President (H.E William Ruto), while addressing the Kenya union of Post Primary Education Teachers (KUPPET) delegates on Saturday 15th December 2018, defended the housing scheme saying: “We want to make it possible for a Kenyan with five thousand shillings to have a mortgage (where they pay Ksh. 5,000 per month) and in fifteen years or twenty years, instead of paying rent of five or ten thousand (monthly) the house becomes yours.” This means that for one to own a house under this scheme he/she will have to wait for a whooping 15 years! This is not, definitely, a good deal for teachers whose payslips have already been raided by the marauding Monster; the AON-Minet Medical insurance scheme. Teachers are also staring at a loss of 7.5% of their salaries to a proposed contributory Pension scheme. In the scheme, the employee will contribute 7.5% of his/ her monthly earnings while, the employer tops it up with 15%. This scheme, to be effected next year (2019), is mandatory for all employees joining the service and all those below 45 years.

According to the finance bill of 2018, a contributor will have to wait for a minimum period of fifteen years before the fund matures. “For employees who qualify for affordable housing, the contributions accrue to the employee and shall be used to finance the purchase of a home under the affordable housing scheme (upon expiry of the fifteen years from the date one starts to make contributions),” reads the 2018 finance bill, in part. The sad part is, if one does not qualify for the housing unit or retires before the expiry of the fifteen years such an individual will either transfer the accrued sum to a pension scheme or receive the contributions in cash. When the contributions are to be paid in cash they shall be included in the contributor’s taxable income for that year and be subjected to tax; at the prevailing rates. This is a big rip off, that is distasteful!

According to the Deputy President (DP), teachers will be the ‘biggest’ beneficiaries of the housing scheme.  “In fact, the biggest beneficiaries of our housing scheme will be the teachers of Kenya; I dare to say and you will poof me right one day. (This is) because you are the people in the middle class,” said the DP. This was met with protests from the delegates who expressed their dissatisfaction; forcing the DP to say that the government was ready to engage the teachers further. “And that is why, Mr Secretary general (KUPPET’s Akello Misori) we are willing , we are ready, to sit down and engage with you on behalf of KUPPET  and the teachers of Kenya. So that you can understand how this housing plan will benefit the teachers of Kenya,” said the DP. This caused, further, wild protests from the delegates. “We want to commit that even if it means we isolate part of this housing plan specifically for teachers, we will do that. Even if it means that we re-invent part of of this plan to belong specifically to teachers, we are willing to go that direction. Because you people (teachers) can see directly how your 1.5% (contribution) is going to benefit you,” the DP added.

The teachers’ unions are already opposed to the way this housing plan has been formulated and are asking the government to engage them in talks; on the way forward. On Thursday, the Kenya National Union of Teachers’ (KNUT) delegates made their intention clear on the housing scheme. The delegates, attending their Annual Delegates Conference at the BOMAS in Nairobi, shutdown the Principal secretary (to the Ministry of Transport, Infrastructure, Housing and Urban Development), Mr. Charles Hinga Mwaura, when he stood to highlight on the scheme. The angry delegates did not give Mr. Hinga time to even introduce himself. A frustrated Mr. Hinga insisted that the Contributory Housing Scheme will be implemented as planned, amid shouting from the disgruntled delegates. KNUT’s Secretary General, Hon Wilson Sossion, has already warned of industrial action if the deduction is effected. This shows the gravity and anguish attached to the housing scheme.

Also opposed to the Housing scheme is the Secretary General to the Central Organization of Trade Unions (COTU), Mr. Francis Atwoli. Similarly, during their Annual Delegates’ Conference (yesterday), KUPPET General Secretary (Mr. akello Misori) said teachers are strongly opposed to this housing scheme, as currently constituted. “Your excellency (the Deputy President), I do not want to forget this. There is a new legislation which require teachers or workers of this country to fund housing to the tune of 1.5% . We are apprehensive, because we feel that will do well with a mortgage, for professionals like us. But, the process of having this 1.5% is going to hurt us,” Akello told the deputy president.

Mr. Akello says if no talks are held between the union and the government, then they will call for industrial action from the members. “We will wish to ask a re-looking to this policy and therefore, the matter taken back to parliament. Currently, teachers are on loans, huge ones. Some of them do not earn,” added Misori. He further noted that further deductions from teachers’ payslips will leave them with no option than venturing into side hustles; to raise an extra coin.

The DP in his address, yesterday, indicated that most teachers do not have decent housing units and hence will be the biggest beneficiaries to the new housing scheme. Wherever the Deputy President got the statistics from, one wonders! For your information, Mr. Deputy President Sir, most teachers own houses; decent ones. Secondly, with the coming of delocalization teachers will definitely continue staying in rental houses. A mortgage can do better as at now, for the teachers.

Fast forward, a good government is one that listens to her workers. If pertinent issues have been raised against the housing scheme and even the AON medical scheme, by teachers, then the government is obligated to amicably solve these biting concerns. Having knee jerk decisions and forcing unpalatable policies on workers is quite unfortunate and uncalled for.

A top critic of Uganda President Yoweri Museveni has been jailed for writing a poem describing the Head of State’s private part. Ugandan university lecturer, Stella Nyanzi who has threatened to strip naked in the recent past shared the poem on her Facebook Status.

She has been sentenced for the crime of cyber harassment and offensive communication.

PRESS BRIEF: FOREST FIRE SITUATION AS AT 2/3/2019

Today aerial surveillance over Mount Kenya was undertaken and heavy rains were observed on the Southern side of the Mountain covering Castle forest in Kirinyaga thus
effectively putting off fires at this part of the forest. Fire is still very active in Chogoria
heading towards North West. Fire fighting teams were observed employing ‘back firing tactics in spirited efforts to contain the fire.

Forest fires in Ndaragwa, at Kamiruri area have successfully been suppressed by KFS and Community Forest Association (CFA)
teams.

In Geta forest, fire is still active at Sofia area at the steep gradients. Close to one hundred members of the CFA and KFS staff are still at the site fighting the fire.
The Shamata/Satima forest fire is still very active and burning towards Central moorlands of Aberdare. Monitoring of the fires is closely being done with the National and County Administrators. Cabinet Secretary Ministry of Environment and Forestry
Keriako Tobiko, has spoken about the need to allocate adequate resources to deal with
forest fires which are an annual occurrence. He was speaking at the Wangari Maathai
Day held at City Park today.

Elsewhere in North Rift Conservancy, fire was spotted in Chororget private farms along Kerio valley escarpment approximately over 10 kilometers from Penon Forest station with the wind blowing smoke to Penon forest. Residents who intend to burn any
vegetation in any areas adjacent to the forest have been warned that they need to give forty eight (48) hour’s written notice to the nearest Kenya Forest Service Office

Former Zimbabwean president Robert Mugabe dies; President Uhuru eulogizes him as an ‘elder statesman’

Zimbabwe’s founding leader Robert Mugabe has passed away at 95.
The Former Zimbabwe president, who reigned in power from 1980-2017 ,died in a Singapore hospital on Friday Morning 6th Of September 2019.

His death was confirmed by the Zimbabwean president Emerson Mnangagwa. “It is with the utmost sadness that I announce the passing on of Zimbabwe’s founding father and former President, Cde Robert Mugabe,” a post on Mnangagwa’s official presidential Twitter account said.

Mugabe, who ruled the southern African nation for nearly four decades since independence from Britain in 1980, was forced to resign in November 2017 after an army coup.

“On behalf of the Government and the People of the Republic of Kenya and on my own behalf, I wish to convey our deepest sympathies and condolences to the Government and the People of the Republic of Zimbabwe following the death of former President Robert Gabriel Mugabe.

In this moment of sorrow, my thoughts and prayers go out to his family, his relatives and the people of Zimbabwe who, for many years, he served with commitment and dedication. Words cannot convey the magnitude of the loss as former President Mugabe was an elder statesman, a freedom fighter and a Pan-Africanist who played a major role in shaping the interests of the African continent.

Indeed, we will remember former President Mugabe as a man of courage who was never afraid to fight for what he believed in even when it was not popular.

To his family, the Government and the people of Zimbabwe, may the Almighty God comfort you and may the soul of former President Mugabe rest in eternal peace.”

Brutality at its best! DCI arrests gang caught on camera assaulting man (Video)

Four suspects caught on video assaulting a Man have been arrested by detectives from the Directorate of Criminal Invetsigations and placed in lawful custody. The four are part of a gang that beat up the man identified as Lloyd Mango. The four assailants are: Mr. Robert Momanyi, Mr. Collins Neriko, Mr.Stanley Rimbere and Mr. Stephen Kimeu. Three others-who are at large-are being sought DCI Detectives. To be charged on Monday.

The complainant recorded his statement after being issued with a P3 Form. Further investigations are underway to arrest the other suspects who are still at large.

Latest Fuel Prices review- Patrol, Diesel up as Kerosene drops marginally

Motorists will now dig deeper into their pockets to fuel vehicles. This is after petrol prices went up in the latest review by the Energy Regulatory Commission, ERC. Super Petrol and Diesel increased by KES 3.07 and KES 0.9 respectively. It is a slight reprieve for Kerosene users after its price was decreases by KES 0.34 a litre.

The new pump prices will be effective for the next one month; up to 15th July, 2019. In Mombasa for example Super Patrol, Diesel and Kerosene will trade for KES 112.45, 102.13 and 101.65 respectively.

KRA Puts measures to fight against corruption, improves revenue collection

The Kenya Revenue Authority, KRA, has put a raft of measures to fight against corruption. The measures saw the tax man to record an enhanced revenue collection from Kshs. 1.365 trillion in the 2016-2017 financial year to Kshs. 1.435 Trillion in the 2017-2018 financial year. This is one of the many successes that KRA has recorded this year. Increased compliance by Taxpayers , Improved service Delivery  and Reduced face-to-face contact between KRA staff and taxpayers are other successes that the Tax Man takes pride in.

To fight corruption, KRA has embraced Information and Communication Technology,  ICT ,and other innovations to fight corruption. These innovations are: Integrated Customs Management System (iCMS); Automation of registration, filing and payment of taxes through the iTax Platform; Regional Electronic Cargo Tracking System (RECTS); Installation of command center’s in Mombasa and Nairobi (iScan); Installation of smart gates at the port of Mombasa; Customer Relationship Management System to enhance customer experience and service delivery (iCare) and activation of Gap Analysis on iTax to detect mismatch of invoices.

 

National Hospital Insurance Fund, NHIF, introduces new changes for members

The National Hospital Insurance Fund, NHIF, has introduced a raft of measures on management of the fund. In the new changes, new members will have to wait for a period of three months up from the current two months. The number of spouses has been capped at one with only five kids (dependants) benefiting. The new changes took effect on January 1, 2020.

“In order to align the organization towards attainment of sustainable Universal Health
Coverage and for purpose of enhancing member retention, the Special Full Board Meeting of 17th December 2019 resolved that the following changes be effected in Member Management Module with effect from 1 January 2020:

  • Revision of the waiting period for new voluntary National Scheme members from current 60 days to 90 days and to introduce a 1 year (12 months) upfront payment, payable within the waiting period while observing the due dates, before one can eligible for any
    of the benefits.
  • Penalty on defaulting beneficiaries to stand at 50% of the monthly contribution for each month paid late, up to 11 months, coupled with requirement to pay for one year in advance and a restriction of 30 days before being eligible for benefits.
  • In case of default for 12 months and above, the affected member will start payment afresh and be eligible for benefits after 90 days from the date of resumption of payment in addition to a 1 (one) year (12 months) upfront payment, payable within the waiting period while observing due dates otherwise rule number 2) above, will also apply.
  • For Voluntary Members access to maternity benefit be restricted to 6-months post card maturity for principal members or spouse declared at the point of registration.
  • For both Maternity and Specialized Services, any dependent declared after initial registration shall be subjected to a 6-month waiting period after such declaration with exception of newborns who shall be considered eligible for benefit provided they are declared within 6 months from the date of birth.
  • For medical inpatient and medical outpatient additional dependents shall be eligible for benefit after 30 days waiting period. This waiting period of 30 days will also apply in case of change of spouse.
  • Eligibility to access to Specialized Services shall be restricted to 6-month wating period following card maturity for new members, while for defaulters, there shall be payment of all penalties and 1-year upfront payment of contributions coupled with a 30-day waiting period thereafter.
  • For National Scheme members, number of dependents per card to be limited to a maximum of (1) one spouse and (5) five children. For Managed scheme it will be capped at M+6 and M+1 for normal and retiree schemes respectively.

Additional dependents can be included subject to payment of additional premiums to be communicated after actuarial valuation.

SPARED MEMBERS

The above changes on Member Management should exempt the following Government funded programs that targets vulnerable groups:

  •  Health Insurance Subsidy Program
  • Free Maternity Program (Linda Mama)
  • Elderly Persons with Severe Disabilities
  •  Inua Jamii Program

Please communicate these changes to the declared Health Care providers in your
jurisdiction and explain to them that the same will be observed when processing claims.”

Kindly note that specialized services, in this context, means all services except for medical in-patient and medical out-patient.

President Magufuli orders the Army to buy all cashew nuts

Tanzanian President, John Pombe Magufuli, has ordered the country’s army to buy all cashew nuts from farmers, immediately. This comes after the cashew nut dealers failed to buy the produce from farmers. The government had, last week, issued a four day ultimatum to the dealers to buy the cashew nuts. But, the farmers refused to sell the produce to the dealers citing low purchasing prices.

Yesterday, Monday 12th November 2018, the no nonsense Tanzanian President, Magufuli, said that the government will purchase all cashew nut stocks directly from farmers at a TShs. 3,300 per Kilogram. The Government will use its military instruments and the Tanzania Agricultural Development Bank (TADB).

The latest move has left the dealers in anguish since they have already hired labour services, warehouses and even borrowed loans to purchase the cashew nuts.
