List of transferred, delocalized Head Teachers in Nyamira County; December 2019

The Teachers Service Commission, TSC, has effected the December 2019 delocalization exercise for school heads. A total of thirteen (13) head teachers have been moved in Nyamira County. The handing/ taking over exercise for the administrators is expected to be completed before schools open for first term on January 6, 2020.

Those moved are heads and principals and their deputies serving in their home counties and those who have served in the same station for a long period. Also on the move are new administrators who were appointed after the just concluded interviews .

Teachers with medical conditions have been spared from the ongoing delocalization exercise. Also spared are teachers aged above 56 years and those set to retire.

The Commission kicked off the delocalization exercise in January, 2018. Other massive deployments would then follow in April, August and December of the same year. Though in April, 2019 the Commission slowed down the transfers as only a handful administrators were moved.

TSC: Retirement Benefits/ Pension paid to teachers; when can a teacher qualify for pension and all you need to know about the current pension and the new proposed contributory pension scheme

THE CURRENT PENSION SCHEME:

The Pensions Act (Cap.189), the main Act, makes provisions for the granting and regulating the payment of pensions, gratuities and other allowances in respect of the public service for officers under the Government of Kenya.
According to the existing terms and conditions of service, officers in the public service expect terminal benefits in accordance with their letters of appointment, as an incentive for the services they render to the country for a number of years of their working life.

Paragraph 4 of the Letter of (Probationary) Appointment in the service of the Government of Kenya, Form G.P. 24 (Revised) reads as follows:-
“If you are confirmed in your appointment, you will be eligible on retirement for retiring
benefits in accordance with the provisions of the Pensions Legislation of the Public Service
of Kenya”.
An officer who has rendered pensionable service to the Government of Kenya expects the payment of retirement benefits in accordance with the provisions of the Pensions Act. The benefits in question are non-contributory or free. In other words, the officer does not have to contribute a part of his salary in order to secure rights to retiring benefits.
In accordance with the provisions of the Pensions Act (Cap.189) Civil Servants or their dependants may be paid, on leaving the service of the Government and on fulfilling certain conditions, one or more of the following benefits:

• Service pension plus commuted pension
• Service gratuity
• Marriage gratuity
• Injury pension
• Death gratuity
• Dependants pension
• Compassionate gratuity
• Annual allowance

1. Service pension plus commuted pension

Calculation of the officer’s pension and maximum pension – Regulation 4
Having ascertained the officer’s particulars on eligibility for pension – the pension due to
him is calculated by taking one-four hundred eightieth of the final pensionable emoluments
for each completed month of pensionable service, subject to a maximum of the highest
pensionable salary drawn by the officer in the course of his service.
(Completed month x annual salary) / 480

Therefore, an officer with ten years’ pensionable service, with final salary of K£1000-0-00
cts p.a., would be eligible for a pension calculated as under.
10 years x 12 months x K£1000-0-00cts p.a./ 480
= K£250 per annum

An officer may prior to the date of retirement, elect to receive three-quarters of his annual
pension and to receive in lieu of the other one-quarter, a lump sum gratuity equal to twenty
times its amount. He would thus receive a reduced pension and a gratuity in lieu of full
pension.
If in the case quoted above, the officer elected at the time of retirement, to receive a reduced pension and to commute a quarter of his pension, his dues would be worked out as follows:-
Unreduced pension as worked out above
= K£250 per annum
or Reduced pension = ¾ x K£250 per annum
= K£187.5 per annum
together with a commuted pension gratuity
= ¼ x K£250 x 20
= K£1250 payable in lump sum
on retirement.
Death Gratuity 2 x £1200 = £2400

2. Service gratuity

Calculation of gratuity where 10 years qualifying service is not completed – Regulation
5:
An officer who retires from the service in circumstances entitling him to a pension before
completion of the necessary 10 years qualifying service is eligible for a gratuity at the rate
of 5 times the annual amount of the pension, which if there had been no qualifying period,
might have been granted to him. Thus for 8 years pensionable service the gratuity payable
to an officer whose emoluments amounted to K£1200 p.a. would be:-
8 years x 12 months x K£1200 x 5 = K£1200.00/ 480

An officer who has retired from the service with less than 10 years qualifying service on
account of injuries received on duty or an abolition or re-organization grounds, has an
option for either the gratuity as calculated in this paragraph, or a pension calculated as in
paragraph 1 above.

3. Marriage gratuity – Regulation 6:
A female officer who resigns from the service on or with a view to marriage or who is
required to retire on account of marriage and has completed at least 5 years service under
the Government, having been confirmed in a pensionable office may be granted a
marriage gratuity on production of satisfactory evidence of her marriage within six months
of her marriage or retirement at the rate of one-twelfth of a months pensionable emoluments for each completed month of pensionable service, subject to a maximum of one year’s pensionable emoluments.

Mainly TSC Female Officers

(i) Thus, an officer who has done 10 years pensionable service on a salary of K£1200
p.a. would be eligible for a marriage gratuity calculated as follows:-
K£1200 x 10 years x 12 months/ 144  = K£100

(ii) However if the officer had done 15 years pensionable service on a salary of K£1200
p.a., she would be eligible for a marriage gratuity calculated as follows:-
K£1200 x 15 years x 12 months/144  = K£1500,

But limited to one years salary i.e. K£1200

4. Injury pension

Calculation of service gratuity for Police, Prisons, A.P. and Forest Guards –
Regulation 26
This gratuity is calculated at the rate of one month’s pay for each complete year of service.
(i) Thus an officer who has done 12 years service and resigns voluntarily on completion
of 12 years service on a salary of K£531 p.a. would have his service gratuity
calculated as follows:-
K£531 x 12 years/ 12 = K£531

(ii) If he had done 16 years or 20 years service, his service gratuity would be:
K£531 x 16 years/12 = K£708

(iii) K£531 x 20 years/12 = K£885

5. Death Gratuity – Section 18
A death gratuity of an amount not exceeding TWICE the amount of a deceased
pensionable officer’s annual pensionable emoluments or his commuted pension gratuity
whichever is the greater is payable to the legal personal representative of the officer.
Where an officer who has retired from the service of the Government dies immediately
thereafter, a death gratuity equal to the difference between what has already been paid to
him by way of commuted pension gratuity and monthly pensions on the one hand; and what should have been paid as death gratuity had he died on the day of his retirement, would
become payable to his legal personal representative.
Pensionable Emoluments = £1200
Commuted Pension Gratuity = ¼ x K£250 x 20
= K£1250 payable in lump sum
on retirement.
Death Gratuity 2 x £1200 = £2400

6. Pension to Dependants on the Death of Officer in service of retirement – Section 17

When an officer who has had ten or more years’ service dies after he has retired from the
service of the Government having been granted a pension under the Pensions Act, a
dependants’ pension to the widow or the children of the officer is payable for a period of
five years at the rate of the officer’s pension at the date of his death. The dependants’
pension is also paid to the widow or children of the officer in case where a pensionable
officer who has served the Government for ten or more years dies while in the service.
Otherwise, if there are no dependants pension ceases on the date of death.
Pensionable Emoluments = £1200
Unreduced Pension = 10 x 12 x 1200/480
= £300
Dependant’s Pension = £300 but for 5 years only

7. Dependants’ Pension or Killed on duty pension – Section 19:

A pension becomes payable to the widow and/or children of an officer who dies
Ø as a result of injuries received in the actual discharge of his duty;
Ø without his own default and
Ø on account of circumstances specifically attributable to the nature of his duty.
The widow’s pension is payable to her while she remains unmarried and of good character
at the rate of 10/60ths of the officer’s pensionable emoluments at the date of his injury or
death. The pension payable to each child is at the rate of 1/8th of their mother’s pension,
subject to a maximum of 6 children.
Pensionable Emoluments at injury = £1200
KID Dependant’s Pension = 10/60 x £1200
= £200
Children = 1/8th x £200 = £25

8. Injury Pension – Regulation 25:
An officer who is permanently injured in the same circumstances referred to in para. 7
above i.e.
Ø as a result of injuries received in the actual discharge of his duty;
Ø without his own default;
and
Ø on account of circumstances specifically attributable to the nature of his duty.
will in addition to any gratuity or pension awarded to him under regulation 4 and 5 of the
pensions Regulations also receive an additional injury pension proportionate to his
pensionable emoluments at the date of his injury at the following rates:-

Ø Reported immediately to the Director of Pensions (except Workmen’s Compensation)
Ø Appear in person before a medical Board of 3 persons
Ø As soon as possible after the injury

9. Pension on Abolition of office or Re-organization of Ministry or Department: Regulation 24
An officer who is retired because of abolition of his office or reorganization of his Ministry
or Department is eligible for a pension or gratuity at his option, even though he may not
have completed the necessary ten years qualifying service.
He is also eligible for an additional pension at the rate of one-sixtieth of his pensionable
emoluments for each completed period of three years’ pensionable service, the additional
pension being limited to ten-sixtieths of his pensionable emoluments, and together with the
remainder of his pension to the pension for which he would have been eligible if he had
continued until the age of 55 years to hold the office held by him at the date of his  retirement having received all increments for which he would have been eligible at that
date.

Calculation
Pensionable Emoluments = £1200
Pension under Reg. 4
10 years x 12 months x K£1200-0-00cts p.a./480

= K£300 per annum
Additional Pension = 1/60 x 3* x 1200
= £60
* 10 years = 3 periods of 3 years completed
Total Pension = £1260

10. Compassionate Gratuity – Regulation 28
An officer who is not eligible for a pension, either because he is a holder of a non pensionable office, or a holder of a pensionable office in which he has not been confirmed,
and who being a male officer was appointed or transferred to the service of the Government before 1st April 1966, and being a female officer was so appointed or transferred before 1st January 1977, is eligible for the grant of a compassionate gratuity at the rate of one-twelfth of a month’s pay as at the date of retirement for each completed month of service.

NB: NSSF came into effect 1966 and non-pensionable officers since then are covered
under NSSF. Hence this award is being phased out. IN addition, these officers are
expected to be covered under the new scheme.
To qualify for a compassionate gratuity an officer should have
• served for not less than 10 years if he retires on age grounds, and for
• not less than 7 years if he retires on the grounds of ill-health;
• public interest;
• abolition of office or re-organization.
Illustration: Thus an officer who has served for 25 years and leaves the service on age
grounds at a monthly pay of Kshs.885/= would have his compassionate gratuity calculated
as follows:-
1/12 of Kshs.885 x 25 years x 12 months
= Kshs.22,125/=

11. Annual Allowance: Regulation 28(3)
In addition to the compassionate gratuity already granted to him, an officer who has been
in the public service for not less than 30 years and whose salary on retirement is not more
than the maximum salary payable for the time being to officers serving job Group “B” may
be granted an annual allowance of Kshs.1200/= or KShs100/= per month.

12. Maintenance Allowance – Section 14 (Bankruptcy) and 15 (Conviction-18 months)
This is an allowance payable to the family (wife and/or children) of a pensioner following
the cessation of his pension on bankruptcy or imprisonment by a competent court for any
offence. It is normally equivalent to the pension that was being earned by the pensioner
at the time the pension ceased, but it may be less at the discretion of the President (i.e.
Director of Pensions).
Presidential pardon required in order for the pension to be reinstated once out of prison or
the bankruptcy ruling is lifted. Given personally by the President.

PENSIONS SCHEMES FOR MEMBERS OF THE TEACHERS SERVICE
As you are probably aware, a Free Pensions Scheme was introduced for the members of the African Teachers Service with effect from 1st August, 1962 vide Education Circular No.3 of 1962 dated 18th October, 1962. All teachers, who were then contributing to the African Teachers Service Contributory Pensions Fund (ATS) were provided with four options as under:-

OPTION (A)
Teachers were to elect to come on to a Free Government Pension Scheme back-dated for
the period of their previous contribution, in which case they would forfeit their rights under
the contributory scheme.

OPTION (B)
They were to choose to retain their rights under the present scheme in respect of past
contributions and to transfer to the new scheme for a date agreed, in which case the Free
Pension will not be back-dated.

OPTION (C)
They were to continue under the present scheme, which would mean continuing to
contribute 1/2% of the teacher’s salary and the employer continuing to contribute 1/2%.

OPTION (D)
They were to elect to come on to a free pension scheme and to withdraw the teachers’
contribution plus interest to the present scheme, at a time and on a basis to be agreed
between the Government and the Union.
All contributors to the African Teachers Service contributory Pensions Fund were given
copies of the Education Circular No.3 of 1962 dated 18th October, 1962 and were required
to elect only one of the four options given.
Following the issue of the Circular it was agreed as follows:-
(i) Teachers who were contributors to the Provident Funds prior to 1st January, 1956
when the African Teachers Service Contributory Pensions Fund was established,
and whose past contributions were handed over to the Pensions Fund and who
continued to contribute to the new Fund from that date, would be eligible for a
refund of their own contributions and their employers’ contributions plus interest on
both.
(ii) Those who did not qualify for the refund of their employers’ contributions – this
group comprised teachers who joined the Pensions Fund from 1st January, 1956 and
thereafter the first time and those who returned to teaching after a break in service –
would receive the benefit on one-third (1/3) service for pensions computation
under the Pensions Regulations (Cap.189). The one-third service applied only to the
contributory service, between 1st January, 1956 and 31st July, 1962.

A vast majority of the contributors opted to withdraw their contributions under Option (D).
Following the receipt of the option forms it was decided that the refunds would be made in
two instalments. Refunds were of two categories. One consisted of Teacher’s contributions
and Employer’s contributions plus interest on both and the other, Teacher’s contributions
plus interest only.

EFFECT OF OPTIONS CHOSEN
Those who withdrew their own and their employers’ contributions plus interest, their
contributory service and any other previous service would not count as pensionable
service. Only service from 1st August, 1962 to the date of retirement would count as
pensionable service. This would mean that by receiving the employers’ contributions in
addition to their own, they lost their previous service for a pension under the Pensions
Regulations (Cap.189).

Those who withdrew their own contributions but not their employers’ the period of their
contributory service would count as to one-third 1/3 as pensionable service and service
from 1st August, 1962 to the date of retirement would count in full as pensionable service.
Any service prior to the contributory service would not count as pensionable service under
the Pensions Regulations (Cap.189).
As regards options (A), (B) and (C) the position was different.

OPTION (A)
Teachers were not eligible for a refund of the contributions. They just surrendered their
contributions including those of the employers to the Government so that in the event of
their retirement from the Teachers Service they would enjoy a pension based on the
following pensionable service.
(i) Non-contributory service i.e. service before the contributory service would count in
half as pensionable service.
(ii) Contributory service would count in full as pensionable sfrvice.
(iii) Service from 1st August, 1962 to the date of retirement would count in full as
pensionable service.

OPTION (B)
Teachers were not eligible for a refund of the contributions unless they left the service
before being pensionable. They just retained their rights under the African Teachers
Service Contributory Pensions Scheme as at 31st July, 1962 and transferred to the Free
Pensions Scheme from 1st August, 1962 so that in the event of their retirement from the
service they could enjoy two pensions:-
(i) One calculated in relation to the contributory service as at 31st July, 1962 under the
Pensions fund Regulations (Cap.212).
(ii) The other calculated in relation to the service from 1st August, 1962 to the date of
retirement under the Pensions Regulations (Cap.189).
Calculations of the two pensions were not similar and the total pension would be less than
the pension one could earn under Option (A).

OPTION (C)
Teachers were not eligible for a refund of the contributions unless they left the service
before being pensionable. They opted to continue to contribute to the African Teachers
Service contributory Pensions Fund and thus were liable to the continued payment of 1/2% of the teacher’s salary until the date of retirement, the employer continued to pay 1/2% until the date of retirement.
Unlike options (A), (B) and (D) where the teachers could opt to retire on pension after
attaining the age of 50 years, teachers with Option (C) could only retire on pension after
completion of 30 years of qualifying service or attaining the age of 55 years. The pension is
calculated on a different basis and is related to the contributory service. The pension rights
are governed by Pensions Fund Regulations (Cap.212). The Pension under Option (C)
would be less than it would be under either Option (A) or Option (B). In short, option (A)
was the best of all in so far as the retirement pension was concerned.

GENERAL CONSIDERATION AND CONDITIONS
Forfeiture of Pension Rights on Resignation or Dismissal
An officer who resigns except with a view to marriage in the case of a woman officer, or on
attaining the retiring age, forfeits all claims to the retiring benefits. Similarly an officer who
is dismissed from service forfeits all claims to pension, etc.
Pension is not a Right
No officer shall have an absolute right to compensation for past services or to pension,
gratuity or other allowance.
Reduction or Withdrawal of Pension
Where it is established that an officer has been guilty of negligence, irregularity or
misconduct, the pension, gratuity or other allowance, may be reduced or altogether
withheld. However, the approval of the Public Service Commission must be sought. This is
under the Constitution of Kenya.

Pension to Cease on Conviction

Where any person to whom a pension or other allowance has been granted under the
Pensions Act is sentenced to a term of imprisonment by any competent court for any
offence, such pension or allowance may be stopped. Any part of that pension or other
allowance may be paid to or applied for the maintenance or benefit of, his dependants in the manner laid down in section 13 of the Pensions Act.
Pension to Cease on Bankruptcy
Where any person to whom a pension or other allowance has been granted under this Act is adjudicated bankrupt or is declared insolvent by judgement of any competent court, then
such pension or allowance may be paid to, or applied for the maintenance or benefit of, his
dependants in the manner laid down in section 13 of the pensions Act.

Transfer of Service
This is possible only where the organization to which an officer wants to transfer his
services from the Government has been declared for the purposes of Kenya Pensions Act to
be “Public Service”. Ann officer transferring to “Other Public Service” enjoys the privilege
of having his pension rights with the Government “preserved” or “kept in cold storage” for
the duration of his service with that “Other Public Service”. In the event of his retirement
from that other service in circumstances permitted by that service, the officer will have his
benefits in respect of his service with the Government calculated separately and paid to him.

Service on Contract Terms:- Paid under the C.O.R.
Counts in full if the officer serving on those terms was being paid on a salary scale
applicable to members of the permanent establishment and if he surrendered the gratuity
earned under the contract, having been admitted without a break of service to the
pensionable establishment.

Service on Provident Fund Terms:- CAP 191
In respect of an officer who was in the service prior to 1st January, 1954 counts in full in
calculating a pension or gratuity provided that he was admitted, without a break in his
service, to the pensionable establishment, and he surrendered his own contribution to the
provident fund for the period in question.

Determination of Age – Regulation 23:
Since the earliest age acceptable for pensionable service is 18 years, and the minimum age
at which a person can be allowed to retire on age grounds is 50 years, there should be a
system of determining the age of an officer on first appointment. The age recorded in the
Application of Employment forms PSC 2 and verified at the time of the officer’s
appointment is taken as the correct age. Any alteration to this age must be, supported by the production of a birth certificate. Application for a certificate must however be routed
through the head of department who must vouch for the correctness of the age given in the record of service.

The Proposed Contributory Pension Scheme:

The government proposes a public servants superannuation scheme.

  • This is a defined pension benefit scheme where both the employer and the employee contribute certain proportions towards pension benefits.
  • It is mandatory for those joining service and those below 45 years.
  • Those above 45 years can opt to join.

Benefits of the proposed contributory Pension scheme

An employee can transfer pension benefit credits from a former employer to another with a similar Pension scheme.

  • The scheme allows employees to access part of their benefits even before the mandatory retirement age.
  • Teachers joining the scheme from non-contributory pension scheme will have their past benefits transferred to the new scheme.
  • Widows and Children’s Pension Scheme (WCPS) and NSSF contribution will cease immediately an employee joins the scheme.
  • Those who remain in the free Pension Act will be bound by the provision of the Pensions Act cap 189.

Good news for teachers as TSC moves to provide them with Work Injury Insurance

The Teachers Service Commission, TSC, is set to provide Work Injury Insurance to all teachers in Primary and Secondary Schools; employed by the Commission. The over 321 teachers now have a reason to smile as the Commission has advertized for tender bids to firms who would provide insurance against workplace related injuries. This will be good news more so to teachers handling Practical based subjects (science) who are highly susceptible to injuries and diseases; arising from the chemicals and equipment that they handle

Duration of Cover

According to the tender papers released by the Commission, the successful insurer will provide insurance services for three years; From January 1, 2020 to January 1, 2023. “The Administration Service will run for the twelve (12) months effective 1st January, 2020. The service/contract may be renewed for the next two years’ subject to satisfactory performance,” read the tender papers; in part.

Deadline for Submission of Tenders

Interested tenders are expected to make their bids not later than Wednesday 20th November 2019 at 9.00 am

What the Insurer will do

 Assess all work injury benefits claims lodged at the Commission, show due diligence and advice appropriately.
 Ascertain the legibility of individual claims.
 Investigate WIBA claims.
 Refer claimant for re-assesment to a panel of doctors appointed by the administrator where the assessment does not meet the criteria set as per the WIBA Act 2007.
 Coordinate with Medical Service providers and Administrator while investigating and authenticating treatment related to injury for the claimants.
 Advice the funds custodian (TSC) on amounts payable for compensation as a result of bodily injury and occupational illness.

Benefits Payable

Teachers will now get the following benefits:

1) On Fatal Accident: WIBA (Work Injury Benefit Act) During the period of cover, existing TSC Teachers and any additional teacher joining TSC will be covered. Benefits to be provided as per the provisions of the WIBA Act (2007).
2) On bodily injury: As provided for in the Act on occupational diseases.
3) On Occupation Illness: As provided in the Act.

Beneficiary Nomination:

Each member of TSC will nominate one or more Beneficiaries as recipients in the event of death. These, generally called the next of kin, will get compensation amount from TSC as may be determined.

What is an “accident”- means an accident arising out of and in the course and scope of an employee’s employment and resulting in personal injury;

Obligations Of Employer

Every employer must obtain and maintain an insurance policy, with an insurer approved by the Minister in respect of any liability that the employer may incur under this Act to any of its employees.

According to the Act, the following are covered:

  • Occupational Diseases; Any ailment as a result of workplace related conditions like Science teachers who are exposed to hazardous reagents;

TSC: OFFENCES/ MISCONDUCTS THAT MAY MAKE A TEACHER TO BE REMOVED FROM THE TSC REGISTER/ Deregistered

A teacher may be deregistered/ removed from the Teachers service Commission, TSC, register for the following offences:

TSC now to issue promotion letters to 25,252 teachers; after resolving standoff with MPs

The Teachers Service Commission (TSC) has made a significant decision to promote 25,252 educators by waiving the prerequisite that requires teachers to serve a minimum of three years in a single grade prior to advancement.

According to the commission, 5,291 teachers were promoted despite not fulfilling the three-year service requirement. A substantial portion of these promotions involved appointments to principal and deputy headteacher positions, where the pool of qualified candidates was insufficient to meet the demand.

In a statement issued on May 22, the commission noted, “In the recently concluded promotion exercise, the number of teachers who satisfied the three-year requirement in the feeder grades was markedly lower than the number of available vacancies.”

This decision follows the allocation of Sh1 billion by the National Assembly to facilitate promotions, which addressed only 5,690 of the 25,252 vacancies.

The commission reported that 1,410 teachers were elevated to principal positions under Grade D3, while 3,686 were appointed as deputy headteachers under Grade C4. Notably, only 598 teachers had served the requisite duration to qualify for the 1,410 principal vacancies, whereas 7,460 met the criteria for the 3,686 deputy headteacher roles.

To mitigate the shortfall in qualified candidates, the commission temporarily reduced the service requirement to six months in a single grade.

The TSC clarified that this waiver was intended to attract a larger pool of applicants and to address the persistent issue of teachers occupying acting positions. “This policy decision facilitated the competitive filling of vacancies, particularly in arid and semi-arid regions where recruitment and retention have posed challenges,” the commission stated.

Among the 5,291 teachers promoted without meeting the three-year requirement, 3,427 were appointed to the critical administrative roles of principal and deputy headteacher. The commission has requested that all teachers promoted under this temporary measure be retained, emphasizing that the waiver was crucial for addressing significant staffing shortages.

Looking forward, the commission plans to develop and disseminate standardized promotion guidelines, which will be informed by public consultation with teachers, unions, and other stakeholders. This new framework will adhere to constitutional principles of equity, inclusiveness, and non-discrimination.

“The commission remains dedicated to ensuring fair and accountable processes in future promotions,” the statement concluded.

There has been considerable contention regarding the promotion criteria employed by the commission, with Members of Parliament expressing strong criticism. However, with the commission’s final determination regarding the promotion process, teachers can now find relief. The promotion letters that have already been prepared will be dispatched to the counties for collection by the successful candidates. The TSC is anticipated to release the final promotions list after removing 1,864 teachers from the initial list and making the necessary replacements.

  2019 started on a high note with a scuffle on School Heads’ transfers between the Teachers Service Commission (TSC) and the Kenya National Union of Teachers (KNUT) threatening to spoil the party. KNUT was opposed to a move by the TSC to transfer 3,094 heads of institution; some of whom were branch officials. TSC, had insisted that calls to revoke the transfers were futile as the moved head teachers and principals had already reported to their new stations; by first term opening date. Attempts by KNUT to call teachers to industrial action would then fall through since the teachers’ employer, TSC, had already threatened to ‘sack’ any teacher who will participate in the strike; and replace them immediately.

 In February, the Commission announced that it had axed 29 teachers for various disciplinary issues. TSC, gazetted 29 teachers struck off the Commission’s register. Via a gazette notice dated February 2019, the Commission said the teachers were de-registered between May and November, 2018. According to the TSC act, a teacher can be de-registered for either of the following reasons; When he/ she:
  • Dies
  • Obtains registration fraudulently
  • Has been convicted of a sexual offence or an offence against a learner
  • Has been convicted of a criminal offence which renders the person unfit to be a teacher
  • Is found unfit to teach following disciplinary proceedings
  • Suffers from physical or mental illness or infirmity which renders the person incapable of performing the duties of a teacher.
 
  August was a month of gloom and anguish for mostly KNUT members. The Commission prepared two parallel payrolls; for KNUT members and other teachers. Whereas non-KNUT members got their phase three of the Collective Bargaining Agreement (CBA), for KNUT members it was a different story. This is because the Labor and Relations Court had ordered that their (KNUT Members) terms be based on the Schemes of Service and not Career Progression Guidelines (CPG).
 
  The Commission in the same month advertised 1,000 teachers in Primary schools who would be promoted to teach in high schools. With few days till end of the year, the would be applicants are yet to know their fate.
 
  September did not get better for mostly KNUT members. It was grief and pain for teachers who had disrupted the new Competency Based Curriculum, CBC, training in April this year. This is after their employer, the Teachers Service Commission (TSC), decided to dismiss some of them for disrupting the training.
 
  “Pursuant to the hearing of your discipline case held on 15/08/2019, I am directed by the Teachers Service Commission to inform you that the Commission has carefully considered your case and has determined that you are guilty of the charges leveled against you and that you are hereby dismissed with effect from 15/8/2019,” read, in part, a dismissal letter sent to one of the affected teachers.
 
  In May the Commission had interdicted 160 teachers, among them 10 KNUT officials, for boycotting and disrupting CBC training. The interdictions were effected on 5th May, 2019 and the teachers given 21 days to show cause why action could not be taken against them.
 
  In April there was temporary disruption of training sessions witnessed in parts of Kakamega, Kajiado, Makueni, Homa Bay among other counties. The interdicted teachers who had responsibilities were directed by TSC to vacate office with immediate effect. Efforts by the Kenya National Union of Teachers, Knut, leadership to have the decision rescinded were met by opposition from the Commission; with TSC Boss Dr. Nancy Macharia promising stern action.
 
  The Commission at the same time created a new user friendly portal for capturing the teachers’ appraisal data. This saw the reduction in the number of teaching standards to be appraised for teachers from the previous seven to five on its online appraisal portal. The portal that intends to reduce bottlenecks in the current one is yet to be officially rolled out by TSC.  
 
  TSC would then (on Wednesday September 25, 2019) hold its first ever open teachers’ day in selected venues countrywide. During the event, schools and teachers who posted good results in academics and Co-curricular activities were feted. The Theme for this year’s day was; TSC INTEGRATING TECHNOLOGY & INNOVATION FOR QUALITY TEACHING.
 
  And the sacking spree (for teachers caught on the wrong side of the code of conduct) would continue. TSC sent home another 36 teachers suspected to have breached the code of conduct for teachers. The list of all male teachers was posted on the TSC website in October, 2019.
 
  But, all was not lost for teachers as recognition for their good work would continue in the World Scene. First, it was teacher Peter Tabichi who won the $1 million Varkey Foundation Global Teacher Prize at a star-studded event in Dubai on March 24, 2019. Then came Asumbi’s Eric Ademba, a mathematics and chemistry teacher who was presented with the African Union Continental Teacher Award for outstanding performance, a first of its kind. Wednesday October 23, 2019 would be the day to remember for teacher Ademba.

  Hope the new year brings more good news to teachers and worthy reforms in the education sector.
 
  This year the Commission has recruited a total of 16,979 on permanent basis to bridge the teething shortage in public schools. Also recruited this year are about 10,000 teacher interns who will report to their stations in January, 2020. A total of 16,113 teachers will count themselves lucky since they received their promotions. Another 218,283 teachers have also been trained this year on the CBC.
 
  In 2020, close to 2,600 classroom teachers will report to new stations after receiving their transfer letters. Also moved are some 1,010 principals in secondary schools across the 47 counties. 1,621 primary school head teachers will at the same time report to new stations in January, 2020.

KENYA UNION OF POST PRIMARY EDUCATION TEACHERS (KUPPET)

SUBMISSION TO THE NATIONAL ASSEMBLY COMMITTEE ON EDUCATION AND RESEARCH CONCERNING THE TSC ACT AMENDMENT BILL.

Short title Proposed amendments
1 Amend to include “after negotiations with
the Unions shall”
2. The Teachers Service Commission Act, in this Act referred to as the ‘Principal Act’ is amended in Section 11 by inserting the following new paragraph immediately after paragraph (f).
(fa) “in consultation with the Salaries and Remuneration Commission and after negotiation with the unions shall facilitate   payment   of   allowances   to   teachers   in   the
manner set out in the Fourth Schedule.”
2 3. The Principal Act is amended by inserting the following new Section immediately after Section 32.
32A. (1) The Commission may appoint a teacher in an acting capacity for a period of at least thirty days but not exceeding a period of six months.
After the six months, the teacher shall be confirmed substantively into the position.
3 Amend to include, “or acting allowance,
whichever is applicable”
(4)  A  teacher  appointed  in  an  acting  capacity  shall  be entitled  to  special  duty  allowance  or  acting  allowance,
whichever is applicable.
4 FOURTH SCHEDULE
(This part provides for allowances that may be granted to teachers in specified circumstances. The remunerative and    reimbursable    allowances    are    non-pensionable except   responsibility   allowance   if   earned   up   to   an

(1) The Commission shall pay Responsibility Allowance to a head of institution, deputy head of institution and senior teacher who are appointed into positions of

(a) pay special school allowance to a teacher who possesses skills in special education or who is teaching in a special school or integrated school.

(i) Transfer Allowance
The Commission shall –
(a) where at its discretion transfers a teacher from a sub- county   to   another   or   in   inter-county   transfer,   pay transfer allowance to the teacher within one month of the
transfer.
Amend to Insert new clause (j) Acting Allowance
The Commission shall from time to time pay an acting allowance     to     a     teacher     appointed     to     perform administrative duties for which the teacher qualifies but
has not been substantively appointed.
(k) Per Diem/Subsistence Allowance
Amend to Insert new clause The  Commission  shall  from  time  to  time  pay  a  daily subsistence or per diem to a teacher who is assigned to perform  an  official   duty   outside  the  teacher’s  work station  at  the  prevailing  rate  for  public  servants  as determined     by     the     Salaries     and     Remuneration
Commission.
Amend to Insert new clause (l) Risk Allowance
The  Commission  shall  from  time  to  time  pay  a  risk allowance  to  science  teachers  who  handle  laboratory chemicals in the course of their duties.
Amend to Insert (m) Post-Graduate Allowance
The Commission shall from time to time pay a post- graduate allowance to teachers who have attained
Master’s and PhD degrees while in service.

Justifications of the Proposed Amendments to the Teachers Service Commission Amendment (TSC) Bill, 2024

1. Ensures Fairness and Equity in Salary Determination

When salaries and allowances are determined through collective bargaining with teachers’ unions, it creates a more objective and predictable system and provides a legal protection for teachers. This process allows for transparent negotiations over compensation, leading to enforceable agreements that provide stability for educators and their families. It also helps reduce arbitrary or unilateral decisions by the employer, ensuring fairness and equity across the teaching workforce. Negotiations based on mutual interest encourage joint problem-solving, leading to agreements that address the needs of both parties.

2. Ensure equity in allowances.

Risk allowance clause into the bill is a justified and necessary measure to address the real and present risks faced by teachers. It will not only improve their welfare and job satisfaction but also enhance the overall quality and stability of the education sector. Teachers are exposed to hazardous materials and they require the compensation. Teachers with post-graduate qualification require a remuneration that suits there qualification.

Unemployed teachers told by TSC to enroll in their respective sub-counties.

All registered jobless teachers have been urged by the Teachers Service Commission (TSC) to visit their respective sub-county TSC offices and register.

The TSC CEO Dr. Nancy Macharia testified before the National Assembly Committee on Education on important issues pertaining to teachers just one day prior to this.

Numerous charges were made before the Commission, including those pertaining to the promotion, hiring, and deployment of instructors, and the Commission had four days to answer.

The Commission is currently gathering data on unemployed teachers at the TSC Sub County Directors offices across the nation.

The information requested from teachers includes their complete name, TSC number, ID number, educational level (such as PTE, Diploma, Degree), course combination, home subcounty, and year of graduation.

The Commission was recently requested to give preference to hiring teachers who are at least forty years old.

When hiring teachers, the legislators instructed TSC to give age and year of graduation priority.

Local teachers, especially those who were interns throughout the recruiting process, have been prioritized by TSC.

But Nancy Macharia has kept her distance from politicians’ backdoor hiring of instructors.

According to her, she is unaware of any instances of politicians purportedly employing teachers. In spite of overwhelming proof of political interference in the hiring process, this is the case.

In the previous year, lawmakers replaced 6,000 instructors with themselves. In a burial ceremony, former CS Ezekiel Machogu was one of the politicians seen handing out job letters.

The same things keep happening again this year. Employment letters are being issued by politicians, including MPs, regardless of merit.

According to Isaac Mwaura, the government’s representative, this year the government will hire a total of 24,000 instructors.

The TSC has not yet hired almost 398,000 instructors. Under a project called ‘Mwalimu Majuu,’ the government intends to sell the majority of them overseas.

Several teachers were recently sent abroad to Qatar to work as educators. Teachers with a Kiswahili subject combination were airlifted by the government via TSC.

Teachers with Diploma and Degree credentials as well as Kiswahili/Any combinations were dispatched to Qatar, where they will earn a monthly wage of up to Ksh 170,000.

Those who work for the Commission or are completing an internship with the organization are eligible to apply to be exported, but they must first quit their positions before they may be considered, according to TSC CEO Dr. Nancy Macharia.

Teachers who are accepted into a program to teach abroad can get a passport in three days from the time they apply, thanks to the government’s preparations.

The government has established a policy framework and regulations that will serve as the foundation for a plan to place thousands of jobless teachers in jobs in at least 17 nations outside of the United States.

According to Nancy Macharia, the policy has been developed in response to requests by foreign governments for export of Kenyan teachers.

“Our research and consultations with the State Department of Diaspora Affairs confirm that there is high demand for Kenyan teachers in USA, Ireland and Germany – especially those who can teach English. Then there is South Africa for those who can teach Kiswahili, Thailand and other Middle East Countries. The policy is a targeted response to this market demand,” Ms Macharia said.

According to the commission, as at May 2024, it had on its register a total of 714,234 teachers, with 360,000 under employment by the TSC on a permanent basis.

“Other countries that are targeted for teacher exports include Kuwait, Japan, and the United Arab Emirates, which require special needs education teachers and Qatar (Islamic religious education and science teachers). Kiswahili teachers are needed in China, France, Botswana and Japan,” Ms Macharia said.

She added that those qualified to teach English are needed in France, Canada, Vietnam, Taiwan, South Korea, Russia, Spain, China, and the UAE.

The placements abroad will be through government-to-government labour export initiatives.

“The commission has received several delegations asking for partnership for the export programme. This necessitated the development of a policy framework to guide the process. As a government institution, TSC will work closely with the Ministries of Foreign Affairs and Labour, who will be responsible for exploring the markets for teacher export,” Ms Macharia said.

The selection criteria will define the essential skills a teacher has, qualifications, and experiences required for a specific international teaching job.

To qualify for placement abroad, a teacher must be a Kenyan citizen and completed training and graduated with a degree, diploma, or certificate in education from a recognised institution and meet other requirements of registration by the TSC.

The teacher must be registered by the TSC and meet the requirements of Chapter Six of the Constitution.

The teacher must also meet any additional requirements set by the host country, such as specialised training, professional certifications, language proficiency, or other specific job requirements.

“The commission will liaise with respective ministries and agencies to provide an orientation programme for the selected teachers that will cover issues that include security, medical, transport, terms of engagement, remuneration, career guidance and development, cultural sensitivity, transparency and accessibility, language skills (where applicable), and specific educational practices prevalent in the host country,” the policy document reads.

The TSC will also advocate for standardised contracts to detail all aspects of the terms and conditions of service including the salary, work hours, benefits, housing, insurance and repatriation terms.

“Teachers employed by the TSC on permanent and pensionable terms are required to resign from their current positions in order to take up international teaching jobs. The TSC will fill these vacancies to ensure teaching and learning are not interrupted. Subsequently, upon return, the teachers are not guaranteed a job but will be eligible to apply for vacancies as they become available,” the policy states.

In July 2024, the Prime Cabinet Secretary and Cabinet Secretary for Foreign and Diaspora Affairs Musalia Mudavadi flagged off some teachers who had secured teaching jobs in the US.

This was, however, not a government project but organised through a placement agency.

According to the document, the policy framework will formalise engagement of Kenyan teachers who will work abroad and also protect their interests “to “collaborate with relevant stakeholders and partners to provide guidance on clear, fair, and competitive terms and conditions of service for Kenyan teachers to be employed outside the Kenyan borders”.

It also aims at cultivating collaborative partnerships with the host countries. It advocates for global educational cooperation and lifelong learning through a structured approach that engages all categories of teachers in opportunities abroad.

“The implementation of this policy framework will therefore support Kenyan teachers as they venture into the international labour market where they will apply their skills and competencies,” the document reads.

Despite Kenya facing a deficit of teachers, the government has been unable to absorb all the qualified and registered tutors.

In October last year, when the TSC advertised for 46,000 vacancies, it received 314,117 applications, highlighting the high unemployment rate among graduates.

Schools at all levels have staffing gaps, which the government has been unable to plug for years. Junior school has been the worst hit since it rolled out two years ago.

While campaigning for presidency in 2022, President William Ruto had promised to employ 116,000 within two years but it has proved to be a difficult task.

“International teaching opportunities offer Kenyan teachers invaluable professional growth and development. Exposure to diverse educational systems, teaching methodologies, and cultural contexts enhances their effectiveness as educators. Additionally, Kenyan teachers working abroad contribute to the generation of remittances, supporting their families and boosting the country’s foreign exchange earnings,” the policy document reads.

According to the policy, the TSC will establish and maintain an updated database of Kenyan teachers who are available for international teaching employment opportunities and match them with relevant positions. The commission will also establish a criterion for selecting the teachers.

“The commission will establish a database that supports real-time data entry, storage, and retrieval of information about teachers that includes personal details, academic and professional qualifications, areas of expertise, host country and any relevant information. The database will also assist in data analysis and reporting,” the document reads.

The TSC will then establish a standardised application process where teachers can submit their credentials and express their interest in teaching opportunities abroad. Access to the database will be restricted to authorised personnel only.

The database will incorporate a feedback mechanism to gather insights from teachers about the registration and matching process and use the feedback to improve the database while the policy framework will be reviewed every three years or when the need arises.

President William Ruto’s administration has made labour migration a key pillar of its plan to create jobs.

The policy has divided opinion with critics questioning why the government should not create jobs locally and pointing to the slave-like conditions of some of the low-level jobs on offer, especially in the Middle East.

The Public Petitions Committee of the National Assembly has resolved to meet the top leadership of the Teachers Service Commission (TSC) regarding the criteria used in designating hardship zones across the country.

This decision was made during a session chaired by Hon. Edith Nyenze (Kitui West), following a petition by the Kenya Union of Post Primary Education Teachers (KUPPET) from Machakos County. The petition, presented by Hon. Vincent Musyoka (Mwala), raised concerns that Mwala and Kalama Sub-counties are excluded from the list of hardship areas, despite facing similar challenges as neighboring zones that qualify.

“As a Committee, we will meet TSC leadership and even the Salaries and Remuneration Commission (SRC) to find out the criteria they use to categorize areas as hardship zones,” said Hon. Nyenze.

The petitioners noted that teachers in the two sub-counties are denied hardship allowances, even though they are surrounded by regions that are already gazetted as hardship areas.

“Mwala is geographically located in the midst of Yatta, Kitui Rural and Mbooni East which are all hardship zones,” said Hon. Musyoka.
“In Kalama Sub-county, teachers in 33 public secondary schools are entitled to hardship allowance, while 9 schools have been left out,” he added.

Hon. Patrick Makau (Mavoko), another committee member, urged the Committee to also question the TSC on how it determines house allowances for teachers in metropolitan areas. He said there is a glaring disparity in the allocation of housing allowances between teachers in similar urban regions.

“It’s unfair for a teacher in Mlolongo in my constituency to get a lower house allowance than their colleagues in the nearby Embakasi South Constituency. The two areas are in the same Nairobi metropolitan region,” noted Hon. Makau.

Members of the Committee agreed that there is a need to harmonize house allowances for teachers working in metropolitan regions to ensure fairness.

In a separate session, Hon. Martin Owino (Ndhiwa) appeared before the Committee to present a petition on alleged unfair labour practices at Sukari Industries Limited in Homa Bay County.

According to the petition, there are claims of discrimination between local and foreign workers, including unequal pay for equal work and holding separate meetings for different staff groups.

“My prayer is that this committee inquires into the alleged discrimination, unfavorable working conditions and unfair treatment of both outsourced and directly employed workers whether local or foreign,” said Hon. Owino.

The Committee assured Hon. Owino that they will investigate the matter and even conduct a site visit to the factory. However, they requested more details to facilitate the inquiry.

“Those who have signed the petition should be categorised into the ones that belong to Sukari Limited and those who belong to outsourced companies,” directed Hon. Nyenze.

TSC protests inadequate funding for teacher promotions.

The Teachers Service Commission (TSC) has urged members of parliament (MPs) to increase the budget for the promotion of teachers.

Speaking yesterday during her appearance before the National Assembly Constitutional Implementation Oversight Committee (CIOC) led by Hon. Eric Karemba (Runyenjes), TSC CEO Dr. Nancy Macharia informed the lawmakers that the Commission cannot promote a sufficient number of teachers owing to limited funding.

She was delivering a report on the Commission’s achievements in meeting its constitutional obligations and the obstacles that impede effective service delivery.

Macharia cautioned about an impending education crisis caused by insufficient budget allocation for the promotion and distribution of teachers nationwide.

Dr. Macharia pointed out that although the government currently designates sh. 1 billion per year for teacher promotions, this sum is inadequate to meet the rising number of eligible teachers.

“Honourable Members, while we appreciate the Kshs. 1 billion earmarked for teacher promotions, this amount only allows for the promotion of 6,000 teachers out of a teaching workforce exceeding 500,000. This ongoing situation demoralizes deserving teachers and impacts service delivery in our schools,” Dr. Macharia emphasized.

Macharia indicated that the TSC requires sh5 billion annually to promote teachers and effectively prevent stagnation.

She made this statement in response after lawmakers expressed concerns regarding the issues surrounding teacher promotions.

The Commission has been receiving a budget of sh 1 billion each year for the purpose of promoting teachers, which Macharia described as a mere drop in the ocean.

“With just one billion shillings, we can only promote 6,000 teachers. We need five billion annually to adequately tackle stagnation,” Macharia asserted.

In 2024, TSC promoted a total of 19,943 teachers after securing sh 1 billion in the 2023 – 2024 financial budget.

Last week, TSC identified 25,252 teachers who were successfully promoted this year following their participation in interviews in January and February.

The teachers will receive their appointment letters at the end of this month before being assigned to schools with vacancies.

MPs further pressed the issue of fairness in promotions and the ambiguous criteria applied, with reports indicating that some constituencies received as few as five promotions.

“We had only five teachers promoted out of 25,000. If distributed evenly among the 290 constituencies, we should have received at least 80,” contended Tiaty MP William Kamket.

Despite the intense questioning, the Commission stated that it continues to operate within its limitations and is committed to enhancing teacher welfare across the country.

The TSC claims that the promotion bottleneck, staffing discrepancies, and health insurance challenges all originate from inadequate funding and urged Parliament to reconsider policies to allow for more sustainable planning.

Deadline for 2,014 Permanent Vacancies Nears

The deadline for new teachers seeking to fill 2,014 vacancies for primary, junior, and senior secondary school teachers is set to lapse on Monday.

The Teachers Service Commission (TSC) had posted a notice on May 6, stating that it would be replacing teachers who exited service through natural attrition.

“The teachers recruited will serve on Permanent and Pensionable terms of service. The deadline for the applications is May 19, 2025, midnight.” the notice read in part.

TSC noted that there are 1,309 vacancies in primary schools, 32 in junior secondary, and 673 in senior secondary schools.

To qualify for recruitment, candidates must be Kenyan citizens.

Applicants for primary school positions should hold a P1 certificate, while those applying for junior and senior secondary positions must have at least a diploma in education, with a minimum KCSE grade of C+ and C+ in two teaching subjects or their equivalent.

The applicants must also be registered as teachers under TSC.

The Commission has at the same time released the recruitment guidelines and a list of documents to be presented during the intervews.

TSC warned candidates against filling out more than one application for employment form, saying it will lead to disqualification.

Teachers’ agony in filling the 2019 Wealth declaration form, online through the TSC Website

The Teachers Service Commission, TSC, portal used by teachers to declare their 2019 assets, income and liabilities is posing serious challenges as it is inaccessible; most of the time. The site has been experiencing massive down times even as the deadline for filling the returns draws near. A spot check on the site shows that it is an uphill task using it during the day and even at night; when it is slightly accessible. Even after successfully filing the returns the system does not send a copy of the filled form to the declared Email address. This, thus, leaves teachers in dilemma; not sure whether their returns have been correctly filed.

What to do. 

To succeed in filing the returns and avoid the last minute rush it is advisable that ;

  • You exercise high levels of patience, when filling the form,
  • Continue trying and refreshing the page until the return is accepted and
  • Try out filling the online form at night when there are fewer users accessing the online portal.

If your return is captured, then you will see a success message (in green) informing you that a copy of the form has been sent to the entered email address.

TSC latest news on 2021-2025 CBA: The Teachers Service Commission (TSC) has reached a number of agreements in its engagement with the Kenya Union of Post Primary Education Teachers (Kuppet) concerning the 2021-2025 Collective Bargaining Agreement.

KENYA UNION OF POST-PRIMARY EDUCATION TEACHERS PRESS STATEMENT AT THE CONCLUSION OF THE KUPPET-TSC RETREAT AT THE NAIVASHA SAWELA HOTEL FROM 14 TO 18 MARCH 2021

KUPPET has held a very fruitful four-day retreat with the Teachers Service Commission to resolve policy and administrative challenges of the 2016-2021 CBA and review the status of negotiations for the new one for 2021-2026. This was the second retreat between KUPPET and the TSC, the first one having taken place in October/November 2019.

During the talks, it was clear that the union and the employer had undertaken their responsibilities under the CBA process. What remains is for the Salaries and Remuneration Commission to give its Advisory to the TSC to enable the employer to table a counter offer to the union. We are seriously concerned by this delay by SRC, since the expiry of the current CBA on 30 June is fast approaching.

1. NEW CBA TO GIVE TRUE WORTH OF CLASSROOM TEACHER

KUPPET and the TSC have developed new Job Descriptions capturing the true worth of a classroom teacher. The new Job Descriptions recognise the teachers’ leadership and technical work within and outside the classroom, which had been ignored by the evaluation tool previously used by the SRC.

There are up to 30 new roles of the classroom teacher, including:
(i) Class management
(ii) Substantial financial responsibility during outdoor activities like tours and sports.

In the new CBC curriculum, a teachers’ work will even be more complex.

2. PROMOTION OF C3 TEACHERS AND TTC TUTORS

The Job Re-Evaluation has resulted in the creation of a new opening in C4 for Senior Master IV and Senior Lecturer IV for those in TTCs who do not have administrative positions. At the moment, the Commission has advertised 6,680 vacancies for these cadres as the first step towards institutionalising C4 as a promotional grade from C3.

Under the CBC, the TTC tutors will be training teachers at the Diploma level, hence the repositioning of their roles. Administrators in TTCs including Deans and Registrars will have a clear career path with substantive appointments.

3. DIPLOMA TEACHERS

The career path for Diploma Teachers has been clarified. By the commencement of the 2016 CBA on 8 November 2017, more than half of teachers who had joined service at Job Group had obtained Bed degrees and transited to the Graduate Scheme of Service.

Among those who had not, those who had served for more than three years in one Job Group had been promoted to the next Job Group, i.e., Job Group k or L, under the common cadre promotions.

However, a small number of the teachers, who had served in one Job Group for less than three years, had their promotions following the scrapping of one common cadre promotional level. Following the union’s memorandums, the Commission has advertised positions specifically to this group of teachers. We understand that the Commission received fewer applicants than the number of vacancies it declared.

4. MATERNITY LEAVE FOR INTERN TEACHERS

The Commission agreed that, except for specific provisions of their contracts, all intern teachers will work under the same conditions as provided under the Code of Regulations for Teachers. The intern teachers qualify for maternity leave of 90 calendar days with effect from the expected date of delivery, as do other teachers.

5. POLICY ON POST-GRADUATE QUALIFICATIONS

The Commission agreed to suspend the requirement of a Master’s degree for Principals or other promotions within the teaching service. This is in line with regulations by the Public Service Commission which has scrapped the requirement of a Master’s degree for promotions at Job Group P and above. Post-graduate qualifications will be considered as an added advantage.

The union, however, demanded the introduction of a Post-Graduate Allowance for teachers who possess Master’s and PhD degrees irrespective of their position in service.

6. REDEPLOYMENT OF GRADUATE TEACHERS FROM PRIMARY

In readiness for the new CBC curriculum, the Commission will promote 1,000 graduate teachers who initially had P1 qualifications to secondary schools every financial year. By June 30, it shall have redeployed 2,000 of such teachers, and the redeployment will continue until the numbers are fully addressed. The teachers must have obtained a KCSE mean grade of C+ and C+ in two teaching subjects.

7. TEACHERS’ MEDICAL SCHEME

The meeting observed the numerous problems teachers face in accessing health services under the Medical Scheme. It was agreed that an inter-parties meeting between the TSC, Minet and KUPPET would be held soon to discuss the issues and recommend solutions.
