Latest TSC News: Commission gives details on T-Pay, Training of teachers on CBC and relationship with teacher unions

The Teachers Service Commission, TSC, has moved to set the record straight concerning its relationship with teachers’ unions. In what is seen as a direct response to the Kenya National Union of Teachers’, KNUT, aasertion that the TSC wants to cripple its operations, TSC now says it has no powers to deregister any trade union.

Here is the presser from the TSC boss, Dr. Nancy Njeri Macharia;

‘STATEMENT ON TEACHERS SERVICE COMMISSION’S RELATIONSHIP WITH TEACHERS’UNIONS

The Teachers Service Commission (TSC) wishes to set the record straight in regard to its relationship with the Teachers’ Unions and state as follow:

TSC as a Corporate Entity

As a corporate entity and as provided under the law. TSC executes its mandate through the Board led by the Commission Chairperson, Dr Lydia Nzomo. The Commission is supported by a Secretariat headed by the Secretary/Chief Executive Officer who is charged with the duty of implementing Board decisions.

As a public institution, the Commission remains committed to supporting the Government in the realization of its development agenda through the provision of quality education. Over the last two years, the Commission has recruited an additional 18,700 teachers to support the policy of 100 percent transition of learners to secondary schools. In addition, to several other key milestones, TSC has fully expedited the processing of pension claims and automated its payroll system, including the management of all third-party deductions.

The Commission was recently feted by the African Union (AU) for the Third Party Transaction Management System (T-PAY). This is an innovative IT platform that allows teachers to manage their third-party deductions, including union dues and financial transactions against their pay. The TSC win was under the category of Best Ethical Managed, Accountable, Transparent and Accessible organization. T-PAY has greatly improved our service delivery to teachers who can now manage all their third-party transactions at the click of a button, while preserving their right to data privacy. As a direct corollary, this has enhanced contact hours between teachers and learners, consequently improving learning outcomes.

To ensure that teachers are adequately prepared to successfully implement the Competence Based Curriculum (CBC). TSC has trained a total of 159,810 teachers during this year. (some 91,620 in April and 68.490 in August). A further 68.490 are scheduled to be trained in December, bringing the total to 288,000 by the end of 2019. As we come to the close of the year, we wish to thank our teachers for their dedicated and selfless service to the nation. We assure them of our commitment to serve and support them.

Relationship with Teachers’ Unions

TSC recognizes teachers’ unions as key stakeholders in the teaching service and the critical role they play in representing teachers’ issues.
Initially, TSC had an unstructured relationship with the unions. It is not until June 2016, that TSC. under the current leadership, made a fundamental decision to sign Collective Bargaining Agreements (CBAS) with teachers’unions. TSC and the recognised teachers’unions signed the first CBA, covering the period 2013-2017 in June 2016. In October, 2016, the TSC and the unions signed a second CBA covering the period July 1, 2017 to June 30, 2021, through which the Government committed Sh54billion in improved salaries and allowances for teachers.

The overall objective of the CBAs was to promoteindustrial harmony and constructive social dialogue in the teaching sector. The culture of industrial unrest that had dominated the teaching service has now been conclusively addressed, thanks to the partnership of teachers and the TSC leadership to address teachers’ issues in a structured and regulated manner. This has led to improved quality teaching for our children on whose behalf we have all been called to serve

In its engagement with the unions, TSC operates strictly within the legal provisions that guide such a relationship. Any action initiated by the Commission is done after careful thought, review, in good faith and in strict conformity with the law. We wish to clarify that under the law. TSC has no power to register or de-register a union as that is the exclusive mandate of the Registrar of Trade Unions.

Similarly, under the law, to sustain a Recognition Agreement between an employer and a union, there are certain minimum requirements that a union must meet. However, in the event a union fails to meet the statutory threshold, the employer will continue to remit all dues payable to such a union.

The Commission has continued to work with registered unions even without a recognition agreement. Further, the process leading to revocation of a Recognition Agreement is elaborate and intricate.
It starts with issuance of the notice of intention and culminates with the decision reached by the National Labour Board. Parties involved still have an opportunity for conciliation and ultimately, judicial adjudication. This process is succinctly provided for by the law. Accordingly, the narrative being advanced that the Commission intends to kill any union is not only false but also misleading

Conclusion

Finally, the Commission wishes to assure all teachers that it absolutely has no desire or interest to constrict their avenues for expression and right to union representation. Equally, the Commission will continue to work harmoniously with all registered trade unions operating within the teaching service.’

12,000 new teachers to be hired as TSC promotes 55,000

The Teachers Service Commission, TSC, will be hiring 12,000 new teachers ahead of the January 2021 full reopening of schools. Under the Economic Stimulus Programme, the commission was allocated Sh2.4 billion funds to engage 12,000 interns.

According to TSC Boss Dr. Nancy Macharia, recruiting the additional 12,000 teachers will bring to 23,574, the total number of teacher interns hired since last year.

In the current financial year, the commission received a budget of Sh2.5 billion to employ 5,000 teachers on Permanent and Pensionable terms.

In a report tabled by Dr. Macharia during a two-day consultative forum with National Assembly Education Committee this week,  TSC requires Sh17 billion to hire about 26,000 teachers to address staffing gaps in secondary schools. An additional Sh8.1 billion will be required annually to hire 12,500 teachers to plug the normal shortage. The situation is worsened by current Covid 19 pandemic and the 100 percent transition policy.

Macharia says her target to enroll 12,500 new teachers yearly has not been met due to inadequate budgetary provisions. She added that under normal staffing, the commission needed 50,504 teachers to support the existing staff establishment.

The Commission is also set to train close to 118,000 teachers next month on the Competency-Based Curriculum (CBC) at a cost of Sh1 billion. See details on this training here.

“The commission intends to prepare teachers for eventual re-opening of schools through training, capacity building, sensitization and induction programmes,” She added.

Teacher promotions.

TSC says about 55,000 teachers have been promoted this year. Another 3,900 are scheduled for interviews. Similarly, 460 teachers have already been interviewed and their letters are on the way.

The Legislators wants the Commission to come up with a clear policy in promoting teachers in order to avoid situations where most stagnate in same job grades for long. But, Macharia was quick to point out that budgetary constraints were to blame.

“The criteria used in promotion of teachers include the availability of budget/funds; the existence of vacancies in the authorised establishment; merit and ability as reflected in the teacher’s work performance; academic and professional qualification among others,” she explained.

Dr. Macharia, sought the committee’s indulgence in finding a lasting solution to the challenges faced by the commission, among them; the need to develop a policy framework to guide the employment and promotion of new and older teachers.

TPAD 2 Lesson attendance; How to input the data into the system

Lesson attendance records for all teachers must be updated regularly on the Teachers Service Commission, TSC, TPAD 2 system (http://tpad2.tsc.go.ke/). It is the responsibility of the Deputy Head of the institution to keep track of the lesson attendance records.

Importance of the lesson attendance by Teachers

The Code of Conduct and ethics section 12 (2) provides that a teacher shall observe official working hours, be punctual and meet deadlines.

The Lesson attendance records form part of the evidence for the part B of the appraisal standards; Teacher Conduct and Professionalism which measures a teacher’s attributes,
behaviour, performance and adherence to the set regulations governing the teaching
profession.

Lesson attendance will simply show if a teacher is adhering to the set time table and that he attends all lessons allocated therein and also observe punctuality.

The lesson attendance is a summary of the updated and analysed Teacher Lesson Attendance Register that is captured by the class representative showing what time a teacher came to class and the time he left.

The Lesson attendance register is submitted to the Deputy Headteacher at the end of each day.

The deputy is required to undertake lesson attendance analysis for each teacher in every subject weekly.

How to capture teachers’ lesson attendance into the TPAD 2 system

The Deputy Head of institution, DHoI, is the only person with rights to enter the data on lesson attendance for all the teacher in the institution.

As indicated earlier he is the one in charge of analyzing the Lesson Attendance Records (LAR) for all the teachers, he will input the weekly summary for every teacher.

To update lesson attendance records;

  1. The DHOI will log into his portal, go on the dashboard menu click on Appraiser appraisal.
  2. A drop down menu with pending appraisals, schedule meetings, weekly attendance appears, click on Weekly attendance.
  3. The portal on weekly attendance will be displayed. Click on +add attendance.
  4. A pop up window is displayed, select the name of the teacher by clicking on the downward arrow.
  5. In the next step click on the week ending, a calendar will appear and you can choose the week you are capturing, you can also select a different month.
  6. The DHOI can then input ;
  • The lesson to be taught – which are the number of lessons allocated to a teacher as per the school time table.
  • No of lesson taught – the lessons a teacher has been able to attend and teach.
  • No of Lesson recovered – in the event a teacher fails to attend a lesson, he/she is required to make arrangements to recover the lesson, once it recovered it should be recorded as taught.
  • Attendance remark- brief remarks about the teacher’s lesson attendance that week, use the save button to ensure the information is captured in the system.

7. The system will then display the message below click on ‘ok’. Repeat the process to capture all the weeks for each individual teacher and ensure you capture details for all the teachers in the school.

8. The teachers captured will appear on the interface. The filter search button: enables the DHOI to search for teachers who attended lessons in a particular week.

9. Click on the down arrows to choose the year, then choose the term, and click on the calendar on week ending and choose the week you want to search. Click on search.

10. The next interface displays the number of records found for that week and on the table it gives details of all the teachers for only that week.

Repwieve for university students as HELB finally distributes Ksh.1.56 billion

The government, via the Higher  Education Loans Board (HELB), has allocated Ksh.1.56 billion to students and trainees for their tuition and living expenses.

Online education courses

Education Cabinet Secretary Migos Ogamba announced that the funds were released on Friday, providing crucial support for university and college students currently enrolled in the program.

“A total of 31,263 TVET trainees and 33,863 university students will benefit from these loan disbursements,” the CS noted.

“This funding will ensure that the needs of students and trainees are addressed, allowing them to pursue their academic, training, and research activities without obstacles.”

Online education courses

Beneficiary students and trainees have been informed of the disbursements through HELB’s official communication channels and are advised to check their portals.

In the current Financial Year 2024/2025, HELB has disbursed a total of Ksh.32.7 billion for living and tuition loans, which are expected to assist 195,522 trainees in TVET institutions and 390,612 university students.

The CS expressed confidence that the government would continue to support university students and TVET trainees in achieving their academic and training objectives, despite the ongoing debate surrounding the new University Funding Model.

This disbursement follows pressure from some MPs and stakeholders regarding the delay in HELB fund distribution, which had left many students in financial distress.

Last month, Kirinyaga Woman Representative Njeri Maina raised concerns about the delay, urging the Departmental Committee on Education to clarify the funding crisis.

Online education courses

The delay was a result of a High Court ruling on December 20, 2024, which deemed the new higher education funding model unconstitutional, preventing its implementation until the government complies with constitutional and legal standards.

In response, the Ministry of Education committed to introducing a revised funding model for tertiary education, expected to be launched later this year. Meanwhile, the government has pledged to revert to the previous HELB funding system.

The financial strain has led to unrest at several universities, with students protesting and, in some cases, lecturers boycotting exams in solidarity with affected students.
